REVISED BACKGROUND,RECOMMENDATION & CONDITIONS OF APPROVAL
The Deputy Planning Director finds it prudent to revise the conditions of approval in order to clarify
the total number of people allowed on the subject property, to revise the hours of operation and in
response to a request from the applicant(Planning Department Exhibit 22—Letter from John
Pipan dated October 31, 2022).
The Deputy Planning Director recommends revising Condition 3, Condition 10 and
Condition 11 as follows:
3. Applicant shall secure and finalize all required as-built building permits for existing
structures used for the proposed holistic education center from the Department of
Public Works - Building Division within [siyr fneiiths]one (1)year of the effective
date of this permit, including change of use building permits for existing structures to
be used for the proposed use. If any as-built or change of use building permits are not
finalized within the prescribed amount of time, the holistic education center shall
cease use of any unpermitted structures.
10. As represented by the Applicant, retreat events shall be limited to up to two retreats
per month for up to 24 participants per retreat. Should there be additional rooms
available, cabins and lodge buildings may be rented to the public for short-term
accommodations, for a maximum of 20 non-retreat guests. There shall be no more

Subject: Special Permit Application—Additional Information and Revisions
Applicant: Robert Silber
Kamaili, Pahoa, Puna, Hawaii TMK(3) 1-3-002:140
We are in receipt of the Background and Recommendation Reports on the subject application.
We have reviewed the proposed conditions and appreciate the work that has gone into crafting
them.
The applicant would like the ability to construct one (1)potable water storage tank of 20,000
gallons capacity instead of two (2)tanks of 10,000 gallons capacity each.
The applicant would also like to request the option to store water for fire suppression purposes in
a pond if approved by the Fire Department. The proposed pond would maintain at least 60,000
gallons of water at all times. This could be accomplished by a square pond approximately 40 feet
on each side and on average 4 feet deep. Please see attached conceptual site plan showing the
approximate proposed location of the pond.
We understand the need for accelerated deadlines on as-built permitting requirements and
appreciate the suggested six-month deadline on Conditions 3, 6, 8, 14 (with the potential for one
additional six-month period by administrative approval). However, we are concerned that the
lengthy review times often encountered at permitting agencies may cause the applicant to miss
these deadlines despite their best efforts. Based on recent discussions regarding the time to
perform conditions of approval on projects more broadly we would respectfully request
consideration that time spent in agency reviews not be counted toward the total time elapsed for
those conditions.
