The County of Hawaii Planning Commission met in regular session at 9:07 a.m. in

GALDONES:This meeting of the Hawaii County Planning Commission will come to
order. The Commissioners were handed some last minute documents to review. Therefore I will
call for a 10 to 15 minute recess so that they can have time to go over this new material.

Mr. Hayashi stated that the applicants representative has requested a continuance of the hearing
inasmuch as the applicant is not feeling well and is unable to make todays meeting.
There was no one from the public wishing to testify on this agenda item.
It was moved by Commissioner Springer and seconded by Commissioner Alameda that this
agenda item be continued to the June meeting. A roll call vote was taken and motion carried
with five ayes (Springer, Alameda, Graham, Iwashita and Galdones) and four absent and excused
(McCall, Watanabe, Salavea, and Siracusa).

Special Permit application to allow the establishment of a public charter school (elementary
school - grades 1 to 6), including limited before and after school care program, and related
facilities on 5 acres of land situated within the State Land Use Agricultural District. The area
involved is located along the east (mauka) side of Queen Kaahumanu Highway, approximately

PLANNING DIRECTOR
AGRICULTURAL TOURISM
INITIATOR: PLANNINGDIRECTOR
Continued hearing on the amendment to Chapter 25 (Zoning Code) of the Hawaii County Code
relating to Agricultural Tourism. The purpose of the draft bill is to specifically address the
permissibilityofagriculturaltourismoritsimpactsinthevariouszoningdistricts.

February 18, 2005 -It was moved by Commissioner Alameda, and seconded by Commissioner
Springer that the minutes be accepted and placed in file. Motion was unanimously carried by a
voice vote of all Commissioners in attendance.
March 18, 2005 -It was moved by Commissioner Springer and seconded by Commissioner
Alameda that the minutes be deferred to the next meeting so that the Commissioners have the
opportunity to review them. Motion was unanimously carried by a voice vote of all
Commissioners in attendance.
ADMINISTRATIVE The following was discussed under administrative matters:
MATTERS
Status of appeals filed on Planning Commission decisions Corporation Counsel Mr. Torigoe
reported that the Yokoyama vs. Doutors Supreme Court Appeal has been dismissed.
Commissioner Springer queried regarding how the Blasmans case should be treated in relation
to Doutor and some of the other ones that are in appeal, Blasman is not.
Director Yuen responded stating that its simply pendingby consent of the parties and there is a
very strong and live acquisition effort that cinched a happening.
Commissioner Springer then asked if the panel of hearings officers will reconvened?
Director Yuen stated that if the acquisition happens then the application will be dropped and the
panel will be dismissed.
Commissioner Graham asked for a status on the Parker School application. Mr. Hayashi said
that Sherry Broder an attorney from Oahu is the Hearing Officer handling both of the Parker
School applications. He also stated that for the Vurick application, Mr. Thomas Yeh who is an
attorney in Hilo who will hear that case for the Commission. He stated that once the contract is
final they will proceed.
ANNOUNCEMENT
The next meeting will be on Thursday, May 12, 2005. The Kona meeting is on May 20, 2005.
ADJOURNMENTThere being no further business, the Chair declared the meeting
adjourned at 6:45 p.m.
