SMA 07-000016 The Commission took this item up at 9:06 a.m. with approximately PUAKO BAY7 people from the public in attendance. INVESTORS, LLC LALAMILO, SOUTH KOHALA APPLICANT: PUAKO BAY INVESTORS, LLC (SMA 07-000016) Continuation of a Public Hearing on the application for a Special Management Area (SMA) Use Permit to allow the development of an 8-lot single-family residential subdivision and related improvements. The property is located on the makai side of Puako Beach Drive, adjacent to and east of the Puako boat ramp, Lalamilo, South Kohala, Hawaii, TMK: 6-9-2:1 and 2. The Chair announced that the applicant requested continuance until the next Kona meeting. There was no one from the public wishing to testify on this agenda item. The applicant’s representative, Sidney Fuke, was in attendance, and stated that the reason for the request is that the applicant is in process of updating their drainage study as a result of meetings with the Planning Department staff and the community. In response to Commissioner Watanabe’s query, Mr. Fuke said that if the updated study is not ready in time for the next meeting, the applicant will have to ask the Commission to agendize it for the following Kona meeting in July. It was moved by Commissioner Siracusa and seconded by Commissioner Watanabe to continue the matter until such time as the applicant is ready to proceed. Motion was unanimously carried by a voice vote of all Commissioners in attendance. 1 SPP 05-000015 The Commission took this item up at 9:35 a.m. with approximately DANIEL IBBETSON 3 people from the public in attendance. TH KAOHE 5, SOUTH KONA APPLICANT: DANIEL IBBETSON (SPP 05-000015) Discussion and review of the Third CircuitCourt’s Order Reversing Decision of the Planning Commission and Remanding Case to Agency for Further Proceedings dated December 22, 2006, in Civil No. 06-01-037K, and further proceedings and consideration consistent with that Order, on the application of Daniel Ibbetson for a Special Permit (SPP 05-000015) to operate a 2-unit bed and breakfast establishment on 0.722 acre of land situated within the State Land Use Agricultural District. The property is located along the west (makai) side of Mamalahoa Highway (Highway 11), approximately 120 feet south of the Kaohe Road-Mamalahoa Highway th intersection, Kaohe 5, South Kona, Hawaii, TMK: 8-7-9:14. (SPP 06-000033) Discussion and action of the Hearings Officer’s Report on the Special Permit Application to allow the establishment of a camping and retreat Center on 6 acres of land situated within the State Land Use Agricultural District. The area under consideration is located approximately 0.8 mile makai of Akoni Pule Highway (Highway 270) and in the vicinity of Union Market, Hanaula, North Kohala, Hawaii, TMK: 5-4-9: portion of 12. LLC WAIKOLOA, SOUTH KOHALA 2 APPLICANT: WAIKOLOA MAUKA, LLC (REZ 678) Amendments to Conditions B (Final Subdivision Approval), C (Access) and I (Fair Share Contribution) of Change of Zone Ordinance No. 05 157, which rezoned approximately 761 acres from Agricultural 5-acre (formerly Unplanned) and Multiple-Family Residential 1,500-square foot (RM-1.5) districts to a Residential and Agricultural 1-acre (RA-1a) district. The property, referred to as the proposed Waikoloa Highlands Subdivision, is located along the south side of Waikoloa Road and south - southeast of Waikoloa Village, Waikoloa, South Kohala, Hawaii, TMK: 6-8-2: portion of 16 and TMK: 6-8-3: portion of 32. (SEE EXHIBIT C) RECESSED The chair called a short recess at 2:10 p.m. RECONVENED The meeting reconvened at 2:18 p.m. REZ 07-000062 The Commission took this item up at 2:18 p.m. with approximately PLANNING DIRECTOR 13 people from the public in attendance. WAIMEA, SOUTH KOHALA INITIATOR: PLANNING DIRECTOR (REZ 07-000062) Change of Zone from Agricultural 1-acre (A-1a) to an Agricultural 400-acre (A-400a) district for 420.17 acres of land. The property is located north of Konokohau Road and Waimea Town and includes the hills (puu) Hokuula, Puuowaowaka, and Puu Ki in the land divisions of Keanuiomano and Puuki, Waimea, South Kohala, Hawaii, TMK: 6-5-1:20. (SEE EXHIBIT D) AMEND ZONING CODE The Commission took this item up at 2:43 p.m. with approximately COUNTY COUNCIL 14 people from the public in attendance. RETAIL ESTABLISHMENTS INITIATOR: COUNTY COUNCIL Amendment to Chapter 25 (Zoning Code), Hawaii County Code 1983 (2005 Edition), as amended, relating to Retail Establishments. The proposed amendment would not permit “superstores” in any zoning district. “Superstore” means a business exceeding 90,000 gross square feet, offering for sale more than 25,000 different stock keeping units, and dedicating more than 20,000 gross square feet of floor area to the sale of groceries. (SEE EXHIBIT E) MINUTES The Commission took this item up at 3:23 p.m. with no one from the public in attendance: 3 March 16, 2007 – It was moved by Commissioner Siracusa and seconded by Commissioner Rho that the minutes be approved as circulated. Motion was unanimously carried by a voice vote of all Commissioners in attendance. ADMINISTRATIVE The Commission took this item up at 3:24 p.m. with no one from MATTERS the public in attendance. Status of appeals filed on Planning Commission decisions - Corporation Counsel – Mr. Torigoe had nothing to report. ANNOUNCMENT There was no announcement.
