HomeMy WebLinkAbout2022-11-03 Police Commission Regular Minutes HAWAI`I POLICE COMMISSION SPECIAL MEETING MINUTES NOVEMBER 3, 2022 HAWAFI COUNTY BUILDING, COUNCIL CHAMBERS 25 AUPUNI ST., SUITE 1401, HILO, HI CALL TO ORDER AND ROLL CALL Chair Bertsch called the meeting to order at 1:08 p.m. Present: John Bertsch, Chair Donna Springer, Commissioner Anthony Sur, Commissioner Denby Toci, Commissioner Via Zoom: Rick Robinson, Commissioner Rod Quartararo, Commissioner Absent: Thomas Brown, Vice Chair Pudding Lassiter, Commissioner A quorum was present. Also present: Dakota Frenz, Deputy Corporation Counsel Charisse Correa, Secretary STATEMENTS FROM THE PUBLIC ON AGENDA ITEMS (Summarized) • Roger Christie thanked the commission for allowing and encouraging the public to participate in the process. He expressed concern regarding the condition of the jails and stated our chiefs of police are partly responsible for this decades-long failure that has resulted in this condition and further stated this must be corrected going forward with a much more enlightened chief of police. He further stated they must be more enlightened in the areas of substance abuse and the horrible county response to COVID-19. The marijuana eradication program was proven to have caused the meth epidemic here. He stated this is one of the biggest failures in policing history and must be corrected by a new chief of police. HPD's response to COVID-19 was unconstitutional. He and so many others have been given the silent treatment by representatives. No case has been opened by HPD that he knows of after they asked them to look at what many call the "crime of a century." Since no reasons are given, they think that HPD is complicit in this take takeover, and that is partly why he and others insist that the next chief is unvaccinated and understanding of the evolving degrading of our basic rights. He explained that vaccinated people might be morphed into a new species based on the ingredients in the vaccine. He stated there are supreme court decisions that say genetically modified things and possibly people are owned by the patent holders. He insists the county holds public hearings and the police chief opens a case. There's also evidence that the vaccines include self-assembling antennas operated by 5G and other invisible energy systems. He stated this must be investigated immediately. Mr. Christie handed out an article from the Hawaii Tribune- Herald "Overcrowding at HCCC, a serious and immediate concern." Hawaii Police Commission Special Meeting Minutes November 3, 2022 Page 2 • Les Brown came before the commission to speak on the next police chief. He stated police officers enforced laws that were unconstitutional. When police officers enforce unconstitutional laws, they are helping to destroy the country, they are creating great revenue for lawyers who don't need any more money, and they're destroying the public's faith in the police department. He stated that he moved to China for 14 years and he sees so many similarities between Hawaii County and communist China. He asked the commission to select someone who respects, honors, and obeys the constitution. • John Erickson came before the commission. He stated if they don't speak out against the government, God will hold them accountable. He took an oath in the Navy to serve the Constitution from all invaders foreign and domestic and he believes there are domestic intruders into their rights, privileges, and way of life. He stated we need aloha and understanding. He stated the police could help round up people that need to be taken out of society and if the jails are overcrowded, they can put them in tents with carpet runners and grow vegetables with the county's help. He spoke about the increase in numerous medical health issues in the US after COVID-19 vaccines were administered. He suggested that the commission should ask the police chief candidates where they get their news source from, you can tell a lot about a person by their news source. He further noted the next police chief should be a scholar of the constitution and an independent thinker. • Millicent Cummings came before the commission she stated that all chiefs of police are bound by Section 7-2-4, in the County Charter and the oaths they took to defend the constitution of the United States and the State of Hawaii. She stated the previous police chief was unable to uphold his oath as evidenced by the unlawful COVID-19 mandates, restrictions, and proclamations of emergency that were upheld and maintained by the police department. She further shared statistical data on deaths from COVID-19 worldwide, and statewide and stated while every single one of those deaths is tragic, the statistics hardly constitute a state of emergency with which to concoct and then enforce by the police department mandates and regulations, particularly ones that betray the constitution and God-given rights. She stated according to VAERS data (vaccine adverse event reporting system) on the CDC website, an astronomical number of deaths and injuries have occurred. She also gave statistics on the increase in drug overdose deaths and drug use, such as methamphetamine and opioids (primarily fentanyl). Stress levels, poverty, crime suicides, and domestic abuse are all skyrocketing. She stated many believe the previous chief's destructive war on drugs by the criminalization of cannabis users has resulted in the ongoing opioid epidemic. Continued bad policies have contributed to the overdose explosion and now, fentanyl is the leading cause of opioid-related deaths. This crisis could have been and could now be avoided by the next police chief if the commission learns from the previous chief's mistakes regarding the wars on drugs and viruses. Ms. Cummings stated we, who pay Hawaii Police Commission Special Meeting Minutes November 3, 2022 Page 3 all your salaries, demand that the new police chief launch a formal and long overdue investigation into all unlawful policies and criminal activity in our county in order to protect our community from medical tyranny, law enforcement, and government overreach as is his or her duty in accord with the County Charter and Constitutions that they will be swearing an oath to uphold. • Kevin Hill came before the commission and stated he echoes what the others have previously stated. He would like the next police chief to be "not for sale" and knows the law. He explained that there's a difference between statutes, codes, and ordinances and what is the law. The law is the Constitution, the law is given by our creator, something written in our hearts. He stated the second amendment isn't something ambiguous, it's very clear. The next chief needs to understand what the real law is. He would like the next chief to know the Constitution, and memorize the Bill of Rights, and expects the same for the officers. Mr. Hill stated in the world of universal deceit, telling the truth is a revolutionary act. He would like our next chief to be grounded in this truth. • Kalei Kailikini came before the commission to speak about the next police chief. She stated that she sent registered mail to the prosecuting attorney, it was a document full of evidence of the laws that were broken regarding COVID-19 and patents of the vaccine. They asked for him to open a case and investigate. She feels the next police chief should be responsive and listen to the citizens. Mr. Kailikini stated the Constitution is the most precious thing that you can have. The chief takes an oath, it's a promise to the people, and it's a legal contract. Their oath of office ties them to these legal contracts, and the citizens are on the other end of that contract. They need the next chief to understand and honor that relationship. She noted that they get paid in taxpayers' dollars. Ms. Kailikini closed by stating we the people of the United States in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, secure the blessings of liberty to ourselves and our posterity, do ordain and establish this constitution for the United States of America. • Chris Hirose came before the commission to speak about the next police chief. He spoke about the Federal Reserve Act and how the Rockefellers are the main owners of US banks and Paul Warburg was the architect of the Federal Reserve Act and is related to the Rothschilds. He further explained how Rockefellers control oil and pharmaceutical companies. Chair Bertsch asked Mr. Hirose what he would like to see in the next police chief. Mr. Hirose stated that he doesn't want the next chief to follow any unconstitutional mandates or be complicit with the crimes of the ruling class. He further explained the world economic forum. Hawaii Police Commission Special Meeting Minutes November 3, 2022 Page 4 Chair Bertsch stated that he appreciates the voices that they heard today, and thanked those in attendance for engaging with the commission to help them navigate this very important decision. He stated they will try to make them proud and will get them the best chief that they possibly can. EXECUTIVE SESSION Commissioner Robinson motioned to meet in executive session to consider the hiring of an employee of the police department, where matters affecting privacy will be involved; and may consult with the board's attorney on questions and issues pertaining to the commission's powers, duties, privileges, immunities, and liabilities pursuant to HRS 92-5 (a) (2) (4) and the Hawaii County Charter Section 13-20 (b). Commissioner Sur seconded, no discussion, and it carried unanimously. Executive session convened at 1:57 p.m. Motion to reconvene open session made by Commissioner Robinson, seconded by Commissioner Sur, with no discussion and it carried unanimously. Regular session reconvened at 4:32 p.m. Chair Bertsch thanked the commission for their dedication to this process. Moving forward, he thinks it's important to continue this process and asked for a motion to host another special meeting. Commissioner Robinson made a motion to schedule another special meeting, seconded by Commissioner Springer. Commissioner Sur asked if there will be a quorum. Chair Bertsch stated they will leave it up to their secretary to collaborate, find a meeting venue and confirm attendance. DCC Frenz suggested finalizing a date today, to make things easier. No further discussion, it carried unanimously, motion passed. Commissioner Robinson stated there is a Police Commission meeting scheduled for November 18t" and suggested keeping the regularly scheduled meeting. The commission decided not to schedule an additional special meeting and agreed this is easier. The motion is moot. ANNOUNCEMENTS The next regular meeting is scheduled for November 18, 2022, at 9:00 a.m., in the West Hawaii Civic Center, Building A Council Chambers, Ane Keohokalole Highway, Kailua- Kona, Hawaii.
