LEEWARD PLANNING COMMISSION
COUNTY OF HAWAI‘I
MINUTES
SEPTEMBER 30, 2010
The Leeward Planning Commission met in regular session at 9:38 a.m. in the King Kamehameha's
Kona Beach Hotel, Ballroom I, 75-5660 Palani Road, Kailua-Kona, Hawai‘i, with Chairman
Frederic Housel presiding.
COMMISSIONERS PRESENT: Frederic Housel, Brandi Beaudet, Geraldine Giffin, Wayne
Iokepa, Richard Nelson and Lani Bowman (from 9:43 a.m.)
ABSENT AND EXCUSED: Thomas Hickcox
STAFF PRESENT: Brandon Gonzalez (Deputy Corporation Counsel), BJ Leithead Todd
(Planning Director), Daryn Arai (Planning Program Manager), Jeff Darrow (Staff Planner), Maija

The Chair introduced the commissioners and staff to members of the public, and described the
procedure for public testimony.
The Commission took up the following item at 9:40 a.m. with approximately 200 people from the
public in attendance:
APPLICANT: HUALLAI PARTNERS OF KONA, LLC (SLU 10-27/REZ 10-127)
Applications for a State Land Use Boundary Amendment from Agricultural to Urban and a Change
of Zone from Agricultural 5-acres (A-5a) to Single-Family Residential 10,000 square feet (RS-10)
for approximately 14.968 acres of land. The property is located southwest of the intersection of

The Commission took up the following item at 12:42 p.m. with approximately 200 people from the
public in attendance:
APPLICANT:GIDEONSOROKIN (SMA 10-43)
Application for a Special Management Area Use Permit to allow for the construction of five (5)
three-story, single family residential units on approximately 31,853 square feet of land zoned Hotel-
Resort-1,250 square feet of land area per unit (V-1.25). The subject property is situated on the east
(mauka) side of Ali‘i Drive, approximately 840 feet south of its intersection with Lunapule Road in
st
Kailua Village, Kahului 1, North Kona, Hawai‘i, TMK: 7-5-19:07.
The Chair stated that the applicant had submitted a letter requesting a deferral for 60 days. There
was no one from the public wishing to testify in regard to this application. The deferral was granted
by a voice vote of all commissioners in attendance.
The Commission took up the following item at 12:43 p.m. with approximately 200 people from the
public in attendance:
APPLICANT: SAINT MICHAEL THE ARCHANGEL CHURCH, REV. KONELIO
FALETOI, PASTOR (SMA 10-44)
Application for a Special Management Area Use Permit to allow the construction of a church,
rectory and parish hall and related improvements to replace the former Saint Michael the Archangel
Church that was damaged during the 2006 earthquake. The approximately 3.19-acre property is
located on the northeast (mauka) side of Ali‘i Drive directly across Hale Hlwai Park and

Mr. Darrow oriented the Commission and public of the subject and surrounding properties on the
location map, flood zone map, site plan and photographs, and summarized the request. He noted
that the Planning Department recommended approval of the application, with conditions, and that
the last sentence of Condition No. 7 was amended to read as follows: “If required, the applicant
shall obtain a Letter of Map Revision (LOMR) prior to the issuance of Certificate of Occupancy.”
Director Leithead Todd added to clarify the mention of the subject property being located in a
Regional Transit-Oriented Development area, saying that this was a special case where the proposal
was basically to replace a church, which was a permitted use within the current zoning, that had
been deemed structurally unsafe and had been demolished due to the 2006 earthquake damage;

therefore, even though there was no master plan for the particular TOD area that had been adopted,
this application should be approved.
In response to the commissioners’ questions, Mr. Darrow said that the applicant had chosen to
apply for a new SMA Use Permit for the proposed project and have the existing SMA Permit No.
250 revoked later, rather than request an amendment to it, that the applicant had also applied for a
variance to allow additional height for the bell tower and cross, and that Harry Canales who had
filed a petition for standing in a contested case hearing, withdrew his petition after his discussion
with the applicant’s representative regarding his concern over the height.
Warner Baxter, a Kailua-Kona resident, testified in support of the application, saying that the
church had been helping him for decades, as well as many others for 160 years, and it was their turn
to help the church, and he implored the Commission to not take it away from them.
The applicant’s representatives, Rev. Konelio Faletoi, Gregory Mooers and Mark Livery, were in
attendance. Mr. Mooers stated that the applicant was in agreement with the Department’s
recommendation including the conditions of approval as amended earlier, together with an
additional revision; since the applicant’s intention was to relocate the coral shrine grotto, he
proposed revising Condition No. 16 to read, “The applicant shall implement a relocation plan and
interim preservation measures for the coral shrine grotto during construction.”
In response to the commissioners’ inquiries, Rev. Faletoi stated that the proposed church building
would resemble the 160-year old building that had been demolished, utilizing what they were able
to save for building material, that they would continue the community outreach and social services
in the new facility, which were currently conducted in a temporary tent, that the shrine grotto would
be relocated only a couple of feet over to accommodate the gathering space in the front yard, and
that they intended to plant trees and shrubs that were representative of the area.
It was moved by Commissioner Giffin and seconded by Commissioner Nelson that the application
be approved along with the conditions including the amendments to Condition Nos. 7 and 16 as
recommended. Commissioner Bowman thanked the applicant for their community outreach, saying
that there were many people even in her North Kohala community who were served by them. A roll
call vote was taken and motion carried with six ayes (Giffin, Nelson, Beaudet, Bowman, Iokepa and
Housel) and one absent and excused (Hickcox).
MINUTES – The Commission took up the following approval of minutes at 1:07 p.m.:
August 27, 2010 – It was moved by Commissioner Iokepa and seconded by Commissioner Nelson
that the minutes be approved as submitted. Motion was unanimously carried by a voice vote of all
Commissioners in attendance.
ADMINISTRATIVE MATTERS – There was nothing discussed under Administrative Matters.
ANNOUNCEMENTS – There were no announcements.
