Kimo Alameda presiding. PRESENT:C. USE 06-000004The Commission took this item up at 9:01 a.m. with A HUI HOU TRIBUTEapproximately 26 people from the public in attendance. CENTER INC. KAILUA, NORTH KONA APPLICANT: A HUI HOU TRIBUTE CENTER, INC. (USE 06-000004) Use Permit to allow cremation within a mortuary facility on property zoned Village Commercial (CV). The property (former 7-11 Store) is located along the east side of Kuakini Highway, approximately 100 feet northwest of the Kuakini Highway - Hualalai Road intersection, Honuaula, Kailua Village, North Kona, Hawaii, TMK: 7-5-22:3. (SEE EXHIBIT A) SMA 06-000009The Commission took this item up at 9:51 a.m. with D-BAR RANCH, LLCapproximately 20 people from the public in attendance. PAHOEHOE, NORTH KONA 1 APPLICANT: D-BAR RANCH, LLC (SMA 06-000009) Continuation on the application for a Special Management Area (SMA) Use Permit to allow the 120-unit condominium project and related uses. The property is located between Alii Drive and the proposed Kahului-Keauhou Parkway (aka Alii Parkway), mauka of the Kona Magic Sands nd Condominium and north of the White Sands Beach Estates Subdivision, Pahoehoe 2, North Kona, Hawaii, TMK: 7-7-8:21 & 23 (SEE EXHIBIT B) SLU 06-000011The Commission took this item up at 2:44 p.m. with REZ 06-00041approximately 11 people from the public in attendance. JAMES AND MADELEINE BUDDE OULI, SOUTH KOHALA APPLICANTS: JAMES AND MADELEINE BUDDE (SLU 06-000011/REZ 06-000041) a.State Land Use Boundary Amendment for 5.003 acres of land from an Agricultural to a Rural district. b.Change of Zone for 5.003 acres of land from an Agricultural -5 acre (A-5a) to a Residential and Agricultural 2-acre (RA-2a) district. The property is located along the south side of Kanehoa Street and north of Keanuiomano Stream, Anekona Estates Subdivision, Ouli, South Kohala, Hawaii, TMK: 6-2-11: 20. Mr. Hayashi oriented the Commission and public of the subject and surrounding properties on the location map and site plan, summarized the requests, and noted the Planning Director recommends approval of the applications with conditions on the change of zone application. Commissioner Siracusa questioned if a condition could be imposed that would prevent the applicant from further subdividing the property. Mr. Torigoe said it was generally not a good idea to try and bind the Council or the Planning Commission to not do any further legislative decisions in the future. Commissioner Watanabe felt Condition D addressed Commissioner Siracusa’s concern on density as the applicant would not be able to construct another dwelling on the property. In response to Commissioner Siracusa’s concern, the applicant’s representative Gregory Mooers said, in addition to the conditions of the change of zone, the CC&Rs for the subdivision prevent any further subdivision of the property. Mr. Mooers clarified that within the subdivision, there are six CPRS, the subject application is th the 25 of the original 36 lots to ask for rezoning, and there would be only 5 remaining lots that have yet to be subdivided if this rezoning goes through. He added that Dr. Budde does have two water meters, and beyond that no additional rezonings can occur until the water source at Ouli is developed. There was no one from the public wishing to testify on the application. 2 Regarding the SLU boundary amendment application, it was moved by Commissioner Galdones and seconded by Commissioner Siracusa to send a favorable recommendation to the County Council. There was no discussion. A roll call vote was taken and motion carried with eight ayes (Galdones, Siracusa, Watanabe, Graham, McCall, Rho, Salavea, and Alameda) and one no (Iwashita). Commissioner Iwashita’s first response to the motion was kanalua. Regarding the Change of Zone application, it was moved by Commissioner Galdones and seconded by Commissioner Siracusa to send a favorable recommendation to the County Council. There was no discussion. A roll call vote was taken and motion carried with eight ayes (Galdones, Siracusa, Watanabe, Graham, Iwashita, McCall, Rho, Salavea, and Alameda) and one no (Iwashita). SMA 06-000013The Commission took this item up at 2:56 p.m. with JR KONAapproximately 11 people from the public in attendance. ACQUISITIONS LLC KAILUA-KONA, NORTH KONA APPLICANT: JR KONA ACQUISITIONS LLC (SMA 06-000013) Special Management Area Use Permit to allow a new addition and renovation to the existing Big Island Honda facility, open auto display, and employee parking. The properties involved are located on the makai side of Kuakini Highway, approximately 600 feet west of the intersection of Palani Road and Kuakini Highway, Kailua-Kona, North Kona, Hawaii, TMK: 7-5-5:87 and 88. (SEE EXHIBIT C) RECESSED The Chair called a short recess at 3:45 p.m. RECONVENEDThe meeting reconvened at 3:53 p.m. SPP NO. 944The Commission took this item up at 3:54 p.m. with BIG ISLAND COUNTRY approximately 9 people from the public in attendance. CLUB HOMES, LLC PUUANAHULU, NORTH KONA APPLICANT: BIG ISLAND COUNTRY CLUB HOMES, LLC (SPP No. 944) Amendment to Condition 7 (construction time requirement) of Special Permit No. 944, which allowed the construction of a 50-unit members only private lodge on 10 acres of land situated within the State Land Use Agricultural district. The property is bordered by the Big Island Country Club golf course situated on the makai side of Mamalahoa Highway (Highway 190), Puuanahulu, North Kona, Hawaii, TMK: 7-1-5: portion of 41. Mr. Darrow stated this item has been withdrawn. Commissioner Iwashita left the meeting at this time. 3 AMEND ZONING CODEThe Commission took this item up at 3:55 p.m. with CHAPTER 25approximately 9 people from the public in attendance. PLANNING DIRECTOR FAMILY DEFINITION INITIATOR: PLANNING DIRECTOR Amendment to Chapter 25 (Zoning Code), Article 1, Section 25-1-5(b) of the Hawaii County Code 1983 (2005 Edition, as amended), by amending the definition of “family” to read as follows: “Family” means an individual or two or more persons related by blood, state-sanctioned adoption, foster parentage, guardianship or marriage, or a group of not more than five unrelated persons (excluding servants), occupying a dwelling unit. The term includes individuals in larger group living situations described as group living facilities and family child care homes[.] and a group of not more than eight unrelated persons, plus any program staff, living in a facility licensed by the department of health. (SEE EXHIBIT D) MINUTESAt 5:30 p.m., the Commission took up the following item with 3 people from the public in attendance. July 21, 2006 - It was moved by Commissioner Galdones and seconded by Commissioner Salavea that the minutes be approved as circulated. Motion was unanimously carried by a voice vote of all Commissioners in attendance. ADMINISTRATIVEThe Commission took this item up at 5:31 p.m. with MATTERS3 people from the public in attendance. Status of appeals filed on Planning Commission decisions - Corporation Counsel – Mr. Torigoe had nothing new to report. ANNOUNCEMENTSThe Commission took this item up at 5:32 p.m. Mr. Hayashi announced that the next meeting is scheduled for September 7, 2006 in Hilo and subsequently for September 22, 2006 at the Hapuna Beach Prince Hotel, Mauka Salon.
