(ORDINANCE NO. 04-106)The Commission took this item up at 9:25 a.m. with SEASCAPE DEVELOPMENT,approximately 10 people from the public in attendance. LLC ST OOMA 1, NORTH KONA APPLICANT: SEASCAPE DEVELOPMENT, LLC (ORDINANCE NO. 04-106) Amendment to Condition H (construction of Kakahiaka Street extension) as required in Ordinance No. 04-106, which rezoned 10.001 acres of land from an Agricultural 5-acre (A-5a) to a Multiple Family Residential  4,000 square feet (RM-4) district. The property is located on the south side of Kona Palisade Subdivision, approximately 1,200 feet south of the Kaiminani Drive st  Kakahiaka Street intersection, Ooma 1, North Kona, Hawaii TMK: 7-3-10: portion of 3. KANEHOAESTATES SUBDIVISION 1 OULI, SOUTH KOHALA APPLICANT: SCOTT NAKAHARA (REZ 06-000031) a.State Land Use boundary amendment from the Agricultural to the Rural district for approximately 5.9 acres of land. b.Change of Zone from Agricultural 5-acre (A-5a) to Residential and Agricultural 2-acre (RA-2a) for approximately 5.9 acres of land. The property is located along the south side of Kawaihae Road (Highway 19) with access from Kanehoa Place, Kanehoa Estates Subdivision, Ouli, South Kohala, Hawaii, TMK: 6-2-9: 17. (SEE EXHIBIT B) YUEN:While we are between items I just wanted to make a comment to the Commission about a statement that was made in the earlier matter about Commissioners testifying and just to clarify when Commissioners can talk about their own life experiences. ALAMEDA:Sure. YUEN:A Commissioner can always talk about things that they are aware of from general knowledge in the community or their own experience. For example, if you work for a financial institution you can talk about whether a certain kind of condition would cause a problem with somebody getting a loan on the property. You can talk about your experience in-, if the question is whether there should be a traffic calming device like a speed bump you can testify about well we have a speed bump in our neighborhood and it causes a lot of noise when the cars go over it. You can always talk about those kinds of things. When we have a matter that the Commission is deciding, like a permit where the Commission is final and not a recommendation you have to be cautious about talking about specifics of the site that are not on the record. In other words I know there€s a big lava tube on that site, the bulldozers going to fall through. If you€re aware of something like that you should try to bring it out by asking a question rather than by your being the source of the facts on it. But as far as knowing, saying that the traffic is bad in Kona or a stub out in my neighborhood causes a problem and that might cause a problem in a situation like we had in a particular subdivision application, you can always do that kind of statement. (SEE EXHIBIT C) (SMA 417/SPP 1117)The Commission took this item up at 11:54 a.m. with JEAN SUNDERLAND ANDapproximately 10 people from the public in attendance ROBERT WATKINS, HANAULA AND HONOPUEO, NORTH KOHALA APPLICANTS: JEAN SUNDERLAND AND ROBERT WATKINS (SMA 417/SPP 1117) Amendments to Special Management Area (SMA) Use Permit No. 417 and Special Permit No. 1117 to allow overnight camping in addition to the previously allowed 16-room Hawaiian Permaculture and Wellness Center on approximately 5 acres of land situated within the State Land Use Agricultural District. The property is located approximately one mile makai from Akoni Pule Highway and Kamehameha Park, Hanaula and Honopueo, North Kohala, Hawaii, TMK: 5-4-09: portions of 1, 14 and 20. Mr. Hayashi informed the Commissioners that the Department received a letter of withdrawal from the applicant on Monday, April 17, 2006. Chair Alameda inquired about whether they could reapply in a few months at which Mr. Hayashi responded that they could do that.
