The Planning Commission met in regular session at 9:07 a.m. at the Waikoloa Beach Marriott

Request to amend condition no. 5 (life of permit) of Special Permit No. 956, which allowed the
establishment of a quarry for soil mining on 14.9 acres within the State Land Use Agricultural
District. The permit was previously issued to Allied Aggregates Ltd. for property located
approximately 2.5 miles northeast of the Hawaii Belt Road (Highway 190)-Saddle Road junction

Amendment to Chapter 2, Article 7, Hawaii County Code 1983 (2005 Edition, as amended)
relating to the Planning Commissions review of a draft community development plan or
amendment thereof. The purpose of the amendment is to provide a time frame for the Planning
Commissions review and recommendation to the County Council on a draft Community
Development Plan or amendment.

Amendment to Chapter 25 (Zoning), Article 2, Division 3, Section 25-2-35, Hawaii County
Code 1983 (2005 Edition, as amended) relating to administrative enforcement. The proposed
amendment states that an appeal to the board of appeals shall not stay the provisions of the
(planning) directors order pending the final decision of the board of appeals.

Mr. Hayashi stated that it is no longer necessary for the Commission to take any action on this
applicationsinceConditionIhasalreadybeenfulfilledastheapplicantsecuredaFinalPlan
Approval from the Planning Department in November 2007. He added that the Department has
informedtheapplicantthattheCommissionwillwithdrawthisitemfromthemeetingagenda.
TherewerenoobjectionsfromtheCommissioners.

January 11, 2008 It was moved by Commissioner Siracusa and seconded by Commissioner
Alameda that the minutes be approved with the following correction: Page 52 of Exhibit A, first
line, correct you to your. Motion was unanimously carried by a voice vote of all
Commissioners in attendance.

Status of appeals filed on Planning Commission decisions Corporation Counsel Mr. Torigoe
had nothing to report.
