The Commissioners were handed some last minute documents to review. Therefore I will call for a 10 to 15 minute recess so that they can have time to go over this new material. HUGGETT KAHULUI, NORTH KONA APPLICANT: WESLEY AND KELLEY HUGGETT (Formerly ERIC SOTO SMA 03-007) Continued hearing on a Special Management Area Use Permit application to allow the construction of a three and one-half story, 45-foot high, 12-unit multi-family residential development and related improvements on approximately 15,203 square feet of land. The property is located on the west (makai) side of Alii Drive, adjacent to and north of the Sea Village Condominium complex, Kahului,North Kona, Hawaii, TMK: 7-5-19:30. INVESTMENT CORPORATION st KAHALUU & KEAUHOU 1, NORTH KONA KAMEHAMEHA INVESTMENT CORPORATION (SMA 05-002) Special Management Area Use Permit application to allow the development of a 16-unit multiple family residential complex and related improvements. The property is located on the east side of Kamehameha III Road, immediately adjacent to and south (makai) of the Keauhou st Rehabilitation and Healthcare Center, Kahaluu and Keauhou 1, North Kona, Hawaii TMK: 7-8- 10:90. There was no one from the public wishing to testify on this agenda item. It was moved by Commissioner Springer and seconded by Commissioner Alameda that this agenda item be continued to the June meeting. A roll call vote was taken and motion carried with five ayes (Springer, Alameda, Graham, Iwashita and Galdones) and four absent and excused (McCall, Watanabe, Salavea, and Siracusa). RECESSED:The Chair called a short recess at 2:27 p.m. RECONVENED:The meeting reconvened at 2:35 p.m. (SPP 05-002)The Commission took this item up at 2:35 p.m. with INNOVATIONS PUBLIC approximately 60 people from the public in attendance. CHARTERS SCHOOL/ IPCS FOUNDATION RD PUAA 3, NORTH KONA INNOVATIONS PUBLIC CHARTERS SCHOOL/IPCS FOUNDATION (SPP 05-002) Special Permit application to allow the establishment of a public charter school (elementary school - grades 1 to 6), including limited before and after school care program, and related facilities on 5 acres of land situated within the State Land Use Agricultural District. The area involved is located along the east (mauka) side of Queen Kaahumanu Highway, approximately rd 1,500 feet north of the Queen Kaahumanu Highway € Hualalai Road intersection, Puaa 3, North Kona, Hawaii, TMK: 7-5-10: portion of 1. (SEE EXHIBIT D) AMENDMENT TOThe Commission took this item up at 5:22 p.m. with CHAPTER 25approximately 5 people from the public in attendance PLANNING DIRECTOR AGRICULTURAL TOURISM INITIATOR: PLANNINGDIRECTOR Continued hearing on the amendment to Chapter 25 (Zoning Code) of the Hawaii County Code relating to Agricultural Tourism. The purpose of the draft bill is to specifically address the permissibilityofagriculturaltourismoritsimpactsinthevariouszoningdistricts. (SEEEXHIBITE) MINUTESTheCommissiontookupthefollowingitemsat6:35p.m. 3 February 18, 2005 -It was moved by Commissioner Alameda, and seconded by Commissioner Springer that the minutes be accepted and placed in file. Motion was unanimously carried by a voice vote of all Commissioners in attendance. March 18, 2005 -It was moved by Commissioner Springer and seconded by Commissioner Alameda that the minutes be deferred to the next meeting so that the Commissioners have the opportunity to review them. Motion was unanimously carried by a voice vote of all Commissioners in attendance. ADMINISTRATIVE The following was discussed under administrative matters: MATTERS Status of appeals filed on Planning Commission decisions € Corporation Counsel € Mr. Torigoe reported that the Yokoyama vs. Doutors Supreme Court Appeal has been dismissed. Commissioner Springer queried regarding how the Blasmans case should be treated € in relation to Doutor and some of the other ones that are in appeal, Blasman is not. Director Yuen responded stating that its simply pendingby consent of the parties and there is a very strong and live acquisition effort that cinched a happening. Commissioner Springer then asked if the panel of hearings officers will reconvened? Director Yuen stated that if the acquisition happens then the application will be dropped and the panel will be dismissed. Commissioner Graham asked for a status on the Parker School application. Mr. Hayashi said that Sherry Broder an attorney from Oahu is the Hearing Officer handling both of the Parker School applications. He also stated that for the Vurick application, Mr. Thomas Yeh who is an attorney in Hilo who will hear that case for the Commission. He stated that once the contract is final they will proceed. ANNOUNCEMENT The next meeting will be on Thursday, May 12, 2005. The Kona meeting is on May 20, 2005.
