The Chair called a recess so that the Commissioners would review last minute communication theyreceived. WAIKOLOA, SOUTH KOHALA APPLICANT: WDCPROPERTIES, LLC (SPECIAL PERMIT NO. 538) Amendment to Condition 4 (extend life of permit for 10 additional years) of Special Permit No. 538, which allowed the establishment of a heliport and related improvements on 9.8 acres of land within the State Land Use Agricultural District. The area involved is the existing heliport located at the Queen Kaahumanu Highway  Waikoloa Road junction, Waikoloa, South Kohala, Hawaii, TMK: 6-8-1: portion of 43. (SEE EXHIBIT D) SPECIAL PERMIT 538The Board took this item up at 10:52 a.m. with WAIKOLOA approximately 14 people from the public in attendance. DEVELOPMENT CO. WAIKOLOA, SOUTH KOHALA APPLICANT: WAIKOLOA DEVELOPMENT CO. (ORDINANCE NO. 95-51) Request for a 10-year time extension to Condition B (time to secure Final Subdivision Approval) of Change of Zone Ordinance No. 95-51 that rezoned approximately 761 acres of land from Unplanned (U) and Multiple Family Residential  1,500 square feet (RM-1.5) districts to Open (O) and Residential and Agricultural 1-acre (RA-1a) districts. The property, referred to as the proposed Waikoloa Highlands Subdivision and Golf Course, is located along the south side of Waikoloa Road and south  southeast of Waikoloa Village, Waikoloa, South Kohala, Hawaii, TMK: 6-8-2: portion of 16 and 6-8-3: portion of 32. (SEE EXHIBIT E) SPP 04-003The Commission took this item up at 12:00 p.m. with CELLCO PARTNERSHIP with approximately 6 people from the public in attendance. dba VERIZON WIRELESS LALAMILO,WAIMEA SOUTHKOHALA APPLICANT:CELLCOPARTINERSHIPdbaVERIZONWIRELESS(SPP04-003) SpecialPermitapplicationtoallowtheretentionofanexisting110-foothightelecommunication towerfacility,includingtheconstructionofanemergencygenerator,on405squarefeetofland withintheStateLandUseAgriculturalDistrict.TheareainvolvedisaportionoftheWatanabe -3- Floral, Inc. property along the south side of Lalamilo Farm Road, approximately 770 feet west of the Lalamilo Farm Road-Mamalahoa Highway intersection, Lalamilo Farm Lots, Lalamilo, Waimea, South Kohala, Hawaii, TMK: 6-6-5: portion of 2. Mr. Hayashi oriented the Commissioners and the public of the subject and surrounding properties on the location map and site plan. He stated that there were no objections by the surrounding property owners or from the general public on the application. He also stated that the Planning Director is recommending approval with conditions. The applicant€s representative, Danette Mettler, received the background report and recommendation from the County and had no comments to offer. The Commissioners had no questions for Ms. Mettler. There was no one from the public wishing to testify on this agenda item. The Chair stated that the Planning Director recommends approval of the application. It was moved by Commissioner Fujikawa and seconded by Commissioner Smith to approve the special permit application with conditions as recommended by the Planning Director. A roll call vote was taken and motion carried with seven ayes (Fujikawa, Smith, Springer, Alameda, Graham, McCall and Galdones) and one absent and excused (Siracusa). SPP 05-001The Commission took this item up at 12:07 p.m. with HANS AND MARSHA with approximately 7 people from the public in attendance. ECKERT RD KALAOA 3, NORTH KONA APPLICANTS: HANS AND MARSHA ECKERT (SPP 05-001) Special Permit application to allow the establishment of a 3-bedroom bed and breakfast establishment within an existing single family dwelling situated on 7.8 acres of land within the State Land Use Agricultural District. The area under consideration is located approximately 1,500 feet east (mauka) of the Hawaii Belt Road (Highway 190), across from the Kona rd Coastview Subdivision, Kalaoa 3, North Kona, Hawaii, TMK: 7-3-2:2 Mr. Darrow oriented the Commissioners and the public of the subject and surrounding properties on the location map. He noted that a late transmittal was received by a Carlos Mahi Manuel and that was distributed to the Commissioners. Hestated that the Planning Director is recommending approval of the application. CommissionerGrahamqueriedKiranEmlerfromtheDepartmentofPublicWorksregardingthe ingressandegressofthehighway.Mr.Emlerstatedthathedidnotlookatthedriveway -4- approach in this case because it enters onto a State highway, therefore this application was deferred to the Department of Transportation. There were no other questions from the Commission. The applicants, Hans and Marsha Eckert, received the background report and recommendations from County and had two comments. The first comment referred to the open building permit which he stated were Ag buildings that they are currently constructing and not related to this application. The second comment referred to an open electrical permit which has been resolved. Mr. Darrow confirmed the applicant€s statements. Commissioner Fujikawa asked the applicants how close their closest neighbor was. Mr. Eckert responded that his closest neighbor lives approximately 1400 - 1500 feet away from his home on the west side, on the east side approximately 600 - 700 feet away, on the north and south side there is undeveloped land. There were no further questions from the Commission. There was no one from the Public to testify on this agenda item. The Chair stated that the Director is recommending approval of this item. It was moved by Commissioner Alameda and seconded by Commissioner Fujikawa to approve the application. A roll call vote was taken and motion carried with seven ayes (Alameda, Fujikawa, Graham, McCall, Smith, Springer, and Galdones) and one absent and excused (Siracusa). SMA 05-001The Commission took this item up at 12:16 p.m. with NEXT DESIGN, LLC approximately 19 people from the public in attendance. KAILUA-KONA, NORTH KONA APPLICANT: NEXT DESIGN, LLC(SMA 05-001) Special Management Area Use Permit application to allow the establishment of a restaurant (Kentucky Fried Chicken) on 18,997 square feet of land. The property is the former Chevron service station site located at the northwestern corner of the Palani Road  Kuakini Highway intersection, Kailua-Kona, North Kona, Hawaii, TMK: 7-5-5:61. WAIMEA, SOUTH KOHALA APPLICANT: PARKER SCHOOL TRUST CORPORATION (USE 04-006) Use Permit application to allow the establishment of an Educational Center, including a pre- school, on 62,000 square feet of land zoned Agricultural 1-acre (A-1a) within the State Land Use Urban District. The property is located along the southeast side of Kapiolani Road, approximately 1,700 feet east of the Kapiolani Road-Lindsey Road intersection, Waimea, South Kohala, Hawaii, TMK: 6-5-4: portion of 25. (SEE EXHIBIT G) USE 05-001The Commission took this item up at 3:07 p.m. with PARKER SCHOOL approximately 15 people from the public in BOARD OF DIRECTORSattendance. WAIMEA, SOUTH KOHALA APPLICANT: PARKER SCHOOL BOARD OF DIRECTORS (USE 05-001) Use Permit application to allow the establishment of an elementaryschool (K to 5) on a 2.635- acre area zoned Agricultural 1-acre (A-1a) within the State Land Use Urban District. The property is located along the southeast side of Kapiolani Road, approximately 550 feet east of the Kapiolani Road-Lindsey Road intersection, Waimea, South Kohala, Hawaii, TMK: 6-5-4: portion of 25. (SEE EXHIBIT H) MINUTESThe Commission took up the following minutes at 3:56 p.m. February 18, 2005 -The Commission deferred approval of the minutes to a future meeting. Mr. Hayashi also stated that we appreciate Commissioners Smith and Fujikawa€s service to this community and wished them well. He thanked them for working with the Staff. Chair Galdones also stated that he appreciated their attendance and dedication.
