MINUTES
NOVEMBER 21, 2003
The Planning Commission met in regular session at 9:00 a.m. in the County Building,
Councilroom - Room 201, 25 Aupuni Street, Hilo, Hawai`i, with Ch
Galdones presiding.

a.Application for a State Land Use Boundary Amendment for 3.344 ac
from the Agricultural to the Urban District.
b.Application for a Change of Zone for 12.640 acres of land from L
20,000 square feet (ML-20), General Industrial Î 5 acres (MG-5a), Village
Commercial Î 10,000 square feet (CV-10 to RS-20) and Agricultural
20-acre (A- 20a) to Single Family Residential Î 20,000 square feet (RS-20) and
ML-20 districts.
c.Application for a Special Management Area (SMA) Use Permit to al
development of 30 lots, including portion of a roadway lot, and related
improvements.
The area involved includes the former Hilo Coast Processing Mill complex and
surrounding former sugar cane lands at Pepeekeo, South Hilo, Hawaii, TMK: 2-8-07:
portions of 1 and 53.

REZ ORD. 93-100The Commission took this item up at 11:29 a.m. with
DIANNE ANDapproximately 12 people from the public in attendance.

APPLICANT: DIANNE AND EDWARD HIRAYAMA(REZ ORD. 93-100)
Request for time extension to condition C (construction timetable) of Change of Zone
Ordinance No. 93-100, which rezoned 11,250 square feet of land from a Single Family
Residential 10,000 square foot (RS-10) to a Limited Industrial Î 10,000 square foot
(ML-10) district. The property is located along the west side of Hinano Street,
approximately 150 feet north of the Hinano Street Î Kawili Street intersection, Waiakea,
South Hilo, Hawaii, TMK: 2-2-50:8.
Mr. Darrow oriented the Commission and public of the subject and surrounding
properties on the location map and site plan, summarized the request, and noted the
Planning Director recommended approval of the application with conditions. He
corrected the Background Report, Page 2, Item 3, by changing the date October 8, 2003
to October 8, 1993.
The applicant, Dianne Hirayama, had no comments on the Backgroun
Recommendation.
Dwight Vincent who signed up to testify was not in attendance.
There was no one in the audience wishing to testify on this agenda item.
It was moved by Commissioner Kubota and seconded by Commissioner Mina that the
public hearing be closed. Motion was unanimously carried by a voice vote of all
Commissioners in attendance.
It was moved by Commissioner Kubota and seconded by Commissioner Fujikawa to send
a favorable recommendation to the Hawaii County Council based on and incorporating
the Planning DirectorÓs recommendation. A roll call vote was taken and motion carried
with eight ayes (Kubota, Fujikawa, Graham, McCall, Mina, Springer, Thibeadeau and
Galdones) and one absent and excused (Smith).
SLU 03-009/REZ 03-021The Commission took this item up at 11:38 a.m. with
PLANT-MASON approximately 10 people from the public in attendance.

a.State Land Use boundary amendment for 2.862 acres of land from t
Agricultural to the Urban District.
b.Change of zone for 14.771 acres from a Single Family Residential
square foot (RS-15) and an Agricultural 20-acre (A-20a) district to a Residential
and Agricultural 2-acre (RA-2a) district.
The property is located adjacent to and west (mauka) of Haaheo E
Wainaku, South Hilo, Hawaii, TMK: 2-6-32:6.

APPLICANT: HAWAII BREWERY DEVELOPMENT CO., INC.
(REZ 03-022/SPP NO. 842)
a.Change of zone for 14.587 acres of land from an Agricultural 20-acre (A-20a) to
an Agricultural 5-acre (A-5a) district.
b.Request for a time extension to condition no. 5 (construction timetable) of Special
Permit No. 842, which allowed the development of a brewery and b
on 14.587 acres of land situated within the State Land Use Agricultural District.
The property, which includes the Hawaiian Natural Water Co., Inc
facility, is located along the old "Slaughter House Road", approximately 700 feet east of
the Highway 11, Keaau, Puna, Hawaii, TMK: 1-6-141:1.
Mr. Darrow oriented the Commission and public of the subject and surrounding
properties on the location map and site plan, summarized the requests, and noted he
Planning Director recommended approval of the applications with conditions.
Commissioner Graham requested comments from the Director inasmuch as even though
what is proposed was a downzoning of agricultural land, no ag uses are being proposed.
Mr. Yuen said he did not see this as being a problem since a special permit has already
been approved and what is proposed does not change any of the uses on the ground.
In response to Commissioner McCallÓs inquiry, Mr. Fuke explained that a special permit
was issued for a 14.587 acre area out of the original 18.7 acre site of the former Miko
Slaughter House; and as required by the special permit conditions, the applicant
consolidated with the adjoining 2.3 acre property with the 18.7 acre area to come up with
the scheme proposed today.
In partial answer to Commissioner GrahamÓs inquiry, Mr. Fuke noted that the area is
already covered by a special permit and as he thought the County Code prohibits the
granting of any lot size variance where the intent violates the density effect, they had no
alternative but to apply for the zone change, noting the Director indicated the proposal
does not have any material impact on what is already permitted in that area. He said
perhaps an argument can be made that they have already complied with the conditions so
no time extension is needed; however as the Director accurately noted they did not
construct the brewery, the bottling company is started, and they want to be able to
separate the bottling plant operations from their upcoming brewe

FLORIDA RSA #8 LLCapproximately 5 people from the public in attendance.

APPLICANT: FLORIDA RSA #8 LLC Î fka USCOC of Hawaii 3, Inc.
(SPP NO. 1084)
Request to delete or modify condition number 2 (planting of trees along ridge line),
number 3 (proposed tree planting), and number 4 (tree planting plan) of Special Permit
No. 1084, which allowed the use of an existing 195-foot telecommunication tower,
antenna, accessory equipment building and structures, and security fence on
approximately 6,100 square feet of land, including access easement, within the State
Land Use Agricultural District. The project site is located above and on the Hilo side of
Maulua Gulch, approximately 1.3 miles mauka of the Hawaii Belt Highway, Maulua Iki,
North Hilo, Hawaii, TMK: 3-4-1: Portion of 22.

MINUTESAt 2:35 p.m., the Commission took up the following
minutes:
October 17, 2003 Î It was moved by Commissioner Kubota and seconded by
Commissioner Fujikawa that the minutes be approved as circulated. Motion was
unanimously carried by a voice vote of all Commissioners in attendance.
ADMINISTRATIVEThe Commission took up the following under
MATTERS administrative matters:
Status of appeals filed on Planning Commission decisions - Corporation Counsel Î
Ms. ÓToole reported that there is before the Supreme Court an appeal on the Fire
Mountain RetreatÓs special permit application.
Other Commission matters Î Mr. Hayashi noted that staff will be meeting with the Chair
shortly on the selection of hearings officers for the contested cases on Florida RSA #8
LLC and Eric Soto.
ANNOUNCEMENTThe following announcement was made:
Planning Commission Meetings Î Mr. Hayashi announced that the next Planning
Commission meetings are scheduled for December 4 and 5, 2003 at the Hapuna Prince
Hotel.
ADJOURNMENTThere being no further business, the Chair declared the
meeting adjourned at 3:31 p.m.
