HomeMy WebLinkAbout2008-07-10 Planning Commission Minutes PLANNING COMMISSION COUNTY OF HAWAI‘I MINUTES JULY 10, 2008 The Planning Commission met in regular session at 10:15 a.m. in the Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawaii with Chairman Rodney Watanabe presiding. PRESENT: Rodney Watanabe ABSENT & EXCUSED: Lani Bowman C. Kimo Alameda Alvin Rho Takashi Domingo Rene’ Siracusa Andrew Iwashita Shelly Ogata Rell Woodward Ivan Torigoe, Deputy Corporation Counsel Christopher Yuen, Planning Director Norman Hayashi, Staff Planner Phyllis Fujimoto, Staff Planner Jeff Darrow, Staff Planner Maija Cottle, Staff Planner The Chair introduced the Commissioners and staff to members of the public and Mr. Torigoe introduced three of the interns with the Office of the Corporation Counsel, Madeline Reed, Kelci Paiva and Cheryl Shitabata. REZ 871 The Commission took this item up at 10:15 a.m. with eight people STANLEY Y. MAEDA from the public in attendance. WAIAKEA, SOUTH HILO APPLICANT: STANLEY Y. MAEDA (REZ 871) Extension of time limits and related conditions of Change of Zone Ordinance No. 97-122, which rezoned approximately 12,900 square feet of land from a Single-Family Residential 10,000 square feet (RS-10) to a Neighborhood Commercial 10,000 square feet (CN-10) district. The property is located on the southwest corner of Kekuanaoa Street and Kalanikoa Street approximately 480 feet west of Kanoelehua Avenue in Waiakea Houselots, Waiakea, South Hilo, Hawaii, TMK: 2-2-37:16. Mr. Darrow confirmed for the Chair that the Planning Department did receive an email from the applicant requesting a continuance to allow him to make a determination on the future outcome of the property. He added that no notification was given to surrounding property owners of the hearing. There was no one from the public wishing to testify on this application. As the presiding officer, the Chair continued this matter until further notice. RECESSED The Chair called a recess at 10:22 a.m. until the next item scheduled for 10:30 a.m. RECONVENED The meeting reconvened at 10:30 a.m. SPP 1136 The Commission took this item up at 10:30 a.m. with EXCAVATION approximately 15 people from the public in attendance. TECH, LLC ORCHIDLAND ESTATES, PUNA APPLICANT: EXCAVATION TECH, LLC (SPP 1136) Amendment to Condition 5 (life of permit) of Special Permit No. 1136, which allowed the establishment of a contractor’s baseyard for heavy equipment storage and excavation operation on approximately 2.5 acres of land situated within the State Land Use Agricultural District. The property is located along the mauka side of the Keaau-Pahoa Highway (Highway 130) and approximately 700 feet Keaau side of Makuu Drive, Orchidland Estates Subdivision, Keaau, Puna, Hawaii, TMK: 1-6-9:237 to 240. Mr. Darrow noted a July 3, 2008 correspondence from the applicant’s attorney requesting a continuance to September 4, 2008, to revise their application to include a time extension on an existing condition. There was no one from the public wishing to testify on this application. As there were no objections, the matter was continued to September 4, 2008. SPP 08-000056 The Commission took this item up at 10:33 a.m. with SATORU S. MAEDA approximately 15 people from the public in attendance. OLAA, PUNA APPLICANT: SATORU STEWART MAEDA (SPP 08-000056) Special Permit to allow the establishment of a commercial boarding kennel, a quarantine kennel, office, and certified kitchen on 4 acres of land situated within the State Land Use Agricultural District. The property is located off the south side of Ihope Street, approximately 0.7 mile southwest of the Ihope Street – North Peck Road intersection, Olaa Reservation Lots, Olaa, Puna, Hawaii, TMK: 1-8-6:193. (SEE EXHIBIT A) 2 SPP 08-000057 The Commission took this item up at 10:44 a.m. with MARTA V. CAMPBELL approximately 15 people from the public in attendance. HAWAIIAN PARADISE PARK SUBDIVISION, PUNA. APPLICANT: MARTA V. CAMPBELL (SPP 08-000057) Special Permit to allow the establishment of a tutoring center on one acre of land situated within th the State Land Use Agricultural District. The property is located along the makai side of 6 th Avenue, approximately 2,300 feet south of the Makuu Drive and 6 Avenue, Hawaiian Paradise Park Subdivision, Puna, Hawaii, TMK: 1-5-27:43. (SEE EXHIBIT B) SPP 08-000055 The Commission took this item up at 2:10 p.m. with CHERIE McARTHUR` pproximately 10 people from the public in attendance. dba PUNA GIRL FARMS POHOIKI, PUNA APPLICANT: CHERIE McARTHUR dba PUNA GIRL FARMS (SPP 08-000055) Special Permit to allow to establishment of an Agricultural Tourism operation, which includes tours and retail sales of products on 6.4 acres of land situated within the State Land Use Agricultural District. The property is located along the north side Pohoiki Road, adjacent to and east of the Lanipuna Gardens Subdivision, Pohoiki, Puna, Hawaii, TMK: 1-3-8:24. Ms. Cottle oriented the Commissioners and public of the subject and surrounding properties on the location map and site plan, summarized the request and noted the Planning Director recommended approval of the application with conditions. For the Commission’s information, Ms. Cottle said there will be no preparation of food done on the subject property as the tour group operator will be providing the food. She added that the applicant will be displaying her products for sale on tables. The applicant, Cherie McArthur, stated she has read the Planning Director’s background report and recommendation, and that she will be able to comply with the proposed conditions. Mr. Yuen said between the pavilion and nearest property line (56 feet) there are a few tall banana trees and lei flower plants, and the land beyond the fence is overgrown, noting the neighboring land is vacant. He then proposed additional wordings to proposed Condition 3. For the Commission’s information, Ms. McArthur said that there is a handicapped bathroom in the pavilion, they will continue to use porta potties, and she manages the facility by herself. There was no one from the public wishing to testify on the application. 3 It was moved by Commissioner Domingo and seconded by Commissioner Iwashita that the application be approved as recommended by the Planning Director, with the following added sentences at the end of Condition 3: “Landscaping shall also be indicated on the plans for the purpose of mitigating any adverse impacts to the roadways and the adjacent properties in accordance with the requirements of Planning Department's Rule No. 17 (Landscaping Requirements). These Landscaping Requirements shall apply to the pavilion and parking areas, and may be satisfied by existing plantings.” Commissioner Domingo felt the proposed activity currently complies with the intent and purpose of the agricultural-tourism bill passed by the Legislature; however, he cautioned the applicant not to going beyond the intent of the legislative action by selling goods not made in Hawaii and impacting the rest of the community who have legitimate businesses. The Chair said the proposed condition would limit the items grown on the subject property or limit the sales to products such as t-shirts and caps that carry the business name, noting it is not supposed to be an extensive retail outlet. A roll call vote was taken and motion carried with six ayes (Domingo, Iwashita, Alameda, Ogata, Woodward and Watanabe) and three absent and excused (Bowman, Rho, and Siracusa). SPP 08-000054 The Commission took this item up at 2:26 p.m. with SYLVIA DOLENA approximately 10 people from the public in attendance. KAPOHO, PUNA APPLICANT: SYLVIA DOLENA (SPP 08-000054) Special Permit to allow the establishment of a Joglo temple for the practicing of religious healing and meditation on approximately 5,000 square feet of land situated within the State Land Use Agricultural District. The property is located along the south side of Ililani Road, approximately 2,300 feet east of the Kapoho Beach Lots Road, Vacationland Hawaii Subdivision, Unit II, Kapoho, Puna, Hawaii, TMK: 1-4-73: portion of 4. The Chair stated no action is required on this item since the applicant is withdrawing her application. RECESSED The Chair called a short recess at 2:28 p.m. RECONVENED The meeting reconvened at 2:35 p.m. KONA COMMUNITY The Commission took this item up at 10:30 a.m. with DEVELOPMENT PLAN approximately 15 people from the public in attendance. KONA COMMUNITY DEVELOPMENT PLAN Review of the draft Kona Community Development Plan (CDP) submitted by the Kona CDP Steering Committee and its Consultant, Wilson Okamoto Corporation. (SEE EXHIBIT C) 4 MINUTES The Commission took up the following minutes simultaneously at this time, 3:41 p.m. June 5, 2008 and June 6, 2008 – It was moved by Mr. Iwashita and seconded by Mr. Alameda that the minutes be approved as circulated. Motion was unanimously carried by a voice vote of all Commissioners in attendance. ADMINISTRATIVE The Commission took up the following at this time, 3:42p.m. MATTERS Status of appeals filed on Board of Appeals decisions - Corporation Counsel - Mr. Torigoe noted he had nothing new to report to the Commission. Other Matters – There were no other matters to discuss. ANNOUNCEMENTS The following announcement was made. Next Meeting – Staff announced the next meeting is scheduled for July 18, 2008 in Kona.
