The Planning Commission met in regular session at 9:05 a.m. in the County of Hawaii, Aupuni
Center Conference Room, 101 Pauahi Street, Hilo, Hawaii, with Chairman William R. Graham
presiding.

The Chair introduced the Commissioners and staff to members of the public.

Continued hearing on the application for a Change of Zone for 88,317 square feet of land from a
Single-Family Residential - 10,000 square feet (RS-10) to a Neighborhood Commercial - 40,000
square feet (CN-40) district. The property is located along the north side of Puainako Street,
between Kilauea Avenue and Kekela Street, across from the KTA Super Stores complex,
Waiakea, South Hilo, Hawaii, TMK: 2-2-39: 31, 57, 68 and 69.

REZ 06-000058The Commission took this item up at 10:40 a.m. with
MICHAEL TANABE approximately 7 people from the public in attendance.

APPLICANT: MICHAEL TANABE (REZ 06-000058)
Change of Zone from an Agricultural 10-acre (A-10a) to a Family-Agricultural 3-acre (FA-3a)
district for ten acres of land. The property is located at the southwest corner of Kupulau Road
and Koaniani Street, Waiakea, South Hilo, Hawaii, TMK: 2-4-65: 34.
Mr. Darrow oriented the Commission and public of the subject and surrounding properties on the
location map and site plan, summarized the request and noted the Planning Directors favorable
consideration on the matter to the County Council with conditions.
The applicant, his wife and his representative, Brian Nishimura, were in attendance.
Mr. Nishimura stated the applicants have reviewed the Background Report and Recommendation
and will be able to comply with the proposed conditions.
For Commissioner Siracusas information, Mr. Nishimura clarified that the applicant has always
wanted to create three lots; however, the Director did indicate he would not be able to support
sucharequestatthistimebecauseofthepresentfloodhazarddesignationaffectingthemiddleof
the property. He said he was aware that the Department of Public Works and FEMA are
currentlyconsideringimprovementstotheWaiakeaStreammaukaofthepropertywhichmay
reduce the area affected by the flood hazard designation and allow for more buildable area on the
lowersectionofthesubjectpropertytocreateanotherlot.
Mr.Darrowindicatedonthepresentationmapthedividinglinebetweenthetwoproposedlots
and the 40-foot right-of-way reserved for future widening of that street, which will then preclude
abuildableareainthatparticularcorner.
Mr. Yuen at this time proposed a new Condition E, with the remaining conditions realphabetized
accordingly, and amended the first sentence in Condition D.

It was moved by Commissioner Watanabe and seconded by Commissioner Domingo to send a
favorable recommendation to the County Council with the following new Condition E, with the
remaining conditions realphabetized accordingly: The property shall not be subdivided into
more than two lots unless the Flood Insurance Rate Map is revised to provide an additional
buildable area, and the first sentence in Condition D amended to read, There shall be no
construction of single-family dwellings and related improvements or other substantial buildings
or subdivision roads within areas designated AE or shaded Zone X by the Flood Insurance
Rate Map (FIRM). Upon Commissioner Woodwards inquiry, staff stated the correct rezoning
number is REZ 07-000058. A roll call vote was taken and motion carried with six ayes
(Watanabe, Domingo, Rho, Siracusa, Woodward and Graham) and two absent and excused
(Alameda and Iwashita).

SPECIAL PERMIT 05-009The Commission took this item up at 11:17 a.m. with
MELVIN W. MIRANDAapproximately 5 people from the public in attendance.

SPECIAL PERMIT NO. 05-009 (APPLICANT: MELVIN W. MIRANDA)
Revocation of Special Permit No. 05-009 granted onAugust 18, 2005 which allowed the
establishment of a contractors base yard on approximately one acre of land situated inthe State
Land Use Agricultural District. The property is located along the north (makai) side of the
Hawaii Belt Highway (Highway 19) at approximately the 47.5-mile marker, Kapoaula,
Hamakua, Hawaii, TMK: 4-7-7: portion of 55.

Review and comment on a draft ordinance (Bill 318) amending Chapter 25 (Zoning Code),
Article 2, Division 4, Section 25-2-44, HawaiiCounty Code 1983(2005 Edition, as amended)
relating to conditions of change of zone (adds requirements to existing provisions within the
Zoning Code relating to conditions on change of zone ordinances regarding water supply and
transportation improvements or strategies be madeconcurrent with development associated with
any change of zone in order to manage growth and coordinate the delivery of government
services).

Review and comment on a draft ordinance (Bill 319) amending Chapter 23 (Subdivision Code),
Article 2, Division 1, Section 23-13, Hawaii County Code 1983 (2005 Edition, as amended)
relating to Large Scale Developments (adds requirements to existing provisions within the
Subdivision Code relating to large scale developments regarding water supply and transportation
improvements or strategies be made concurrent with development in order to manage growth and
coordinate the delivery of government services).
INITIATOR: COUNTY COUNCIL
Review and comment on a draft ordinance (Bill 328) amending the Hawaii County Code 1983
(2005 Edition, as amended) by adding a new chapter relating to concurrency (establishes a
concurrencymanagementsystemandpreparesapublicfacilitiesimprovementplantofundand
maintain county-wide facilities and services).
INITIATOR: COUNTY COUNCIL
Review and comment on a draft ordinance (Bill 329) amending the Hawaii County Code 1983
(2005 Edition, as amended) by adding a new chapter relating to adequate public facilities (relates
to adequate public facilities for the identification of infrastructure and services necessary to
support new development and the establishment of a policy as to when and how these
improvements and services will be constructed and maintained).

MINUTESThe Commission took this item up at 2:45 p.m.
February 2, 2007 It was moved by Commissioner Watanabe and seconded by Commissioner
Siracusa that the minutes be approved as circulated. Motion was unanimously carried by a voice
vote of all Commissioners in attendance.
ADMINISTRATIVEThe Commission took up the following under Administrative
MATTERSMatters at 2:47 p.m.:
Ainaloa Development Corp.s Use Permit 106 Mr. Torigoe noted the Circuit Court upheld the
PlanningCommissionsdecisionandthedeveloperscounselhasstatedtheywillnotbetaking
any further appeal from that decision, noting thefinal order will be entered shortly.

D-Bar Ranch, LLCs SMA 06-000009 Mr. Torigoe noted that he just filed an answering brief
th
in the Circuit Court and the oral argument is set for March 16 at 8 a.m. in Hilo, noting this will
delay his attendanceofthe Planning Commission meeting also on that day in Kona.
Daniel Ibbetsons SPP 05-000015 In response to Commissioner Watanabes inquiry,
Mr. Torigoe said has not heard of any progress was being made in the mediation. Mr. Hayashi
noted that Dennis Kruger stated they have not as yet finalized their agreement

9:00 a.m. in the County of Hawaii Aupuni Center Conference Room in Hilo.
