HomeMy WebLinkAbout2007-05-04 Planning Commission Minutes PLANNING COMMISSION COUNTY OF HAWAII MINUTES MAY 4, 2007 The Planning Commission met at 9:07 a.m. for a site visitation of the property and surrounding area relating to Hawaii Island Community Development Corporation/Hawaiian Rainbows Business Development, LLC€sSLU 07-000013 and REZ 07-000059 at Kahua and Makahanaloa, South Hilo Hawaii and in regular session at 10:30 a.m. in the County of Hawaii, Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawaii, with Chairman William Graham presiding. PRESENT:William Graham (left at 3:57 p.m.) C. The Commission Members met at the location of the Hilo Coast Processing Company wheel in the vicinity of the intersection of the Hawaii Belt Road and Sugar Mill Road. The Chair introduced the Commissioners and staff to members of the public and explained the purpose of the site inspection, noting that the public will not be allowed to provide testimony at this time, only at the public hearing following the site visitation. The Commission then proceeded in assigned vehicles through the gate to Parcel 111 (A-5a) where the self-help housing is proposed, approximately 500 feet from the old Mamalahoa Highway. Mr. Darrow briefly explained the proposed project and noted the Commissioners will be looking at what physically is on the ground and look at the particular issues brought up by the community. He pointed out the boundaries for the RS 7.5 area proposed from Ag to Urban, the berm and culvert areas, and also indicated the areas on the plot plan. The Commission then went to the area of the puu several hundred yards away where they looked at the other culvert, drainage and surrounding areas. The Commission viewed the topography map submitted by the applicant at this time and looked at the waterwell and 1,000-foot radius area. The Commission proceeded to Lot 118A, to view the makai boundary of the proposed area for rezoning from A-20 to A-10a and A-5a and staff pointed out the boundaries of this area. They looked at the property in relation to the location map and site plan. The Commission went along the Old Mill Road viewing the culvert area and one-lane bridge and then headed toward Aupuni Center for their meeting. RECONVENEDThe meeting reconvened at 2:44 p.m. 2 REZ 07-000061The Commission took this matter up at 2:44 p.m. with JUSTINPITTULLO approximately 9 people from the public in attendance. AND NANCY HAMADA PONAHAWAI, SOUTH HILO APPLICANTS: JUSTIN PITTULLO AND NANCY HAMADA (REZ 07-000061) Change of Zone from Agricultural 1-acre (A-1a) to Neighborhood Commercial 20,000 square feet (CN-20) for approximately 1.022 acres of land. The property is located on the south side of Ponahawai Street approximately 950 feet east of the Komohana Street/Ponahawai Street intersection, Ponahawai, South Hilo, Hawaii, TMK: 2-3-37: 11. (SEE EXHIBIT B) REZ 07-000063The Commission took this item up at 3:20 p.m. with GUY MILLERapproximately 6 people from the public in attendance. PONAHAWAI, SOUTH HILO APPLICANT: GUY MILLER (REZ 07-000063) Change of Zone from Agricultural 1-acre (A-1a) to Multiple-Family Residential 4,000 square feet (RM-4) for approximately 1.298 acres of land. The property is located on the south side of Ponahawai Street approximately 400 feet east of the Komohana Street/Ponahawai Street intersection,Ponahawai,SouthHilo,Hawaii, TMK: 2-3-37: 17. (SEE EXHIBIT C) (SP NO. 1139)The Commission took this item up at 4:15 p.m. with GEORGE AND 3 people from the public in attendance. SHALEEN CURLEE KEAAU, PUNA APPLICANTS: GEORGE ANDSHALEEN CURLEE (SP NO. 1139) Amendment to Condition No. 2 (life of permit) of Special Permit No. 1139 which allowed an automobile repair shop and towing service on approximately 4,421 square feet of land in the State Land Use Agricultural district. The property is located on the eastern corner of Paradise th Drive and 19 Street in the Hawaiian Paradise Park Subdivision, Keaau, Puna, Hawaii, TMK: 1-5-41: 190. Mr. Darrow oriented the Commission and public of the subject and surrounding properties on the locationmapandsiteplan,summarizedtherequestofextendingthepermitforanadditionalfive years, and noted the Planning Director recommended approval the request. He referred to the applicant€sApril27,2007correspondenceindicatingtheapplicantisworkingwiththeFire Department to meet the fire flow requirement through a water catchment tank. He said Condition10forasolidwastemanagementplanisbeingproposedinlightoftheDepartmentof 3 Environmental Management€s request and existing conditions have been reworded to reflect current standard language. In light of Commissioner Woodward€s comment Mr. Yuen said he would like to keep the time condition as worded to review the situation after the five years in light of the community development plan process, rather than said the condition amended to say x‚ years after considerable industrial zones are available. The applicants, George and Shaleen Curley, were in attendance. In response to Mr. Curley€s concern, Mr. Yuen clarified that should industrial lands become available the use or business would have to cease on the subject property but the structure itself would be able to remain on the property. CommissionerSiracusasaidshewouldnotfeelcomfortableapprovingtheapplicationifthe applicant has not complied with Planning Department€s Rule 17 (landscaping plan) for the entire property. Mr. Curley addressed her concern by noting that there is only a small area left that needs to be planted with areca palms, noting the albesia and guavas in the area were bulldozed last week. It was moved by Commissioner Watanabe and seconded by Commissioner Siracusa that the amendment to Condition No. 2 of Special Permit No. 1139 be approved based on the Director€s recommendation. A roll call vote was taken and motion carried with six ayes (Watanabe, Siracusa, Domingo, Rho, Woodward and Alameda) and two absent and excused (Graham and Iwashita). USE 07-000007)The Commission took this item up at 4:34 p.m. with HAMAKUA HEALTH two people from the public in attendance. CENTER, INC. HONOKAA, HAMAKUA APPLICANT: HAMAKUA HEALTH CENTER, INC. (USE 07-000007) Use Permit to allow the development of a healthcare facility to replace an existing health care structure on approximately 31,304 square feet of land situated within the Agricultural 5-acre (A-5a) zoned district. The property is located off Lehua Street, north of Honokaa Park and east of the Hale Ho Ola Hamakua Critical Access Hospital in Honokaa, Hamakua, Hawaii, TMK: 4-5-10: 89. Commissioner Domingo abstained from participating on this application as he is a Board MemberoftheHamakuaHealthCenter,Inc. Mr.DarroworientedtheCommissionandpublicofthesubjectandsurroundingpropertiesonthe location map and site plan, summarized the request, and noted late correspondence received from theDepartmentofWaterSupplyandapplicant.HesaidthePlanningDirectorisrecommending approval of the application with conditions, with an amendment to Condition 6. 4 The applicant€s representatives, Christopher Clark and Greg Mooers, were in attendance. Mr. Mooers stated they agreed with the conditions as amended. He said they would want to connect to the County sewer system as it runs on or adjacent to the subject property, rather than the Honokaa Hospital system as there is a significant change in the elevation and would require a lift station and sewer line that ran basically almost uphill. In response to Commissioner Siracusa€s concern on lead and asbestos contamination, Mr. Mooers said as the Health Center is very aware of the problem they are electing to take the building down and replace it with a new structure. Mr. Mooers added that it is their understanding and intention that the remediation required will meet all Department of Health€s rules and regulations as stated in Condition 9, noting the applicant does not have a problem if the Commission makes it a specific condition. Commissioner Siracusa said she did not see a reason tomakeitaspecificconditionaslongastheHealthDepartmentrequiresthismatterbe addressed. It was moved by Commissioner Siracusa and seconded by Commissioner Watanabe that the application be approved based on the Planning Director€s recommendation and proposed conditions, with Condition No. 6 amended to read, The applicant shall connect the proposed project to the County€s planned sewer collection system for Honokaa. Should the sewer system not be available at the time the project is developed, the applicant will construct an on-site wastewater treatment system meeting the requirements of the State Department of Health. Once the sewer system is available, the applicant will connect to the County system at that time.‚ A roll call vote was taken and motion carried with five ayes (Siracusa, Watanabe, Woodward, Rho, and Alameda) and three absent and excused (Graham, Iwashita and Domingo).
