Kimo Alameda presiding. PRESENT:C. (REZ 03-032)The Commission took this item up at 9:10 a.m. with JACK AND BARBARAapproximately 10 people from the public in attendance. UMPHREY HONALO, NORTH KONA APPLICANT: JACK AND BARBARA UMPHREY (REZ 03-032) Continuation on the application for a Change of Zone for 25,580 square feet of land from a Single Family Residential ‚ 7,500 square feet (RS-7.5) to a Village Commercial ‚ 7,500 square feet (CV-7.5) district. The property is located along the east (mauka) side of Mamalahoa Highway and across from Saint Paul Road, approximately 430 feet south of Teshima Restaurant, Kawanui 1, Honalo, North Kona, Hawaii, TMK: 7-9-3:61. st Mr. Darrow informed the Commissioners that Jack and Barbara Umphrey submitted a letter requestingcontinuancetilltheApril2006meeting.CommissionerSiracusainquiredaboutthe timeline however since the applicant is the one requesting for the continuance the timeline is not applicable.TheChairthenaskediftherewasanyonefromthepublicthatwantedtogive testimony. There was no public testimony but written testimony had been submitted by Gerry HerbertandNancyRedfeatherandwasplacedinthefileaspartoftherecord.Itwasmovedby Commissioner Siracusa and seconded by Commissioner Springer that this application be 1 continued to the April Kona meeting. Commissioner Galdones proposed an amendment to the motion that the application be agendized assoonas the applicant submits a revised application for consideration. The amendment to the motion was accepted. Motion was unanimously carried by roll call vote of all Commissioners in attendance. (SLU 05-004/REZ 05-013)The Commission took this item up at 9:14 a.m. with LAVA KUAKINI INC.approximately 16 people from the public in attendance. State Land Use boundary amendment for 14 acres from the Agricultural to the Urban District. b. KEAHOLE, NORTH KONA APPLICANT: HAWAII ELECTRIC LIGHT COMPANY, INC. (REZ 05-025) Change of Zone from an Open (O) to a General Industrial 15-acre (MG-15a) district for 15.643 acres of land. The property is the site of the existing Keahole power plant located east of Queen Kaahumanu Highway and the Kona International Airport at Keahole, Keahole, North Kona, Hawaii, TMK: 7-3-49: 36 and 37. (SEE EXHIBIT G) RECESSED:The Chairman called for a recess at 4:55 p.m. RECONVENED:The meeting was reconvened at 5:10 p.m. (REZ 05-010)The Commission took this item up at 5:10 p.m. with HILUHILU LIGHTapproximately 15 people from the public in attendance. DEVELOPMENT LLC KEAHOLE, NORTH KONA APPLICANT: HILUHILU DEVELOPMENT LLC (REZ 05-010) Change of Zone from Open (O) and Agricultural 3-acre (A-3a) to a Project District for 725.2 acres of land. The project, referred to as €Palamanui will be a master planned community with a mix of single-family and multiple-family residential units, commercial spaces, a village inn, 18- hole golf course,and related improvements and infrastructure. The property is located northeast of the Kona International Airport at Keahole, between Queen Kaahumanu Highway andMakalei Estates Subdivision, Kau, North Kona, Hawaii, TMK: 7-2-5:1. (SEE EXHIBIT H) INITIATOR: PLANNINGThe Commission took this item up at 7:40 p.m. with DIRECTORapproximately8peoplefromthepublicinattendance. INITIATOR:PLANNINGDIRECTOR 4 Amendment to certain conditions of Change of Zone Ordinance No. 93-45 pertaining to the land proposed for a Change of Zone filed by HiluhiluDevelopment LLC at Kau, North Kona, Hawaii, TMK: 7-2-5:1. Mr. Hayashi briefed the Commissioners stating that the ordinance 93-45 covers a portion of the Hiluhilu Development that was discussed in the previous application and also Makalei Estates Subdivision. He stated that because Hiluhilu has come in for the change of zone the ordinance has to be amended to delete approximately 450 acres of Hiluhilus property. Mr. Hayashi said that because many of the conditions have already been fulfilled and/or are no longer applicable since removing the Hiluhilu property the ordinance will be amended to reflect those changes. He said that this will require deleting most of the conditions except for 4 conditions from the ordinance. The four conditions that will be retained are as follows: 1) Prohibit construction of a second single-family dwelling on each of the lots within the Makalei Estates Subdivision. 2) The standard condition that if any unidentified archaeological sites and remains are found then work shallimmediatelycease.3)Allotherapplicablerules,regulationsandrequirementsshallbe complied with. 4) The applicants, successors or assigns shall be responsible for complying with all of the stated conditions of approval. All of the other conditions in the current ordinance are being deleted. Commissioner Watanabe queried if this amendment is subject to the approval of the Change of Zone by the County Council on the previous application. This was confirmed by Mr. Hayashi. Commissioner Springer asked what happens to the Tax Map Keys and are they renumbered by virtue of this action. Mr. Yuen answered her stating that the area under the tax map key is deleted but not the number. During this discussion the Chairman stated that Commissioner Siracusa was not present during this discussion. It was moved by Commissioner Watanabe and seconded by Commissioner Galdones that a favorable recommendation be sent to the County Council for amendment to the Change of Zone Ordinance number 93-45, tax map key 7-2-5:1 subject to the approval of the Change of Zone application REZ 05-010. There was no discussion. Motion was unanimously carried by roll call vote of all Commissioners in attendance (Siracusa was not present). MINUTESThe Commission took this item up at 7:43 p.m. with approximately 6 people from the public in attendance. November 18, 2005 ‚ This minutes could not be approved because it was not on the agenda however Commissioner Graham did want the attendees on the Executive Session and the Minutes corrected because they were different. This minutes will be on the next agenda. December 8-9, 2005 ‚ It was moved by Commissioner Galdones and seconded by Commissioner McCall that the minutes be approved as circulated.
