WAIAKEA, SOUTH HILO APPLICANT: JANICE OSHIRO (REZ 05-016) Action on an application for a Change of Zone for 28,002 square feet of land from a Single Family Residential ƒ 10,000 square foot (RS-10) to a General Commercial ƒ 10,000 square foot (CG-10)district.ThepropertyislocatedalongtheeastsideofKilaueaAvenueand approximately 120 feet north of the Kilauea Avenue ƒ Lanikaula Street intersection, Waiakea, SouthHilo,Hawaii,TMK:2-2-28:30,32&33. JEANNE VURICH KEAAU, PUNA APPLICANTS: JOHNAND JEANNE VURICH (SPP 04-017) Discussion and action on the Hearing Officer€s report on a Special Permit to allow the establishment of a self-storage facility with perimeter chain link fencing and landscaping on one acre of land situated in the State Land Use Agricultural District. The property is located at the th northwestern corner of Kaloli Drive and 14 Avenue, and adjacent to the existing JJŒs Self Storage facility, Hawaiian Paradise Park Subdivision, Keaau, Puna, Hawaii, TMK: 1-5-46:120. (SEE EXHIBIT B) RECESSEDThe Chair called a short recess at 12:25 p.m. RECONVENEDThe meeting reconvened at 12:30 p.m. As there was no objection the Commission took up the following application at this time. REZ 05-017The Commission took this item up at 12:30 p.m., with THE NEWTON FAMILYthree people from the pubic in attendance. LIMITED PARTNERSHIP ST KUKUAU 1, SOUTH HILO APPLICANT: THE NEWTON FAMILY LIMITED PARTNERSHIP (REZ 05-017) Change of Zone for 885.4 acres of land from Unzoned to an Agricultural 80-acre (A-80a) district. The property is located approximately 3,600 feet southwest of the Hilo Country Club st Estates Subdivision inUpperKaumana, Kukuau 1, South Hilo, Hawaii, TMK: 2-4-8: Portion of 33. Mr. Hayashi oriented the Commission and public of the subject and surrounding properties on the location map and site plan and summarized the request. He noted that the Planning Director recommended approval of the application with conditions, noting all of the conditions imposed by the Land Use Commission are incorporated in Condition B of the Planning Director€s proposed conditions. The applicant€s representative, Jim Bell, gave some background information and summarized the request.Hestatedthattheapplicantisinagreementwiththeproposedconditionsofthe Planning Director. For Commissioner Siracusa€s information, Mr. Bell clarified that the Newton Family Limited Partnershipisnotbuildinganyhomes,butthefamilymemberswhoreceivetitletotheirlotwill. Mr.YuenatthistimeamendedConditionDtoclarifythatthisconditionwillnotkickinunless8 lots are created. Mr. Bell said the applicant would like to leave the option of creating 8 lots, to 2 which Mr. Yuen said the amended Condition would allow for this as it says as required by the Department of Water Supply.‚ Mr. Yuen then recommended that Condition H be deleted as he did not want to precludethe possibility of the applicant requesting a variance. In response to Commissioner Siracusa€s inquiry, Mr. Yuen said Condition G is a standard condition imposed upon such applications and that he did not feel it needed to be amended even if street lights are not required for this subdivision. Mr. Yuen noted that the applicant would probably be required to install a stop sign at the intersection. Commissioner Springer questioned if Condition L should be amended to include a forest management plan. Mr. Yuen said that in the Kaloko Mauka area the Department is finding it difficult to continually impose such a condition and will be attempting to create a standard plan thatwillbeincorporatedasacondition. InresponsetoCommissionerSiracusa€ssuggestionrelatingtoConditionL,theapplicantstated he will look into dedicating a portion of the property to native forest to obtain a real property tax break. For Comissioner Salavea€s information, Mr. Bell stated they were not planning any improvements to Wilder Road, except at the intersection, and they would have to be approved by the Department of Public Works and Planning Department. He added that they will build a single agricultural road up to the easement onto the Newton property. In response to Commissioner Salavea€s concern of creating additional lots in the area where the stream rises over the bridge or road during heavy rains, Mr. Yuen said he could not say specifically if this was a consideration in the recommendation, but they did feel the proposal was a minimal addition to the uses of Wilder Road. There was no one from the public wishing to testify on the application. It was moved by Commissioner Springer and seconded by Commissioner Siracusa that the application be approved for the reasons and with the conditions, as recommended and amended by the Planning Director. A roll call vote was taken and motion carried with six ayes (Springer, Siracusa, Watanabe, McCall, Salavea, and Alameda) and three absent and excused (Galdones, Graham and Iwashita). LYNNWOOD KEAAU, PUNA 3 APPLICANTS: VERNE AND LYNN WOOD (SPP 05-018) Continued hearing on the application for a Special Permit to allow a contractor€s warehouse and baseyard to facilitate the construction and servicing of water catchment systems on 40,075 square feet of land situated within the State Land Use Agricultural District. The property is rd located between 33 Street and Highway 130 (Keaau-Pahoa Road), approximately 800 feet rd northwest of the 33 Street ƒ Makuu Drive intersection, Hawaiian Paradise Park Subdivision, Keaau, Puna, Hawaii, TMK: 1-5-16:167. (SEE EXHIBIT C) SPP 05-019The Commission took this item up at 2:31 p.m., with ROMANO DE CESAREfive people from the pubic in attendance. KEAAU, PUNA APPLICANT: ROMANODE CESARE (SPP 05-019) Special Permit to allow the establishment of a home office for real estate acquisition and management within an existing single family dwelling situated on a 9.5-acre property within the State Land Use Agricultural District. The existing dwelling is the former Puna Sugar Co. manager€s residence situated along the northeast side of the old Keaau ƒ Pahoa Road, Keaau, Puna, Hawaii, TMK: 1-6-3:85. Mr. Darrow oriented the Commission and public of the subject and surrounding properties on the location map and site plan, summarized the request, and noted the Planning Director is recommending approval of the application with conditions. The applicant, Romano De Cesare, stated he did review and had no objections to the Planning Department€s background report and recommendation. As Mr. De Cesare said he is considering having the residence included in the National Register ofHistoricPlaces,CommissionerSiracusaencouragedthathedoso. InresponsetoCommissionerSalavea€sinquiry,Mr.DeCesareconfirmedthathewillbeusing the existing dwelling and not constructing any new dwellings. There was no one from the public wishing to testify on this application. It was moved by Commissioner Springer and seconded by Commissioner Siracusa that the applicationbeapprovedforthereasonsandwiththeconditionsprovidedbythePlanning Department. A roll call vote was taken and motion carried with six ayes (Springer, Siracusa, McCall,Salavea,WatanabeandAlameda)andthreeabsentandexcused(Galdones,Grahamand Iwashita). REZ 05-018 The Commission took this item up at 2:37 p.m., with KULANA KEA, LLC eight people from the pubic in attendance. WAINAKU, SOUTHHILO 4 APPLICANT: KULANA KEA, LLC (REZ 05-018) Change of Zone for 26.122 acres of land froman Agricultural 20-acre (A-20a) district and a Single Family Residential 15,000 squarefoot (RS-15) district to a Family Agricultural 5-acre (FA-5a) district. The properties involvedare located along the north side of Kulana Kea Road, approximately 850 feet west of the Kulana Kea Road ƒ Wainaku Street intersection, Wainaku Farms Subdivision, Wainaku, South Hilo, Hawaii, TMK: 2-6-32:4 & 5. (SEE EXHIBIT D) REZ 05-019The Commission took this item up at 4:20 p.m., with MATSUNOone person from the pubic in attendance. ENTERPRISES, LTD. PONAHAWAI, SOUTH HILO APPLICANT: MATSUNO ENTERPRISES, LTD. (REZ 05-019) Change of Zone for 8 acres of land from an Agricultural 1-acre (A-1a) district to a Neighborhood Commercial 20,000 square foot (CN-20) district. The property is located along the south side Ponahawai Street, approximately 1,500 feet east of the Komohana Street ƒ Ponahawai Street intersection and diagonally across from the Homelani Cemetery, Ponahawai, South Hilo,Hawaii, TMK: 2-3-36: portion of 18. Mr. Hayashi oriented the Commission and public of the subject and surrounding properties on the location map and site plan, and summarized the request. He noted the Planning Director€s favorable recommendation with conditions and amended the second sentence in Condition N to read, This requirement shall be approved by the Administrator of the Office of Housing and Community Development prior to final subdivision approval for any new residential structures.‚ For Commissioner McCall€s information, Mr. Hayashi indicated on the presentation map the location of Alenaio Stream, which borders the rear portion of the 24-acre area and not the 8-acre area. ForCommissionerWatanabe€sinformation,Mr.Hayashinotedthattherewillbeone ingress/egress from Komohana Street with aleft-turn storage lane and that Civil Defense has suggested there be another ingress/egress from Ponahawai Steet for emergencypurposes only. Mr. Hayashi said although the Planning Department has not received any letter in support of or in opposition to the request, Mr. Fuke did submit a letter from a Mr. Logan expressing his concern on the drainage in the area. In response to Mr. Alameda€s inquiry, Mr. Hayashi indicated on the presentation map the location of the proposed Mormon Church. The applicant€s representative, Sidney Fuke and Glen Hashimoto, were in attendance. Mr. Fuke said the applicant agrees to the proposed conditions and shared with the Commission an artist€s rendering of the proposed project. He indicated on the presentation map the subject and surrounding properties and noted that applicant is proposing the commercial development in 5 this particular area because the project services a need for the area, referring to the University expansion and the University Terrace project. He added that interest is being generated for a physical therapy office in the area at some point in the future. Specifically relating to Commissioner Siracusa€s inquiry about the balance of the property, Mr. Fuke said the owner felt doing a 24-acre project would be too substantial at this point, not knowing what the market is going to be like. He added that at the time the property was proposed to be zoned RS-7.5 one thought was to possibly have a walkway path meandering along the Alenaio Stream bed. For the Commission€s information, Mr. Fuke explained that they got into this project when there was a lot of controversy surrounding the University Terrace Project and held several informal meetings on their project with some of the major objectors to the Terrace Project and perhaps that is the result of no one being present today to testify on the matter. Mr. Fuke confirmed for Commissioner Watanabe€s information that the State Land Use designationisurbanforthisarea. InresponsetoCommissionerMcCall€sinquiry,Mr.Fukesaidfromhisresearchtheplanforthe sewer is to extend the line from Punahele Street down along Komohana Street to Ponahawai Street. He said as the line would have to be improved from the intersection of Kapiolani and Ponahawai Streets down to Kilauea Avenue possibly the project could dovetail in terms of cost- sharing for the wastewater system. There was no one in the audience wishing to testify on the application. At this time, Mr. Yuen amended Condition N to include final plan approval‚ in the last sentence. It was moved by Commissioner Watanabe and seconded by Commissioner Springer to send a favorable recommendation to the County Council for the reasons and with the conditions recommended by the Planning Director, with Condition N amended to read, To ensure that the Goals and Policies of the Housing Element of the General Plan are implemented, the applicant shall comply with the requirements of Chapter 11, Article 1, Hawai i County Code relating to Affordable Housing Policy. This requirement shall be approved by the Administrator of the Office of Housing and Community Development prior to final plan approval or final subdivision approval for any new residential structures.‚ A roll call vote was taken and motion carried with six ayes (Watanabe, Springer, McCall, Salavea, Siracusa and Alameda) and three absent and excused (Galdones, Graham and Iwashita). REPEAL OF ORD. 487The Commission took up the following at this time, 4:41 p.m., PLANNING DIRECTORwith no one from the public in attendance. PONAHAWAI, SOUTH HILO INITIATOR: PLANNING DIRECTOR Repeal of a 24.495-acre, identified by Tax Map Key: 2-3-36:18, from Change of Zone Ordinance No. 487, which incrementally zoned a 50.988-acre area from an Agricultural 1-acre (A-1a) to a 6 Single Family Residential ƒ 7,500 square foot (RS-7.5) district. The area involved includes the 8-acre areaproposed by Matsuno Enterprises, Ltd. for rezoning from an A-1a to a Neighborhood Commercial ƒ 20,000 square foot (CN-20) district. The property is located along the south side of Ponahawai Street, diagonally across from the Homelani Cemetery, Ponahawai, South Hilo, Hawaii. The Chair stated that the item was deleted from today€s agenda. For Commissioner Siracusa€s information, Mr. Hayashi clarified that the Planning Director will be proposing to repeal Ordinance 487 in its entirety rather than to repeal the 24.495-acre area, adding that all landowners have been notified of the Director€s proposal. He added that this matter is tentatively scheduled on the January 6, 2006 Commission agenda. MINUTESThe Commission took up the following minutes at this time, 4:41 p.m. October 7, 2005 ƒ It was moved by Commissioner Siracusaandseconded by Commissioner McCall that the minutes be approved as circulated. Motion was unanimously carried by a voice vote of all Commissioners in attendance. ADMINISTRATIVEThe Commission took up the following under administrative MATTERSmatters at this time, 4:42 p.m.: Status of appeals filed on Planning Commission decisions - Corporation Counsel ƒ Mr. Torigoe noted he had nothing new to report at this time. Other Commission matters ƒ Mr. Hayashi noted that the Hiluhilu application has been withdrawn th from the December 8 agenda and tentatively scheduled for the January 20, 2006 meeting Kona.
