HomeMy WebLinkAbout2010-03-05 Joint Planning Commission Minutes WINDWARD AND LEEWARD PLANNING COMMISSION COUNTY OF HAWAI‘I MINUTES MARCH 5, 2010 A regularly advertised hearing on the WINDWARD AND LEEWARD PLANNING COMMISSIONS’ RULES OF PRACTICE AND PROCEDURES was called to order at 9:10 a.m. The Windward Planning Commission met in the County of Hawaii Councilroom, County Building, 25 Aupuni Street, Hilo, Hawai‘i and the Leeward Planning Commissions met in Kona Council Office (Video Conference), Kailua Trade Center, 75-5706 Hanama Place, Suite 109, Kailua-Kona, Hawai‘i, with Chairman Rell Woodward presiding. WINDWARD PLANNING COMMISSIONERS PRESENT: Chairman Rell Woodward, Dean Au, Takashi Domingo, Andrew Iwashita, Zendo Kern, and Wallace Ishibashi. LEEWARD PLANNING COMMISSIONERS PRESENT: Chairman Fred Housel, Brandi Beaudet, Lani Bowman, Richard Nelson III STAFF PRESENT: Brandon Gonzalez (Deputy Corporation Counsel), BJ Leithead Todd (Planning Director), Norman Hayashi, (Planning Program Manager), Phyllis Fujimoto (Staff Planner), Jeff Darrow (Staff Planner), and Maija Cottle (Staff Planner). LEEWARD PLANNING COMMISSIONERS ABSENT: Geraldine Giffin, Wayne Iokepa,and Rodney Watanabe REVIEW AND ADOPTION OF THE LEEWARD AND WINDWARD PLANNING COMMISSIONS’ RULES OF PRACTICE AND PROCEDURES. Designated Chairman Woodward introduced the Windward and Leeward Planning Commissioners and staff to the members of the public. The Chair noted this item was first discussed at a joint meeting of the Leeward and Windward Planning Commissions on December 9, 2009, in Waikoloa where they reviewed the initial draft. He said circulated subsequently are the proposed changes to the initial draft. Mr. Hayashi explained that the purpose was to adopt a uniform rules of practice and procedure for the Windward and Leeward Planning Commissions as required by the Hawai‘i County Charter. He said there were a number of recommendations made by the Commissioners; however, recommendations to make the rules consistent with other rules were not possible 1 because of certain statutory requirements that set the processing time for certain types of permits and applications. Mr. Hayashi then reviewed the proposed amendments. He said it was felt the filing fee proposed was reasonable in light of the economic times, it actually does not cover the processing cost, and in comparing it with the other jurisdictions. if the Commission or Planning Department requests a continuation of a hearing, the applicant is not charged an additional fee. He added that the $200 filing fee for a contested case was to encourage the public to proceed with a contested case hearing if they so desired. Tim Rees provided comments regarding the SMA Rule 9. He said the notification required to surrounding property owners should be increased from what it is presently and posting of a general concept plan on the site rather than what is presently required so more information will be provided to the public, referring to a recent County of Hawai‘i Parks and Recreation SMA Permit. He urged the Commission to read HRS Section 205A encouraging public participation in their consideration of the adoption of this rule. It was moved by Commissioner Iwashita and seconded by Commissioner Kern that the rules be adopted. A roll call vote was taken and motion carried with ten ayes (Iwashita, Kern, Au, Domingo, Ishibashi, Woodward, Beaudet, Bowman, Nelson and Housel) and three absent and excused (Giffin, Iokepa and Watanabe). There being no objection, the Chair declared the meeting adjourned at 9:44 a.m. Respectfully submitted, Sharon M.
