MINUTES
NOVEMBER 3, 2022
The Windward Planning Commission met in regular session at 9:02 a.m., in the County of
Hawaii, Council Chambers, 25 Aupuni Street, Hilo, Hawaii, with Chair Dennis Lin presiding
with a live stream video for the public to observe the meeting.
COMMISSIONERS PRESENT: Dennis Lin, Gilbert Aguinaldo, Lauren Balog, John Cross,
Wayne De Luz, and Michelle Galimba.
ABSENT AND EXCUSED: Louis Daniele III.
ALSO PRESENT: Malia Kekai, Esq. (Counsel for the Commission), Jean Campbell, Esq.
(Counsel for the Planning Department), Zendo Kern (Planning Director), Jessica Andrews
(Planner), Clinton Mercado (Planner), Janice Hata(Zoom Host), Christian Kay (Acting Planning
Program Manager)and Melissa Dacayanan-Salvador (Windward Planning Commission
Secretary).
And none from the public in attendance.
A quorum was present. Chair Lin called the meeting to order. He described the public
accessibility to this meeting and the protocol for the participants to follow.
Chair Lin called the roll of the Commissioners and introduced the staff.
APPROVAL OF MINUTES
At 9:04 a.m. the Commission took up the minutes of the October 6, 2022, Windward Planning
Commission meeting. No corrections were offered. It was moved by Commissioner Aguinaldo
and seconded by Commissioner Cross that the minutes be approved as submitted. A voice vote
was taken, and the motion carried with all in favor, and none opposed.
STATEMENTS FROM THE PUBLIC ON AGENDA ITEMS
Chair Lin explained the procedure in providing public testimony and a reminder to Rule 1-5 of
the Planning Commission's Rules of Practice &Procedure to be courteous and respectful to all
testifiers, staff members and commissioners. There was no public testimony.
Chair Lin called for a recess at 9:05 a.m., and the meeting was reconvened at 9:10 a.m.
There were no in-person or Zoom testifiers.

NEW BUSINESS
1. APPLICANT: ROBERT J. SILBER(PL-SPP-2022-000016)
Application for a Special Permit to legitimize the operation of a holistic education center
on approximately 8.134 acres of land in the State Land Use Agricultural District. The
subject property is located at 13-2060 Lolia Place, approximately 0.3 miles northwest
(mauka) of its intersection with Kalapana-Kapoho Beach Road, Pohoiki, Puna, Hawaii,
TMK: (3) 1-3-002:140.
The Commission took up this item at 9:10 a.m. with 2 members from the public in attendance
and there were no members of the public testified.
Chair Lin stated the applicant had requested to defer the application until the next meeting.
2. APPLICANT: SHALEEN CURLEE (AMEND SPP 1139/PL-SPP-2022-000023)
Application for a ten (10)-year time extension to Condition No. 2 (life of permit) of
Special Permit No. 1139, which allowed the establishment of an auto repair shop and
towing service operation on 4,421 square feet of land in the State Land Use Agricultural
District. The subject property is located at 15-1505 Paradise Drive, on the northeast
corner of the 19t'Avenue-Paradise Drive intersection, Hawaiian Paradise Park
Subdivision, Kea`au, Puna, Hawaii, TMK: (3) 1-5-041:190.
The Commission took up this item at 9:11 a.m. with 2 members from the public in attendance.
At 9:17 a.m. it was moved by Commissioner Galimba and seconded by Commissioner
Aguinaldo that public testimony be closed for this agenda item. There being no discussion on
the motion, a voice vote was taken, and the motion carried by unanimous vote of those present.
It was moved by Commissioner Galimba and seconded by Commissioner Aguinaldo that the
request to amend Special Permit No. 1139 be approved based on the Planning Director's
recommendation. A roll call vote was taken, and the motion carried with six ayes (Galimba,
Aguinaldo, Balog, Cross, De Luz, Lin) and one excused.

PLANNING DIRECTOR'S REPORT
Report on Special Management Area (SMA) determinations, minor permits action issued
by the Planning Director.
At 9:26 a.m. Chair Lin introduced this item. Acting Program Planning Manager, Christian Kay
stated the Short-Form Assessment Log and the SMA Assessment Log were emailed to the
Commissioners and there were no questions.

AGENDA ITEMS FOR NEXT MEETING
At 9:27 a.m. Chair Lin introduced this item. Acting Program Planning Manager, Christian Kay
stated the Robert Silber agenda item will be moved to next month's agenda and along with two
agenda items. He also mentioned the election of officers for 2023 will take place.
ANNOUNCEMENTS
The Windward Planning Commission's next monthly meeting is scheduled for Thursday,
December 1, 2022, at the County of Hawaii County Council Chambers and the public may
provide verbal testimony by interactive video conference via Zoom or at the physical
location.
Chair Lin stated Vice Chair Michelle Galimba will be resigning from the Windward Planning
Commission effective November 4, 2022. Director Kern on behalf of the Planning Department
and the Mayor and the community expressed his appreciation and service. He presented a
certificate of appreciation. Vice Chair Galimba thanked everyone for the opportunity.
ADJOURNMENT
There being no further business, it was moved by Commissioner Aguinaldo and seconded by
Commissioner Daniele that the meeting be adjourned. A voice vote was taken, and the motion
carried by unanimous vote of those present. Chair Lin adjourned the meeting at 10:39 a.m.
