Kimo Alameda presiding. PRESENT:C. ORD. 96-81The Commission took this item up at 9:10 a.m. with JON MITSUDA approximately 18 people from the public in attendance. WAIAKEA, SOUTH HILO APPLICANT: JON MITSUDA (ORD. 96 81) Request to repeal Ordinance No. 96 81, which reclassified approximately 1.952 acres from an Agricultural 3-acre (A-3a) to a Single-Family Residential 10,000 square feet (RS-10) district. The property is located at the west end of Ahe Street, adjacent to the Hoomalu Street Subdivision, Waiakea, South Hilo, Hawaii, TMK: 2-4-8: 15 (formerly 2-4-3: portion of 4). Mr. Hayashi gave some background information. He said the applicant requested the Commission proceed with this matter even though he will be unable to attend today’s meeting as he does not intend to go ahead with the project proposed by the previous owner, Gilbert Kudo. In response to Commissioner Siracusa’s inquiry, Mr. Hayashi clarified that conditions in an ordinance do not have to be complied with if the ordinance is repealed. There was no one from the public wishing to testify on this application. 1 It was moved by Commissioner Siracusa and seconded by Commissioner Salavea to send a favorable recommendation to the Hawaii County Council on the repeal of Ordinance No. 96 81 as recommended by the Planning Director. A roll call vote was taken and motion carried with six ayes (Siracusa, Salavea, Iwashita, McCall, Rho, and Alameda) and three absent and excused (Galdones, Graham, and Watanabe). RECESSEDThe Chair called a short recess at 9:14 a.m. RECONVENEDThe meeting reconvened at 9:19 a.m. SMA 434/SPP 1214The Commission took this item up at 9:19 a.m. with CELLCO PARTNERSHIPapproximately 17 people from the public in attendance. dba VERIZON WIRELESS WAIPUNALEI, NORTH HILO APPLICANT: CELLCO PARTNERSHIP dba VERIZON WIRELESS (SMA 434/SPP 1214) Cellco Partnership dba Verizon Wireless, with authorization from the landowner and Nextel Partners, Inc., has submitted a request to amend Special Management Area (SMA) Use Permit No. 434 and Special Permit No. 1214 to allow the following: a.Co-location of eight 8-foot panel antennas on the existing 80-foot telecommunication pole; b.Construction of a 312+ square foot equipment shelter and security fencing; and c.Increase the permit area from 600 square feet to 1,475 square feet. The area involved is located at the north end of Laupahoehoe Gulch and along the makai side of State Highway 19, Waipunalei, North Hilo, Hawaii, TMK: 3-6-4: portion of 7. Mr. Darrow oriented the Commission and public of the subject and surrounding properties on the location map and site plan, summarized the requests, and noted the Planning Director recommended approval of the applications with conditions. Commissioner McCall expressed his concern of the proximity of this development to the existing heiau in the area. Mr. Darrow indicated on the presentation map the location of the existing heiau, which was approximately 100 to 150 feet away from the subject property. Mr. Darrow said the Department has not received a “no effect” letter from the State DLNR within the 30-day limit. For Commissioner Siracusa’s information, Mr. Darrow described the 8-foot panel antennas, which would be similar to the Verizon 12-foot panel antennas in Orchidland. The applicant’s representative, Danette Metler, stated she did receive the Planning Department’s background report and recommendations. 2 For Commissioner Iwashita’s information, Ms. Metler indicated on the presentation map the location of the areas involved and noted that the improvements will be located more than 100 feet away from the heiau. Commissioner Salavea questioned what weight should be given to the fact that a letter of “No effect” from the DLNR has not been received by the Planning Department for the proposed amendments. Mr. Darrow said it was up to the Commission to make this determination, noting however that in many instances DNLR does not provide comments to applications. Mr. Darrow added that the DLNR did provide a response to the original applications, which was they determined there were “no historic properties affected.” There was no one from the public wishing to testify on the application. Regarding the amendment to SMA 434, it was moved by Commissioner Salavea and seconded by Commissioner McCall that the request be approved as recommended by the Planning Director. A roll call vote was taken and motion carried with six ayes (Salavea, McCall, Iwashita, Rho, Siracusa, and Alameda) and three absent and excused (Galdones, Graham and Watanabe). Regarding the amendment to SPP 1214, it was moved by Commissioner Salavea and seconded by Commissioner McCall that the request be approved as recommended by the Planning Director. REZ 06-000044The Commission took this item up at 9:33 a.m. with DR. ALLAN TAKASE approximately 20 people from the public in attendance. WAIAKEA, SOUTH HILO APPLICANT: DR. ALLAN TAKASE (REZ 06-000044) Change of Zone from a Single-Family Residential – 10,000 square feet (RS-10) to a Multiple-Family Residential – 1, 000 square feet (RM-1) district. The property is located on the west side of Kinoole Street, approximately 180 feet south (Puna side) of the nd Kinoole Street – Olona Street intersection, Waiakea House Lots, 2 Series, Waiakea, South Hilo, Hawaii, TMK: 2-2-26:24. (SEE EXHIBIT A) SPP 06-000032The Commission took this item up at 10:08 a.m. with PAT FAY & approximately 24 people from the public in attendance MARY ROBLEE KEAAU, PUNA 3 APPLICANT: PAT FAY & MARY ROBLEE (SPP 06-000032) Special Permit to allow the establishment of a 2-bedroom bed and breakfast within an existing single family dwelling located on 0.5 acre of land situated within the State Land Use Agricultural District. The property is located along the west (mauka) side of Paradise Ala Kai Street, approximately 1 mile from its intersection with Paradise Drive, Hawaiian Paradise Park Subdivision, Keaau, Puna, Hawaii. TMK: 1-5-59:28. The area involved is located at the northwest corner of State Highway 19 and Kalaoa Camp Road, adjacent to and south of Aukuu Stream, Kalaoa, South Hilo, Hawaii, TMK: 2-7-8: portion of 130. DEFINITION OF FAMILY Amendment to Chapter 25 (Zoning Code), Article 1, Section 25-1-5(b) of the Hawaii County Code 1983 (2005 Edition, as amended), by amending the definition of “family” to read as follows: “Family” means an individual or two or more persons related by blood, state-sanctioned adoption, foster parentage, guardianship or marriage, or a group of not more than five unrelated persons (excluding servants), occupying a dwelling unit. The term includes individuals in larger group living situations described as group living facilities and family child care homes[.] and a group of not more than eight unrelated persons, plus any program staff, living in a facility licensed by the department of health. August 4, 2006 – It was moved by Commissioner Siracusa and seconded by Commissioner Salavea that the minutes be approved as circulated. Motion was unanimously carried by a voice vote of all Commissioners in attendance ADMINISTRATIVEThe Commission took this matter up at 4:31 p.m. with MATTERSno one from the public in attendance. Status of appeals filed on Planning Commission decisions - Corporation Counsel - Mr. Torigoe had nothing new to report. Other Commission matters - Regarding the contested case hearing for the First Samoan Congregational Church (SPP 06-000022), Mr. Hayashi noted the Church has withdrawn their application. ANNOUNCEMENTS Mr. Hayashi announced the next meeting is scheduled for September 22, 2006 at the Hapuna Prince Hotel.
