The Planning Commission met in regular session at 9:11 a.m. at the King Kamehameha's Kona
Beach Hotel, 75-5660 Palani Road, Kailua-Kona, Hawaii, with Chairman William Graham
presiding.

The Chair introduced the Commissioners and staff to members of the public.

Amendmentto Condition C (time extension to secure final subdivision approval) of Change of
Zone Ordinance No. 02-21, which rezoned 28.832 acres of land from an Agricultural 20-acre (A-
20a) to an Agricultural 3-acre (A-3a) district. The property is located along the southeast side of
Ala Kahua Drive, approximately mile mauka of the Ala Kahua Drive Akoni Pule Highway

Special Management Area (SMA) Use Permit to allow the development of an 8-lot single-family
residential subdivision and related improvements. The property is located on the makai side of
the Puako Beach Drive, adjacent to and east of the Puako boat ramp, Lalamilo, South Kohala,
Hawaii, TMK: 6-9-2:1 and 2.
Chair Graham stated that the Planning Department and the applicant have agreed to a
continuance, and that there are no public testifiers signed up for this agenda item.
It was moved by Commissioner Siracusa and seconded by Commissioner Watanabe that this
matter be continued to the next Kona meeting. Mr. Hayashi stated that the Planning Department
received a letter from Eric Arakaki, Superintendent for the United States Department of Interior
National Park Service, commenting on this request, which will be made part of the record, and
that the Commissioners have been provided with a copy of the letter. Motion was unanimously
carriedbyavoicevoteofallCommissionersinattendance.

Review and comment on a draft ordinance (Bill 318) amending Chapter 25 (Zoning Code),
Article 2, Division 4, Section 25-2-44, Hawaii County Code 1983 (2005 Edition, as amended)
relating to conditions of change of zone (adds requirements to existing provisions within the
Zoning Code relating to conditions on change of zone ordinances regarding water supply and
transportation improvements or strategies be made concurrent with development associated with
any change of zone in order to manage growth and coordinate the delivery of government
services).

Review and comment on a draft ordinance (Bill 319) amending Chapter 23 (Subdivision Code),
Article2,Division1,Section23-13,HawaiiCountyCode1983(2005Edition,asamended)
relating to Large Scale Developments (adds requirements toexisting provisions within the
Subdivision Code relating to large scale developments regarding water supply and transportation
improvements or strategies be made concurrent with development in order to manage growth and
coordinate the delivery of government services).

Review and comment on a draft ordinance (Bill 328) amending the Hawaii County Code 1983
(2005 Edition, as amended) by adding a new chapter relating to concurrency (establishes a
concurrency management system and prepares a public facilities improvement plan to fund and
maintain county-wide facilities and services).
INITIATOR: COUNTY COUNCIL
Review and comment on a draft ordinance (Bill 329) amending the Hawaii County Code 1983
(2005 Edition, as amended) by adding a new chapter relating to adequate public facilities (relates
to adequate public facilities for the identification of infrastructure and services necessary to
support new development and the establishment of a policy as to when and how these
improvements and services will be constructed and maintained).

along the west (makai) side of Mamalahoa Highway (Highway 11), approximately 120 feet south

MINUTESThe Commission at this time, 4:34 p.m., took up the following
minutes with no one from the public in attendance:
January 19, 2007 It was moved by Commissioner Alameda and seconded by Commissioner
Watanabe that the minutes be approved with the following corrections: The seventh word in
Chair Grahams third comment on Page 2 of Exhibit A to read, perspective; the New
University District hearing transcript to be dated January 19, 2007 and labeled Exhibit B; and the
first word in the fourteenth line on Page 13 of Exhibit C to read, TORIGOE. Motion was
unanimously carried by a voice vote of all Commissioners in attendance.
February 15, 2007 It was moved by Commissioner Siracusa and seconded by Commissioner
Alameda that the minutes be approved with a correction to Page 7 of Exhibit C, the tenth line of
Chair Grahams comment to read, years weve had Mr. Dollar and Mr. Brock, and for a short
time there was Mr. Ziemann,. Motion was unanimously carried by a voice vote of all
Commissioners in attendance.
ADMINISTRATIVE The Commission took this item up at 4:38 p.m. with
MATTERSno one from the public in attendance.
Status of appeals filed on Planning Commission decisions - Corporation Counsel
Mr. Torigoe reported that the matter of D-BAR RANCH, LLC (SMA 06-000009) has been
remanded by Judge Strance due to some procedural issues, and advised the Commission to
agendize an executive session when the Commission receives the written order from the Court,
possibly at the next Kona meeting.
Commissioner Siracusa requested the staff to provide the background materials to the new
Commissioners, as well as other Commissioners who need them.
