PRESENT:Hannah Springer ABSENT & EXCUSED: Fred Galdones C. The Chair introduced the Commissioners and staff to members of the public. SPP 04-018The Commission took this item up at 9:15 a.m. with GERALD AND approximately 48 people from the public in attendance. WENDY YAMADA KEAAU, PUNA APPLICANTS: GERALD AND WENDY YAMADA (SPP 04-018) Special Permit to allow the establishment of a commercial retail and office complex (gas station/convenience store, auto repair and sales store, supermarket, financial institution, personal services, restaurant, hardware supply, medical and dental office, other professional services such as real estate, attorney, insurance, etc.) on approximately 3.17 acres of land situated in the State Land Use Agricultural District. THERESA MOYLAN KEAAU, PUNA APPLICANTS: PATRICK AND THERESA MOYLAN (SPP 04-016) Reopening of public hearing to entertain Motion to Rescind Planning CommissionŠs approval action on April 1, 2005on Special Permit to allow the establishment of a cabinet shop on 2 acres of land situated in the State Land Use Agricultural District. Upon approval of the Motion to Rescind, the Planning Commission will then conduct a public hearing on the application. The th property is located at the southern corner of 37 Street and Melia Street, Orchidland Estates Subdivision, Keaau, Puna, Hawaii, TMK: 1-6-8:102. (SEE EXHIBIT B) SPP 04-005The Commission took this item up at 4:29 p.m. with WORLD BOTANICALapproximately 20 people from the public in attendance. GARDENS, INC KAMAEE, NORTH HILO APPLICANT: WORLD BOTANICAL GARDENS, INC. (SPP 04-005) Continued hearing on the request for a Special Permit toallow the construction of a visitor center, parking lot and related improvements on approximately 154,010 square feet (3.53 acres) of land situated within the State Land Use Agricultural District. The site is part of the existing World Botanical Gardens situated on the north side of Leopolino Road between Highway 19 and the Old Mamalahoa Highway, Kamaee, North Hilo, Hawaii, TMK: 3-1-1: portion of 15. (SEEEXHIBITC) RECESSEDTheChaircalledashortrecessat7:58p.m. RECONVENEDThe meeting reconvened at 8:05 p.m. SPP 04-014The Commission took this item up at 8:05 p.m. with CANDEE CORWIN/approximately 5 people from the public in attendance TERESA REYNOSO KAMAILI HOMESTEADS, PUNA APPLICANTS:CANDEECORWIN/TERESAREYNOSO(SPP04-014) Application for a Special Permit to allow the establishment of a 2-bedroom bed and breakfast establishmentandamassagewellnessoperationwithinanexistingsinglefamilydwelling situated on 5.06 acres of land within the State Land Use Agricultural District. The property is 2 located along the north side of Opihikao Road, Kaueleau Farm Lots Subdivision, Kamaili Homesteads, Puna, Hawaii, TMK: 1-3-10:1. (SEE EXHIBIT D) SPP 05-004The Commission took this item up at 8:41 p.m. with CELLCO PARTNERSHIPapproximately 4 people from the public in attendance dba VERIZON WIRELESS KEAAU, PUNA APPLICANT: CELLCO PARTNERSHIP dba VERIZON WIRELESS (SPP 05-004) Special Permit to allow the construction of a new 104-foot high steel monopole telecommunications tower, appurtenant cabinets and equipment shelter, and chain link fence enclosure on approximately 1,100squarefeet of land within the State Land Use Agricultural th District. The property is located along the northeast side of 35 Avenue, approximately 650 feet th from the 35 Avenue  Orchidland Drive intersection, Orchidland Estates Subdivision, Keaau, Puna, Hawaii, TMK: 1-6-10: 48. (SEE EXHIBIT E) BILL NO. 23, DRAFT 2The Commission took this item up at 9:07 p.m. with no one COUNTY COUNCILfrom the public in attendance CHAPTER 14, HAWAII COUNTY CODE INITIATOR: COUNTY COUNCIL (Bill No. 23, Draft 2) Draft Bill amending Chapter 14, Hawaii County Code, by adding a new article to provide enhanced public notice of proposed development. Mr. Hayashi explained that after this bill was transmitted to the Commission by the County Council, Council Member Bob Jacobson transmitted a Draft 3. He then explained that the intent was to provide enhanced public notice of all proposed developments, including those relating to the Zoning Code, Subdivision Code, SMA Use Permits, Use Permits, and Special Permits. He said the Department has scheduled this item on the Planning Commission€s May 20, 2005 agenda, at which time Planning Department will come up with its position on this particular bill. In response to Commissioner Siracusa€s inquiries, Mr. Hayashi explained that Section 14-101(a)(5)regardinggradingorgrubbingpermitswasdeletedinDraft3andthatalthough Draft 2 was advertised for this and the subsequent Planning Commission meetings, the CommissioncouldstartoffwithDraft2andthendiscussDraft3. CommissionerSiracusaurgedtheretentionofSection14-101(a)(5)becausesomuchdamagecan occur when grading or grubbing is done, noting things are not always on the record but the peopleinthecommunitymayknowaboutendangeredspecies,historicsites,etc.inthearea.She recalled an instance where a project was stopped at the entrance to the Black Sand Subdivision becausealthoughHistoricPreservationDivisionwasunawareofit,someoneknewtherewere historic sites in the area, and a Mark Smith investigated the area and found some burials. 3 In response to the Chair€s inquiry, Mr. Yuen said that it was up to the Commission whether or not to recommend inclusion of Section 14-101(a)(5) to the County Council,noting the Council is the ultimate decision-making body in this matter. MINUTESAt 9:14 a.m., the Commission took up the following minutes: January 21, 2005 It was moved by Commissioner Alameda and seconded by Commissioner Salavea that the minutes be approved as circulated. Motion was unanimously carried by a voice vote of all Commissioners in attendance. April 1, 2005- The Commission deferred approval of the minutesto a subsequent meeting. ADMINISTRATIVEThe Commission took up the following under administrative MATTERSmatters at this time, 9:15 a.m. Status of appeals filed on Planning Commission decisions - Corporation Counsel  Mr. Torigoe said he had nothing new to report. Other Commission matters  Mr. Hayashi reported thatParker School Trust Corporation has withdrawn their Use permit application (USE 04-006); Sherry Broder will be the hearings officer for the Parker School Board of Director€s Use Permit application (USE 05-001); and Tom Yeh will be the hearings officer for John and Jean Vurick€s Special Permit application (SPP 04-017). He added that the next meeting is scheduled for May 20, 2005 at the King Kamehameha Kona Beach Hotel.
