JUNE 18, 2004
The Planning Commission met in regular session at 9:00 a.m. in the King Kamehameha's Kona
Beach Hotel, Kamakahonu Ballroom, 75-5660 Palani Road, Kailua-Kona, Hawai i, with First
Vice-Chairman Earl Fujikawa presiding.

MINUTESThe Commission took up the following minutes at
1:28 p.m.
May 28, 2004 - It was moved by Commissioner McCall and seconded by Commissioner
Springer that the minutes be approved as circulated with a correction to Exhibit A,
page 27, second paragraph changing ALAMED TO ALAMEDA. Motion was unanimously
carried by a voice vote of all Commissioners in attendance.
ADMINISTRATIVEThe following were discussed under administrative
MATTERSmatters:
Contested Case Hearings Mr. Hayashi reported on the following contested case hearings,
noting all the hearings officers have been appointed with the exception of the Spectrasite
Communication, Inc.s special permit application: Colin Love, Esq. is the hearing officer for
Ainaloa Developments amendment to Special Permit 827 with the contested case to be held on
th
July 29; Sherry Broder, Esq. is the hearing officer for Puulani Ranch Corp.s amendment to
Special Permit 626 with a prehearing conference to be conducted next week; Tom Yeh, Esq. is
the hearing officer for Michael and Misato Mortaras.special permit application with a
prehearing conference to be conducted shortly; Sandra Song, Esq. is the hearing officer for SCD
Kahakai LLCs amendment to SMA Use Permit 304; and Sandra Song, Esq. is the hearing
officer for Rod Immings SMA Use Permit application.
Phase III. Native Hawaiian Access Rights Project/Recommendations for SMA Rules and
Process Upon Commissioner Springers request, Mr. Yuen stated that a copy will be provided
to the Commission to provide them with an insight into the issues raised, even if the
recommendations may not be feasible for the County to adopt.
Status of appeals filed on Planning Commission decisions Ms. OToole reported on Dean
Yokoyamas Circuit Court appeal of Doutor Coffees Special Permit 1215, noting the Countys
brief is due in the middle of July and the argument will be before the end of July in Judge
Ibarras court. She added that the Supreme Courts briefs in the Geigers appeal of Betty Chins
(Fire Mountain) Special Permit 1185 have been filed and is pending in Court.
