PLANNING COMMISSION
COUNTY OF HAWAII
MINUTES
JULY 1, 2005
The Planning Commission met in regular session at 9:00 a.m. in the County Building,
Councilroom - Room 201, 25 Aupuni Street, Hilo, Hawaii, with First Vice-Chairperson Hannah
Springer presiding.

The Chair introduced the Commissioners and staff to members of the public.
All those testifying were duly sworn in.
REZ 05-005The Commission took this item up at 9:03 a.m. with
TIMOTHY DELOZIERapproximately 12 people from the public in attendance.

APPLICANT: TIMOTHY DELOZIER (REZ 05-005)
Change of Zone for 19,500 square feet of land from a Single Family Residential 10,000 square
feet (RS-10) to a Neighborhood Commercial 10,000 square feet (CN-10) district. The property
is located along the west side of Manono Street, approximately 195 feet north of the Manono
st
Street Lanikaula Street intersection, Waiakea Houselots, 1 Series, Waiakea, South Hilo,
Hawaii, Tax Map Key 2-2-27:42.

SPP 05-009The Commission took this item up at 11:15 a.m. with
MELVIN W.approximately 8 people from the public in attendance.

APPLICANT: MELVIN W. MIRANDA, SR. (SPP 05-009)
Special Permit to allow the establishment of a contractors base yard on approximately one acre
of land situated in the State Land Use Agricultural District. The property is located along the
north (makai) side of the Hawaii Belt Highway (Highway 19) at approximately 47.5-mile
marker, Kapoaula, Hamakua, Hawaii, Tax Map Key 4-7-7: portion of 55.
As there were no objections, the Commission took this item out of order.
The applicant, Melvin W. Miranda, Sr., and his representative, Robert S. Rodrigues, were in
attendance.
Mr. Rodrigues explained that since his client received the background report and
recommendation two days ago and brought it for his review last night, he would like to request a
continuance to prepare a response in writing or prepare for an oral presentation. He noted that
North Hawaii, North and South Kohala, Hamakua and Waikoloa are basically agricultural and
ranching communities and the farmers and cattle ranchers there are threatened with foreclosure if
theirprimarywatersupplier,feedcarrierandcattlemoverisnotabletooperate.Headdedthat
the Fire Department relies on volunteer water carriers for range fires, etc. He said Miranda
Trucking, operating 24-7, is the sole water supplier for all of the Kukaiau homes and cattle
ranchers that do not have water.
In response to Commissioner Siracusas inquiry, Mr. Yuen stated that the Planning Department
would be willing to extend the enforcement deadlines for corrective action pending the action of
the Planning Commission, noting it may take a formality of the applicant requesting an extension
of those deadlines.
At Commissioner Grahams behest, Mr. Rodrigues said he will be addressing the Planning
Commissions specific legal requirements in his response to the Planning Directors
recommendation.
It was moved by Commissioner Siracusa and seconded by Commissioner Iwashita that the

hearing be continued to the August 5
meeting to allow Mr. Rodrigues an opportunity respond to
the Planning Departments recommendation. A roll call vote was taken and motion carried with
seven ayes (Siracusa, Iwashita, Alameda, Graham, McCall, Watanabe and Springer) and two
absentandexcused(GaldonesandSalavea).

APPLICANT: DOUGLAS W. KNIGHT (SPP 05-010)
Special Permit to allow the establishmentofan automobile repair establishment on 0.25 acre of
land situated in the State Land Use Agricultural District. The property is located along the south
side of Malama Street, approximately 408 feet east of the Malama Street Kahukai Street
intersection, Leilani Estates Subdivision, Keahialaka, Puna, Hawaii, Tax Map Key 1-3-25:
portion of 41.

MINUTESThe Commission took up the following minutes at this time,
12:18 p.m.
June 3, 2005 It was moved by Commissioner Alameda and seconded by Commissioner
Siracusa that the minutes be approved. Motion was unanimously carried by a voice vote of all
Commissioners in attendance.
ADMINISTRATIVE At 12:20 p.m., the following were discussed under administrative
MATTERSmatters:
Status of appeals filed on Planning Commission decisions - Corporation Counsel -
Mr. Torigoe said he had nothing new to report.
ANNOUNCEMENTSMr. Hayashi notedthe next meeting is scheduled for July 15, 2005
in Kona.
ADJOURNMENTThere being no further business, the Chair declared the meeting
adjourned at 12:22 p.m.
