Yuen, Planning Director Norman Hayashi, Staff Planner Phyllis Fujimoto, Staff Planner And approximately 7 people from the public in attendance COUNTY COUNCIL INITIATED - Proposed Bill No. 47 amending Chapter 25, YnmhmfBncd+nesgdG`v`hkhCounty Code 1983 (1995 Edition) as amended, relating to permitted uses in the Industrial-Commercial Mixed Use (MCX) District. The proposed bill is to add specific uses to the list of permitted uses. ETIHJ@V@9Nj`x+sgdehqrssghmfvdludfnsnmsghrlnqmhmflr`fdmc`hrvd have the County Council initiated, this is a continued hearing on the proposed Bill No. 47 amending Chapter 25, Zoning Code, ofsgdG`v`hkhBntmsy Code 1983 (1995 Edition) as amended, relating to permitted uses in the Industrial-Commercial Mixed Use (MCX) District. So, staff, could you do the presentation. HAYASHI:Thank you, Vice-Chair. This matter was brought before the Planning Commission at your meeting in Hilo in April. Basically, what it is is the County Council has submitted a proposed, this bill for your consideration relating to increasing the types, the permitted uses within the Industrial- Commercial zoned district. And, basically, the Industrial-Commercial zoned district is a Mixed Use District, is to allow mixing of some Industrial uses with Commercial uses. 1 EXHIBIT A The proposed bill, as I indicated, is to add specific uses to be listed to the permitted trdr:`mcsg`slrhmxntqaackground report that was sent out to you previously. We presented our recommendation to you at the Hilo meeting and the recommendation was to send a favorable consideration on this proposed bill with the exception of four uses. And one is the adult care center, the crop production, home care and schools which were being proposed by, for inclusion by the County Council, also, the deletion of a day care center which is in the current code. Are there any questions? FUJIKAWA:Okay, do we have anyone from the public on this -? KUBOTA:Mr. Chair? FUJIKAWA:Go ahead, Commissioner. KUBOTA:I have a question. Norman, you know, just a thought that arose in my mind, somewhere I read that the deletion of day care centers would have to be in a separate resolution or a separate, what do they call that, I read it somewhere, and it sqhffdqdcrnldsghmf-@mcvdlqdhmbktchmfhsas a part of this general recommendation. How do we treat that? G@X@RGH9A`rhb`kkx+vg`svdlcadcnhng is sending, if you agree with the qdbnlldmc`shnm+vdlkkadrdmchmfsgdoqnonred ordinance to the County Council with the exclusion of these four that they had proposed and also recommending the deletion of a day care center. And this would be part of one bill that would be submitted. KUBOTA:And it will be okay to treat it as one as long as we delineate the day care center as a deletion from the now, the present resolution, ordinance? HAYASHI:That is correct. KUBOTA:Ordinance. HAYASHI:That would be basically our recommendation from the Planning Commission. KUBOTA:All right, all right. I thought I read somewhere where it needed snadsqd`sdcrdo`q`sdkx-Hb`mlsehmchs- HAYASHI:Well, just as a matter of, for your information, there are two, I believe, maps for the Kona area; and there are two areas that are currently within the Industrial-Commercial, zoned Commercial-Industrial. And one would be the area 2 which would be north of the existing Kona Industrial Subdivision. And another area would be the area mauka of the current Kaloko Industrial Subdivision where Costco is located; and that would be this particular area. FUJIKAWA:Are you done, Commissioner Kubota? KUBOTA:Yes, I am. FUJIKAWA:Okay, are there any other questions from the other Commissioners? Anyone from the general public? No one? If not, do I hear a motion? KUBOTA:Mr. Chair, hearing no other comments, I would like to move that proposed Bill No. 47, amendment to Chapter 25, Hawaii County Code, relating to permitted uses within the Industrial-Commercial Mixed Use (MCX) District, be approved with the deletion of adult day care centers, crop production, home care, schools and day care. And this motion is based on the findings and recommendations of the Planning Director, along with the clearly defined rationale for the deletion of Mixed Uses. MINA:Second it.
