LALAMILO, SOUTH KOHALA APPLICANT: MARK FABYONIC (SMA 04-005) Special Management Area Use Permit to allow the development of a 26-unit residential project with related recreational improvements. The property is located along the mauka side of Puako Beach Drive, immediately east of the Puako Beach Condominium complex, Lalamilo, South Kohala, Hawaii, TMK: 6-9-2:23 and 27. The property is located along the east (maukaside)ofQueenKaahumanuHighway(StateHighway19),adjacenttoandsouthofthe 2 stnd Kaloko Industrial Subdivision, Honokohau 1 and 2, North Kona, Hawaii, TMK: 7-4-8: portion of 13 and 30. The Chair stated that this item has been cancelled from today€s agenda. MINUTESThe Commission took up the following minutes at 1:28 p.m. May 28, 2004 - It was moved by Commissioner McCall and seconded by Commissioner Springer that the minutes be approved as circulated with a correction to Exhibit A, page 27, second paragraph changing ALAMED‚ TO ALAMEDA. Motion was unanimously carried by a voice vote of all Commissioners in attendance. ADMINISTRATIVEThe following were discussed under administrative MATTERSmatters: Contested Case Hearings ƒ Mr. Hayashi reported on the following contested case hearings, noting all the hearings officers have been appointed with the exception of the Spectrasite Communication, Inc.€s special permit application: Colin Love, Esq. is the hearing officer for Ainaloa Development€s amendment to Special Permit 827 with the contested case to be held on th July 29; Sherry Broder, Esq. is the hearing officer for Puulani Ranch Corp.€s amendment to Special Permit 626 with a prehearing conference to be conducted next week; Tom Yeh, Esq. is the hearing officer for Michael and Misato Mortara€s.special permit application with a prehearing conference to be conducted shortly; Sandra Song, Esq. is the hearing officer for SCD Kahakai LLC€s amendment to SMA Use Permit 304; and Sandra Song, Esq. is the hearing officer for Rod Imming€s SMA Use Permit application. Phase III. Native Hawaiian Access Rights Project/Recommendations for SMA Rules and Process ƒ Upon Commissioner Springer€s request, Mr. Yuen stated that a copy will be provided to the Commission to provide them with an insight into the issues raised, even if the recommendations may not be feasible for the County to adopt. Status of appeals filed on Planning Commission decisions ƒ Ms. O€Toole reported on Dean Yokoyama€s Circuit Court appeal of Doutor Coffee€s Special Permit 1215, noting the County€s brief is due in the middle of July and the argument will be before the end of July in Judge Ibarra€s court. She added that the Supreme Court€s briefs in the Geiger€s appeal of Betty Chin€s (Fire Mountain) Special Permit 1185 have been filed and is pending in Court.
