The Planning Commission met in regular session at 9:10 a.m. in the Hapuna Beach Prince Hotel,
Hau Room, 62-100 Kaunaoa Drive, Kohala Coast, Hawaii, with Chairman Rodney Watanabe
presiding.

Amendment to Condition C (Final Subdivision Approval) and Condition E (Access) of
Ordinance No. 95 119, which rezoned 24.9 acres of land from an Agricultural 20-acre (A-20a) to
an Agricultural 3-acre (A-3a) district. The property is located along the south side of Ala Kahua
Drive, approximately 7,650 feet east of the Ala Kahua Drive-Akoni Pule Highway intersection,

Special Permit to allow the establishment of seasonal farm worker housing for up to 50 workers
on 2 acres of land situated within the State Land Use Agricultural District. The area involved is
a part of the existing Greenwell Farms located along the makai side of Mamalahoa Highway,
approximately 2,500 feet south of the Mamalahoa Highway – Halekii Street intersection,
Kealakekua, South Kona, Hawaii, TMK: 8-1-4: Portion of 75.

SMA 388 The Commission took this item up at 11:05 a.m. with seven people

APPLICANT: PACIFIC MONARCH RESORTS (SMA 388)
Amendment to Condition No. 3 (time to complete construction) of Special Management Area
Use Permit No. 388, which allowed the development of a commercial/condominium complex
and related improvements on 76,739 square feet of land. The property is located on the makai
side of Alii Drive bounded by Alii Drive and Kahakai Road, south of Royal Kona Resort and
north of Kona Reef Condominium, Puaa 3rd, North Kona, Hawaii, TMK: 7-5-18:011.
Mr. Darrow oriented the Commission and public regarding the subject and surrounding
properties on the location map, site plan and aerial photos, summarized the request, and noted
that the Planning Director recommended approval of the request with conditions.
The applicant’s representative, Dr. William Foulk, was in attendance. Dr. Foulk indicated that
the applicant is agreeable to the conditions as proposed by the Planning Director. In response to
Commissioner Domingo’s questions regarding the lava tube, he stated that no remains or
artifacts were discovered during the filling process, and that he doesn’t think the Department of
Land and Natural Resources was present during the process. Commissioner Domingo then
confirmed with Director Yuen that the Planning Department is satisfied with the actions the
applicant has taken with the lava tube.
There was no one from the public wishing to testify on this agenda item.
It was moved by Commissioner Woodward and seconded by Commissioner Domingo that the
request be approved as recommended by the Planning Director, with conditions. A roll call vote
was taken and motion carried with six ayes (Woodward, Domingo, Bowman, Housel, Ogata and
Watanabe) and two absent and excused (Alameda and Iwashita).

At this time, 11:20 a.m., the Chair announced that the Commission will grant a request from a
member of the public, Josephine Tanimoto, and allow her to provide testimony on the matter of
the South Kohala Community Development Plan (SEE EXHIBIT C).
SPP 08-000064 The Commission took this item up at 11:30 a.m. with five people
GOODFELLOW from the public in attendance.

APPLICANT: GOODFELLOW BROTHERS, INC. (SPP 08-000064)
Special Permit to allow the establishment of a baseyard to provide equipment and motor vehicle
maintenance and repair services and relates uses on 14.77 acres of land situated within the State
Land Use Agricultural District. The property is located adjacent to the existing Waikoloa Quarry
and south of Waikoloa Road, half way between Waikoloa Village and Queen Kaahumanu
Highway, Waikoloa, South Kohala, Hawaii, TMK: 6-8-1: portion of 5.
Ms. Cottle oriented the Commission and public regarding the subject and surrounding properties
on the location map, site plan and aerial photos, summarized the request, and noted that the
Planning Director recommended approval of the request with conditions. In response to
Commissioner Housel’s inquiry, she said that the project site is located at least one mile mauka
of Queen Kaahumanu Highway, and the quarry isn’t visible from the highway.
The applicant’s representatives, Ann Cobb and Ed Brown, were in attendance. Ms. Cobb
indicated that the applicant is agreeable to the conditions as proposed by the Planning Director.
She added that the applicant is in need of a baseyard central to its operations in West Hawaii, and
the location was selected because of its distance from surrounding uses, and thus will have
minimal to no impact on residential areas, viewplanes, infrastructure or traffic. In response to
Commissioner Bowman’s question, Mr. Brown said that the proposed solar farm and a generator
together will provide all electricity needed at the baseyard.
There was no one from the public wishing to testify on this agenda item.
It was moved by Commissioner Domingo and seconded by Commissioner Bowman that the
request be approved as recommended by the Planning Director, with conditions. A roll call vote

SPP 08-000062 The Commission took this item up at 11:38 a.m. with two people

APPLICANT: HAWAII WILDLIFE CENTER (SPP 08-000062)
Special Permit to allow the establishment of a wildlife rehabilitation center and associated
educational uses on approximately 1.65 acres of land situated within the State Land Use
Agricultural District. The property is located adjacent (north boundary) to the Kohala Middle
School, Halaula, North Kohala, Hawaii, TMK: 5-3-7: portion of 4.
Mr. Darrow oriented the Commission and public regarding the subject and surrounding
properties on the location map, site plan and aerial photos, summarized the request, and noted
that the Planning Director recommended approval of the request with conditions.
The applicant’s representatives, Gregory Mooers, Linda Elliott and Pete Hendricks, were in
attendance. Mr. Mooers indicated that the applicant is agreeable to the conditions as proposed
by the Planning Director. In response to Commissioner Bowman’s inquiry, Ms. Elliott stated
that the kitchen is not certified since it is just for preparation of animal food.
There was no one from the public wishing to testify on this agenda item.
It was moved by Commissioner Woodward and seconded by Commissioner Bowman that the
request be approved as recommended by the Planning Director, with conditions. A roll call vote
was taken and motion carried with six ayes (Woodward, Bowman, Domingo, Housel, Ogata and
Watanabe) and two absent and excused (Alameda and Iwashita).

DEVELOPMENT PLAN
SOUTH KOHALA COMMUNITY DEVELOPMENT PLAN
Review and action on the draft South Kohala Community Development Plan (CDP) submitted
by the South Kohala CDP Steering Committee and its consultant, Townscape, Inc.

MINUTES The Commission took up the following minutes at this time,
1:48 p.m., with two people from the public in attendance.
August 22, 2008 – It was moved by Commissioner Domingo and seconded by Commissioner
Woodward that the minutes be approved as circulated. Motion was unanimously carried by a
voice vote of all Commissioners in attendance.
ADMINISTRATIVE The Commission took up the following at this time, 1:49 p.m.,
MATTERS with two people from the public in attendance.
Status of appeals filed on Board of Appeals decisions - Corporation Counsel – Mr. Torigoe had
nothing to report to the Commission.

ADJOURNMENT There being no further business, the Chair declared the meeting
adjourned at 1:50 p.m.
