BOARD OF DIRECTORS WAIMEA, SOUTH KOHALA APPLICANT: PARKER SCHOOL BOARD OF DIRECTORS (USE 05-001) Discussion and action on the Hearing Officersreport on a Use Permit to allow the establishment of an elementary school on 2.635 acres of land zoned Agricultural 1-acre (A-1a) and situated within the State Land Use Urban district. The property is located along the southeast side of Kapiolani Road, approximately 550 feet east of the Kapiolani Road-Lindsey Road intersection, Waimea, South Kohala, Hawaii, TMK: 6-5-4:portion of 25. The property is located between Kuakini Highway and Walua Road, approximately 1,500 feet northwest of the Kuakini st Highway and Walua Road junction, Waiaha 1, North Kona, Hawaii, TMK: 7-5-18:95. (SEE EXHIBIT B) (SSV 05-001)The Commission took this item up at 10:25 a.m. with KAILUA-KONA VILLAGEapproximately 10 people from the public in attendance. DEVELOPMENT GROUP KAILUA VILLAGE KAILUA-KONA APPLICANT: KAILUA KONA VILLAGE DEVELOPMENT GROUP (SSV 05-001) Continuation of a hearing on the application for a Shoreline Setback Variance to allow the construction of an outdoor seating lanai to the existing restaurant proposed within the 40-foot shoreline setback area. The property is the site of the existing Kona Inn Shopping Village, Kailua Village, Kailua-Kona, Hawaii, TMK: 7-5-7:21. Mr. Darrow told the Commission that the applicants representative, Steven Lim, submitted a thst letter dated September 19 requesting a continuance to the October 21 meeting. Mr. Lim explained that they are requesting a continuance for the purpose of discussing with the Planning Director some of his concerns raised in the background and recommendation report. Mr. Lim said that they he hopes to come in with a modified proposal that would satisfy some of the concerns. st Mr. Hayashi said that the initial agenda for the October 21 meeting has already been published but that since there is more than 6 calendar days an addendum can be made to accommodate the applicant. In response to Commissioner Watanabes inquiries, Mr. Lim said that to the extent that the applicant needs to waive the 90-day rule they will do so and Chairperson Springer said the applicantwouldnotcontesttheCommissionnottakingactionwithina90-dayperiodsincethe hearing is being continued at their request. It was moved by Commissioner Salavea and seconded by Commissioner Watanabe that this applicationbecontinuedtotheOctober21,2005meeting.Arollcallvotewastakenandmotion carried with 5 ayes (Salavea, Watanabe, Alameda, Graham, and Springer) and 4 absent and excused(Galdones,McCall,Siracusa,andIwashita). WAIKOLOA VILLAGE, WAIKOLOA, SOUTH KOHALA APPLICANT: EDWIN DELUZ TRUCKING AND GRAVEL, LLC(SP70-85) Request to amend condition number 2 of Special Permit 70-85, which allowed the operation of a quarry on approximately 63,648 acres of land situated within the State Land Use Agricultural District. The property is located approximately 4,600 feet south of Waikoloa Road and 1.3 miles southeast of Waikoloa Village, Waikoloa, South Kohala, Hawaii, TMK: 6-8-2:Portion of 16. (SEE EXHIBIT C) (SMA USE PERMIT NO. 201)The Commission took this item up at 11:15 a.m. with QUEEN LILIUOKALANIapproximately 10 people from the public in attendance. TRUST KEAHUOLU, NORTH KONA APPLICANT: QUEEN LILIUOKALANI TRUST (SMA USE PERMIT NO. 201) Request to amend Special Management Area Use Permit No. 201 by changing the request from a 76-lot Industrial Subdivision to an Industrial-Commercial Mixed Use Subdivision. The request would allow the undeveloped properties to be developed with uses permitted in the Industrial- Commercial Mixed (MCX) district. The area involved is referred to as the €Makalapua Business Center and is located north of the existing Kona Industrial Subdivision and makai of Queen Kaahumanu Highway, Kailua-Kona, Keahuolu, North Kona, Hawaii, TMK: 7-4-8:portion of 2 & 70, and 7-4-25:1-4. Mr.DarroworientedtheCommissionandpublicofthesubjectandsurroundingpropertiesonthe location map and site plan and summarized the request noting that the applicant is requesting the amendmenttoavoidpossibleconflictsinthefuture.Mr.DarrowpointedoutConditionNumber 2 to the Commissioners that the applicant shall comply with all applicable conditions of Change of Zone Ordinance 0165, which was effective August 8, 2001 that had created the zoning that is in place at this time. Mr. Darrow said the Planning Department has not received any written objections or comments from the general public and that the Planning Director is recommending approval of this request. The applicants representative, Sidney Fuke, stated that Mr. Ozaki the Chief Executive Officer had planned on being present for this meeting however was unable to make it due to a last minute shift in things. Mr. Fuke said that Mr. Ozaki did review the recommendation and the staff report and found it to be acceptable. Mr. Fuke explained that the proposed amendment would resolve the potential conflict of some uses being allowed in the MCX zone and not in the ML zone. There was no one from the public wishing to testify on the application. 3 It was moved by Commissioner Watanabe and seconded by Commissioner Alameda that the request to amend Special Management Area Use Permit No. 201 be approved based on the Planning Directors Recommendations and proposed conditions. For the Commissions information, Mr. Darrow clarified that the change of zone ordinance passed on August 8, 2001 listed 14 conditions and those conditions are incorporated in Condition 2 of the proposed amendment to SMA Use Permit No. 201 as it states, €The applicant shall comply with all applicable conditions of Change of Zone Ordinance No. 01-65. A roll call vote was taken and motion carried with 5 ayes (Watanabe, Alameda, Graham, Salavea and Springer) and 4 absent and excused (Galdones, McCall, Siracusa, and Iwashita). GRAVETTapproximately 14 people from the public in attendance. HOLUALOA, NORTH KONA APPLICANT: DARRELYN M. GRAVETT (SPP 05-016) Application for a Special Permit to allow a 2-unit bed and breakfast establishment on 1.291 acres of land situated within the State Land Use Agricultural District. The property is located between the Holualoa Art Gallery and the Kona Imin Center on the mauka (east) side of the Old Government Road, Holualoa, North Kona, Hawaii, TMK: 7-6-3:13. PUUKAPU HOMESTEADS, 4 ND 2 SERIES WAIMEA, SOUTH KOHALA APPLICANTS: YOSHIO INABA, ET AL (REZ 05-003) Application for a Change of Zone for 43.88 acres of land from an Agricultural 40-acre (A-40a) to an Agricultural 5-acre (A-5a) district. The property is located on the north side of Mamalahoa nd Highway, adjacent and west of the Hoonani Subdivision, Puukapu Homesteads, 2 Series, Waimea, South Kohala, Hawaii, TMK: 6-4-17:40. (SEE EXHIBIT F) MINUTESThe Commission took this item up at 4:14 p.m. with approximately 3 people from the public in attendance. August 26, 2005 - It was moved by Commissioner Alameda and seconded by Commissioner Salavea that the minutes be approved as circulated. Motion carried by voice vote of all Commissioners in attendance ADMINISTRATIVE MATTERSThe Commission took this item up at 4:15 p.m. with no one from the public in attendance. Deputy Corporation Council Ivan Torigoe had nothing to report. ANNOUNCEMENTThe Commission took this item up at 4:15 p.m. with no one from the public in attendance. Mr. Hayashi reported on the following items: 1) A reminder that the upcoming HCPO Conference on Kauai on November 2 & 3, 2005. 2) He did request an increase to the Commissioners mileage but that he was told that it has to go through the union. He will keep the Commissioners updated on this request.
