MAYOR'S EMERGENCY RULE,#1.
Pursuant to the authority vested in me by Hawaii Revised Statutes Sections 127A-
1.2(a)(5)(1:1), 127A-12(e)(12), 127A-12(c)(14), 127A-25 and 291C-111, 1 hereby promulgate the
following rule to prohibit harking and traversing/'walk-ing on the Daniel K. Inouye Highway and
its shoulders between the 16 mile marker and the 31 mile marker(hereinafter the"Area")which
is also shown as the area marked(highlighted in yellow)on the map attached hereto as Exhibit
"A",except as permitted at designated parking lots.'This restriction is necessary due to the
presently ongoing and active volcanic eruption of Mauna Loa in the Northeast Rift Zone creating
unsafe road conditions and hazards due to increased vehicle and pedestrian activity.
1. Barking on the Area shall be limited to County, State,or Federal govermrental
employees and verified governmental contractors only.
2. This Emergency Rule shall have the force and effect of law. Pursuant to Hawaii
Revised'Statutes Section 127A-29(a),any person violating this Rule shall be guilty of a violation.
and upon conviction fined not more than$1„000,00.
3„ This [Emergency Rule shall be effective immediately,upon publication of this
Emergency Rule,and shall continue throughout the present emergency caused by the ongoing
active e volcanic eruption or until sooner terminated by my Order.
