Kimo Alameda presiding. PRESENT:C. As there were no objections and to obtain additional materials on C&R Development€s application, the Commission amended its agenda to take up the following application at this time. REZ 06-000046The Commission took this item up at 9:04 a.m. with C&Rapproximately 5 people from the public in attendance. DEVELOPMENT, LLC KALOKO, NORTH KONA APPLICANT: C & R DEVELOPMENT, LLC (REZ 06-000046) Change of zone from a Limited Industrial  1 acre (ML-1a) to an Industrial Commercial Mixed 1-acre (MCX-1a) district for approximately 1.277 acres of land. The property is located along the south (mauka) corner of Kamanu Street and Maiau Street in the Kaloko IndustrialSubdivision,Kaloko,NorthKona,Hawaii,TMK:7-3-51:96. (SEEEXHIBITA) RECESSEDTheChaircalledforashortrecessat10:06a.m. 1 RECONVENEDThe meeting reconvened at 10:12 a.m. REZ 06-000048The Commission took this item up at 10:13 a.m. with WINTON approximately 5 people from the public in attendance. NICHOLSON KALOKO, NORTH KONA APPLICANT: WINTON NICHOLSON (REZ 06-000048) Change of Zone from anAgricultural 20-acre (A-20a) to an Agricultural 10-acre (A-10a) district for 21.088 acres of land. The property is located along the southwest side of Kaloko Drive, approximately 300 feet west of the Kaloko Drive-Keanaaina Street intersection, Kaloko Mauka Subdivision, Kaloko, North Kona, Hawaii, TMK: 7-3-27:14. Mr. Darrow oriented the Commission and public of the subject and surrounding properties on the location map and site plan, summarized the request, and noted the Planning Director recommended a favorable recommendation to the County Council with conditions. The applicant, Winton Nicholson, and his representative, Greg Mooers, were in attendance. Mr. Mooers gave a history of change of zone applications in this subdivision created over 20 years ago, and referred to the Council€s resolution and ordinances passed the last 10- 12yearstopreservethenativeforest,habitatsandwatershedinthearea.Hesaidthe Council established policies to support 10-acre rezonings at this elevation provided applicants were willing to accept an 80 percent forest preservation condition because of the concern of destroying the resources. He said currently there is no requirement to preserve the land and landowners can clear their land and cut all the forest down on their 20-acre parcel and perform agricultural activities. There was no one from the public wishing to testify on the application. It was moved by Commissioner Siracusa and seconded by Commissioner Watanabe to send a favorable recommendation to the County Council as recommended by the Planning Director. Commissioner Siracusa said she supported the request as she sees it as a way to protect the forest lands. A roll call vote was taken and motion carried with seven ayes (Siracusa, Watanabe, Galdones, Graham, Iwashita, Rho and Alameda) and two absent and excused (McCall and Salavea). SPP 06-000035The Commission took this item up at 10:20 a.m. with CELLCO PARTNERSHIP five people from the public in attendance. DBAVERIZON WIRELESS KAPAAULA, HAMAKUA 2 APPLICANT: CELLCO PARTNERSHIP DBA VERIZON WIRELESS (SPP 06-000035) Special Permit to allow the construction of a telecommunication facility consisting of a 150-foot monopole, an equipment shelter, and fencing on approximately 2,000 square feet of land situated within the State Land Use Agricultural District. The area involved is located on the south side of the Hawaii Belt Road (Highway 19), approximately 4 miles east of the Hawaii Belt Road  Old Mamalahoa Highway intersection, Kapaaula, Hamakua, Hawaii, TMK: 4-7-7: portion of 10. 2 people at 10:28 a.m. Mr. Darrow stated that the applicant€s representative, Danette Mettler, submitted an October 23, 2006 correspondence requesting a continuance of the hearing to allow the public additional time to pose questions and raise concerns. Commissioner Graham questioned why this item was on the agenda today rather than on the Hilo agenda, to which no reason was offered. Commissioner Galdones requested the appropriateness of requesting a map of the various cell towers on the Big Island and, also, their coverages. Mr. Darrow said he will refer this request to Mr. Hayashi; and he noted they would have to request propagation maps from each cell tower provider. Mr. Yuen said they will do their best, but noted the difficulty that some towers in the Ag district were never permitted and there are many towers that required only plan approvals because the use is already permitted, noting no propagation maps were submitted for these towers. Mr. Yuen said they have started asking for propagation maps for those that came in for special permits because the Department wanted them to demonstrate a need for the project and also to analyze the same kinds of questions the Commission have. Mr. Torigoe noted that as this is a contested case, the presiding officer has the authority to continue the matter. As there was no objection, the Chair stated this agenda item is continued to the next Hilo meeting. GENERAL PLANThe Commission took this item up at 10:28 a.m. with PLAN AMENDMENTtwo people from the public in attendance COUNTY COUNCIL PROCEDURE INITIATOR:COUNTYCOUNCIL Review and comment on a draft ordinance regarding the General Plan amendment procedure. (SEEEXHIBITB) 3 MINUTESThe Commission took this item up at 11:25 a.m. September 22, 2006  It was moved by Commissioner Galdones and seconded by Commissioner Graham that the minutes be approved as circulated and placed in file. Motion was unanimously carried by a voice vote of all Commissioners in attendance. ADMINISTRATIVE The Commission took this item up at 11:26 a.m. with MATTERSno one from the public in attendance. Status of appeals filed on Planning Commission decisions - Corporation Counsel  Mr. Torigoe noted that the Third Circuit Court Judge has not ruled on the appeal of Daniel Ibbetson€s special permit (SPP 05-015).
