JULY 15, 2005
The Planning Commission met in regular session at 9:07 a.m. in the King Kamehameha's Kona
Beach Hotel, Ekahi Ballroom, 75-5660 Palani Road, Kailua-Kona, Hawaii with Vice-
Chairperson Hannah Springer presiding.

Continuation on the application for a Change of Zone for 25,580 square feet of land from a
Single Family Residential 7,500 square feet (RS-7.5) to a Village Commercial 7,500 square
feet (CV-7.5) district. The property is located along the east (mauka) side of Mamalahoa
Highway and across from Saint Paul Road, approximately 430 feet south of Teshima Restaurant,

Mr. Darrow stated that the Applicants representative sent a request for continuance to the
August or September hearing due to the Applicant being out of state. Therequest was granted
by consensus of all the Commissioners present.

APPLICANT: STATE DEPARTMENT OF LAND AND NATURAL RESOURCES (REZ
05-002)
Application for a Change of Zone from Open (O) to the Industrial-Commercial Mixed one-acre
(MCX-1a) district for approximately 1.32acres of land located approximately 1,200 feet
northwest of the junction between the Kawaihae Road and the Akoni Pule Highway at
Kawaihae, South Kohala, Hawaii, TMK: 6-1-3:15.
Mr. Darrow stated that the Applicants representative sent a request for continuance.
Commissioner Watanabe queried the Planning Director as to the 90-day time deadline to hear
this application before it can go directly to the County Council. Director Yuen stated that the
applicant is within the 90-day period and has stated that theywill come back to the Commission
at least once before going forward to the Council. Mr. Torigoe clarified that under the Rules and
Ordinances basically there is a 90-day time thatsrunning but that time can be extended if agreed
toby the applicant. Chair Springer stated that the correspondence requests for continuance of the
public hearing to the next West Hawai`i Public Hearing tentatively scheduled for August 26,
2005. The request was granted by consensus of all the Commissioners present.

DEBRA DICKENSapproximately 9 people from the public in attendance.

Special Permit to allow the re-establishment
of a neighborhood store (former Morihara Store) on approximately 10,000 square feet of land
situated within the State Land Use Agricultural District. The property is located along the
southeast (mauka) side of Highway 11 and across from the Highway 11 City of Refuge Road
junction, Keokea, South Kona, Hawaii, TMK: 8-4-15: portion of 10.

with no one from the public in attendance.
June 17, 2005-It was moved by Commissioner McCall and seconded by Commissioner
Salavea that the minutes be approved with corrections to Exhibit B, page 11, last sentence of

Graham should read failing that not faring that and Exhibit E, page 14, 3 Graham
paragraph the name Don Farsa should be Ghalan Farsa. Motion was unanimously carried by
a voice vote of all Commissioners in attendance.
ADMINISTRATIVEThe Commission took this item up at 12:55 p.m. with
MATTERSno one from the public in attendance.
Mr. Torigoe reported that there is an oral argument set before Judge Hara on Friday, July 22,
2005 on the Ainaloa Development Company appeal. He stated that this is the appeal where
Ainaloa Development Company asked for relief from some of the exactions that were placed
upon their permit. The hearing is set for 10:00 a.m.
Mr. Graham stated that he attended the Parker School Contested Case Hearing in Waimea. He
said that it was only one day and once the proposed findings of fact is turned over to the
Hearings Officer and she makes her recommendation it should be back in front of the
Commission probably by the September meeting.

no one from the public in attendance.

ADJOURNMENTThere being no further business, the Chairman Pro tem declared
the meeting adjourned at 1:07 p.m.
