WINDWARD PLANNING COMMISSION
COUNTY OF HAWAIÒI
MINUTES
November 10, 2010
The Windward Planning Commission met in regular session at 9:07 a.m. in the County of
HawaiÒi Councilroom, County Building, 25 Aupuni Street, Hilo, HawaiÒi with Chairman Rell
Woodward presiding.
COMMISSIONERS PRESENT: Rell Woodward, Dean Au, Takashi Domingo, Wallace
Ishibashi, and Zendo Kern.
STAFF PRESENT: Gerald Takase (Deputy Corporation Counsel), BJ Leithead Todd
(Planning Director), Daryn Arai (Planning Program Manager), Jeff Darrow (Staff Planner) and
Maija Cottle (Staff Planner).
ABSENT AND EXCUSED: Stephen Ono
The Chair introduced the staff and Windward Planning Commissioners to the public and
described the procedures to be followed for todayÓs meeting.
The Commission took the following item up at 9:07 a.m. with approximately 23 people from the
public in attendance:
APPLICANT: GERALD KODAMA TRUST (REZ-10-130)
Application for a Change of Zone from Agricultural 3-acre (A-3a) to Residential and
Agricultural-1-acre (RA-1a) zone district for approximately 2.73 acres of land. The property is
located on the north side of Lama Street, approximately 440 feet east of the Lama Street-Awa
nd
Street intersection, Panaewa House Lots, 2 Series, Waikea, South Hilo, HawaiÒi,
TMK: 2-2-51:15.
Mr. Darrow oriented the Commission and the public of the subject and surrounding properties on
the location map and site plan, summarized the request, and noted the Planning Director
recommended approval of the application with conditions. He pointed out that all the structures
on the property are permitted.
Commissioner Domingo said for quite some time he felt the County should start looking into the
possibility of creating urban zoning in the Hilo area to provide for residential uses; and he
thought this was in the right direction.
In response to Commissioner DomingoÓs inquiry, Ms. Leithead Todd said generally because the
land is State Land Use Urban and Low Density Urban on the General Plan rezoning requests
similar to this would be favorably received. She felt this area was probably one of the more
appropriate areas on the island for residential development because of the existing road network
wherein if something happens on the main highway there would be other ways out of the
subdivision
The Chair pointed out that there is one water meter on the property supplying four homes; and he
questioned whether the applicant would be able to comply with the Department of Water
SupplyÓs requirements.
Mr. Darrow said the applicant was informed that the requirements of the Department of Water
Supply would be costly but he nevertheless agreed to comply with the requirements.
The applicantÓs representative, Lori Mikkelson, said the applicant has paid the required deposit
to the Department of Water Supply in an effort to move forward with the project and agreed with
the Planning DepartmentÓs recommendation and proposed conditions, noting the applicant
understood the magnitude of the cost involved to comply with the Department of Water SupplyÓs
requirements.
There was no one from the public wishing to testify on this agen
It was moved by Commissioner Kern and seconded by Commissioner Domingo to send a
favorable recommendation to the County Council. Commissioner Domingo stated he spoke for
the motion in light of the Planning DirectorÓs reasons for granting approval of the application,
and in light of todayÓs discussion. A roll call vote was taken and motion carried with five ayes
(Kern, Domingo, Au, Ishibashi and Woodward) and one absent and excused (Ono).
The Commission took the following item up at 9:26 a.m. with approximately 26 people from the
public in attendance:
APPLICANT: SPRINT NEXTEL HAWAII (USE 10-022)
Application for a Use Permit to allow for the installation of panel antennas on an existing 100-
foot tall light pole along with its associated ground equipment on approximately 525 square feet
of land within the CountyÓs Pahala Ball Park. The project site is situated within the southeastern
corner of the Pahala Ball Park near the intersection of Pakalana and Huapala Streets in Pahala
Village, Makaka-PÒauÒau, KaÒ , HawaiÒi, TMK: 9-6-05:39.
Ms. Cottle oriented the Commission and public of the subject and surrounding properties on the
location map and site plan, summarized the requested and noted the Planning Director
recommended approval of the application with conditions.
In response to Commissioner DomingoÓs inquiry, Ms. Cottle noted that since the antennas are
being placed on a light pole rather than a telecommunication pole, the Zoning Code requires a
Use Permit in the RS district.
The applicantÓs representative, Debbie Wong, said this was a win-win situation as this was the
only area in Pahala that suited their need of utilizing an existing light pole that can withstand 100
miles per hour winds and the CountyÓs need to collect rent at this facility, noting the property
manager wanted to complete this hearing before negotiating the lease rent.
In response to Commissioner DomingoÓs inquiry, Ms. Wong said although space could be made
available for other poles at the park, her company currently does not intend to represent other
applicants. She noted the Director of Parks and Recreation wanted this to be an option for the

County. She agreed with Commissioner Domingo that once this application is approved other
carriers may want to come in with similar applications.

It was moved by Commissioner Domingo and seconded by Commissioner Kern that the
application be approved. Commissioner Domingo clarified his position in that he does have
strong reservations for cell towers to be located in a residential area; however, since the antennas
will be placed on an existing 100-foot tall light pole and within the park parameter he is
supporting the request. A roll call vote was taken and motion carried with five ayes (Domingo,
Kern, Au, Ishibashi, and Woodward) and one absent and excused (Ono).
The Commission took the following item up at 9:35 a.m. with approximately 28 people from the
public in attendance:
APPLICANTS: MICHAEL AND JOY MENTNECHSPP 10-106)

Application for a Special Permit to allow the establishment of a community store within the
garage of an existing dwelling on 1 acre of land situated within the State Land Use Agricultural

District. The property is located at the intersection of 31 Avenue and MakuÒu Drive, along the

makai side of 31 Avenue and the south side of MakuÒu Drive, Hawaiian Paradise Park
Subdivision, KeaÒau, Puna, HawaiÒi, TMK: 1-5-015:061.

The Commission took the following item up at 10:31 a.m. with six people from the public in
attendance:
APPLICANT: PUA MAUKA DEVELOPMENT, LLC (SLU 09-23/REZ 09-109)
Applications for a State Land Use Boundary amendment for 3.183 acres of land from an
Agricultural to an Urban district and a Change of Zone for 3.183 acres of land from an
Agricultural-one acre (A-1a) to an Industrial-Commercial Mixed-3 acre (MCX-3a) zoned
district. The property is located in the Hawaiian Ocean View Estates Subdivision on the
northwest side of the Hawaii Belt Road and HawaiÒi Boulevard intersection at Kahuku, KaÒ,
HawaiÒi, TMK: 9-2-082: 002.
Mr. Darrow oriented the Commission and public of the subject and surrounding properties on the
location map and site plan, summarized the requests, and noted the Planning Director
recommended a favorable recommendation be sent to the County Council on both applications.
In response to Commissioner DomingoÓs inquiry, Mr. Darrow confirmed that the water
requirement is only applicable when there is a consideration for Industrial Commercial Mixed
Use and not Residential.
The applicantÓs representative, Bennett Baldwin, stated he is currently the sole owner of the
property and requested approval of the applications.

On the State Land Use Boundary Amendment, it was moved by Commissioner Domingo and
seconded by Commissioner Kern to send a favorable recommendation to the County Council. A
roll call vote was taken and motion carried with five ayes (Domingo, Kern, Au, Ishibashi, and
Woodward) and one absent and excused (Ono).
On the Change of Zone Application, it was moved by Commissioner Domingo and seconded by
Commissioner Kern to send a favorable recommendation to the County Council. A roll call vote
was taken and motion carried with five ayes (Domingo, Kern, Au, Ishibashi, and Woodward) and
one absent and excused (Ono).
The Commission took the following item up at 11:44 a.m. with 5 people from the public in
attendance:
APPLICANT: CONCEPT CONSTRUCTION, INC. (REZ 10-131)
Application for a Change of Zone from Single-Family Residential 10,000 square feet (RS-10) to
Neighborhood Commercial 20,000 square feet (CN-20) for approximately 5,160 square feet of
land. The property is located on KinoÒole Street, approximately 174 feet southwest of the
intersection of KinoÒole Street and Lanikaula Street, Waikea, South Hilo, HawaiÒi, TMK: 2-2-
025: Portion of 022.
Mr. Darrow oriented the Commission and public of the subject and surrounding properties on the
location map and site plan, summarized the request, and noted the Planning Director
recommended a favorable recommendation be sent to the County Council.
The applicantÓs representative, Thomas Yeh, stated Mr. Hansen has started the project and
wishes to provide additional parking to support the dialysis center.

The Commission took the following item up at 11:49 a.m. with 3 people from the public in
attendance:
INITIATOR: PLANNING DIRECTOR
Amendment to Chapter 25 (Zoning Code), Article 2 and Article 5 of the Hawaii County Code,
1983 (2005 Edition, as amended), relating to Use Permits and Schools.

The Commission took the following item up at 11:58 a.m. with approximately 3 people from the
public in attendance:

Amendment to Chapter 25 (Zoning Code), Articles 2, 4 and 5 of the Hawaii County Code, 1983
(2005 Edition, as amended), relating to Use Permits and Telecommunication Towers within the
Open-zoned District.

MINUTES Î At 12:05 p.m., the Commission took up the following minutes:
September 1, 2010 Î It was moved by Commissioner Kern and seconded by Commissioner
Ishibashi that the minutes be approved as circulated. Motion was unanimously carried by a voice
vote of all members in attendance.
ADMINISTRATIVE MATTERS Î The following were discussed under administrative matters:
Permitting Process - Commissioner Domingo requested the Planning Staff to look into whether
cinder being taken from the West Hawaii Concrete property was allowed and had gone through
the proper permitting process.
Election of Officers Î The Chair said the matter of the election of officers will be
CommissionÓs agenda shortly. He noted he did not wish to continue the chairmanship and that
Commissioner Kern has indicated an interest to replace him.
ADJOURNMENT - There being no further business, the Chair declared the meeting adjourned at
12:07 p.m.
