HomeMy WebLinkAbout2008-12-11 Planning Commission Minutes PLANNING COMMISSION COUNTY OF HAWAII MINUTES DECEMBER 11, 2008 The Planning Commission met in regular session at 9:40 a.m. in the Hapuna Beach Prince Hotel, Hau Room, 62-100 Kaunaoa Drive, Kohala Coast, Hawaii, with Chairman Rodney Watanabe presiding. PRESENT: Rodney Watanabe ABSENT & EXCUSED: C. Kimo Alameda Lani Bowman Shelly Ogata Takashi Domingo Frederic Housel Andrew Iwashita (from 10:35 a.m.) Rell Woodward Ivan Torigoe, Deputy Corporation Counsel  Daryn Arai, Acting Planning Director Norman Hayashi, Planning Program Manager Jeff Darrow, Staff Planner Maija Cottle, Staff Planner The Chair introduced the Commissioners and staff to members of the public. USE 07-000009 The Commission took this item up at 9:40 a.m. with two people HAWI JODO MISSION from the public in attendance. HAWI, NORTH KOHALA APPLICANT: HAWI JODO MISSION (USE 07-000009) Request to include a pre-school to Use Permit No. 07-000009, which initially allowed the establishment of an elementary school (K-6). Also requested are time extensions to condition no. 2 (submittal of water usage calculations and water commitment) and condition no. 3 (submittal of plans for plan approval) and deletion of the paved driveway access and paved parking requirements in condition no. 3. The property is located at the southeast corner of Highway 270 (Akoni Pule Highway) and Ilina Road, Kahei House Lots, Hawi, North Kohala, Hawaii, TMK: 5-5-11:39. (SEE EXHIBIT A) SPP 08-000069 The Commission took this item up at 11:00 a.m. with two people DOROTHY MADIGAN from the public in attendance. DISCOVERY HARBOUR SUBDIVISION, UNIT I, KAU 1 APPLICANT: DOROTHY MADIGAN (SPP 08-000069) Special Permit to allow the establishment of a 2-bedroom bed and breakfast establishment within an existing 3-bedroom single family dwelling situated on 15,132 square feet of land within the State Land use Agricultural District. The property is located at 94-1553 Kaulua Circle, Discovery Harbour Subdivision, Unit I, Ka’u, Hawaii, TMK: 9-4-21:142. Mr. Darrow oriented the Commission and public regarding the subject and surrounding properties on the location map, site plan and aerial photo, summarized the request, and noted that the Planning Director recommends approval of the application with conditions. Commissioner Bowman inquired about the type of breakfast to be served to guests since there is no mention of a Department of Health permit in the application; Mr. Darrow responded that it has to be a Continental breakfast such as fruits and muffins. He also mentioned that the applicant has already complied with the backflow preventer installation requirement and the solid waste management plan requirement. The applicant, Dorothy Madigan, was in attendance. Ms. Madigan indicated that she is agreeable to the conditions as proposed by the Planning Director. There was no one from the public wishing to testify on this agenda item. It was moved by Commissioner Domingo and seconded by Commissioner Woodward that the application be approved as recommended by the Planning Director with conditions. A roll call vote was taken and motion carried with five ayes (Domingo, Woodward, Bowman, Housel and Watanabe) and three absent and excused (Alameda, Iwashita and Ogata). RECESSED The Chair called a recess at 10:07 a.m. RECONVENED The meeting reconvened at 10:20 a.m. SMA 08-000030 The Commission took this item up at 10:20 a.m. with no one from WALUA SUNSETS LLC the public in attendance. WAIAHA, NORTH KONA APPLICANT: WALUA SUNSETS LLC (SMA 08-000030) a. Special Management Area Use Permit to allow the development of a 3-story, 12-unit mixed use office-residential condominium project. b. Revocation of Special Management Area Use Permit No. 448 previously issued to William E. Hall for a 3-story, 12-unit apartment complex and related improvements. The property is located between Walua Road and Kuakini Highway, approximately 930 feet northwest of the Walua Road – Lunapule Road junction, Waiaha, North Kona, Hawaii, TMK: 7-5-18: 92. (SEE EXHIBIT B) 2 MINUTES The Commission took up the following minutes at this time, 10:36 a.m., with one person from the public in attendance. November 24, 2008 – The Commission deferred approval of the minutes to a subsequent meeting. ELECTION OF OFFICERS The Commission took this item up at 10:38 a.m. with one person from the public in attendance. It was moved by Commissioner Woodward and seconded by Commissioner Domingo that the current officers continue until two planning commissions are established, tentatively April 1, 2009. Motion was unanimously carried by a voice vote of all Commissioners in attendance. ADMINISTRATIVE The Commission took up the following at this time, 10:42 a.m., MATTERS with one person from the public in attendance. Status of appeals filed on Board of Appeals decisions - Corporation Counsel – Mr. Torigoe had nothing to report to the Commission. ANNOUNCEMENTS The Commission took this item up at 10:42 a.m. with one person from the public in attendance. Mr. Hayashi announced that the next Hilo and West Hawaii meetings are scheduled for Thursday, January 15, 2009, in the Aupuni Conference Room and Thursday, January 22, 2009, at the Hapuna Beach Prince Hotel, respectively. He added that a memorandum regarding the tentative meeting schedule for 2009 will be distributed within a week.
