HomeMy WebLinkAbout2004-04-23 Planning Commission Minutes PLANNING COMMISSION COUNTY OF HAWAI‘I MINUTES APRIL 23, 2004 The Planning Commission met in regular session at 9:03 a.m. in the Ohana Keauhou Beach Resort, Kahaluu Ballroom, 78-6740 Alii Drive, Keauhou, North Kona, Hawai`i, with Chairman Fred Galdones presiding. PRESENT:Fred Galdones C. Kimo Alameda Earl Fujikawa Bill Graham Jeffrey McCall Francis Smith Hannah Springer Bill Thibadeau Patricia O’Toole, Deputy Corporation Counsel Christopher J. Yuen, Planning Director Norman Hayashi, Planning Program Manager Phyllis Fujimoto, Staff Planner Jeff Darrow, Staff Planner The Chair introduced the Commissioners and staff to members of the public. USE 04-002The Commission took this item up at 9:05 a.m. with SHAWN NAKAKURA approximately 15 people from the public in attendance. AND SAM LEE KOHANAIKI, NORTH KONA APPLICANTS: SHAWN NAKAKURA AND SAM LEE (USE 04-002) Use Permit to allow the operation of a cremation business within portion of a warehouse building situated within the Limited Industrial 1-acre (ML-1a) district. The property is located along the north side of Hulikoa Drive within the Kohanaiki Business Park Subdivision which is situated along the east side of Queen Kaahumanu Highway (Highway 19), Kohanaiki, North Kona, Hawaii, TMK: 7-3-58:28. (SEE EXHIBIT A) 1 KSV 04-002 The Commission took this item up at 9:33 a.m. with OCEAN'S SPORTS approximately 12 people from the public in attendance. BAR AND GRILL ND AUHAUKEAE 2, NORTH KONA APPLICANT: OCEAN'S SPORTS BAR AND GRILL (KSV 04-002) Sign Variance to allow deviations from the requirements of Chapter 3 (Advertising and signs), Article 2 (Kailua Village Signs), Section 3-72 (Sign and lettering size) and Section 3-74 (Sign height) of the Hawaii County Code, as amended. The property is located within the Coconut Grove Marketplace between Alii Drive and Kuakini nd Highway, Auhaukeae 2, North Kona, Hawaii, TMK: 7-5-9: 25. (SEE EXHIBIT B) KSV 04-001The Commission took this item up at 9:50 a.m. with CENTURY 21 ALL approximately 12 people from the public in attendance. ISLANDS PLAZA ST HIENALOLI 1, KAILUA-KONA APPLICANT: CENTURY 21 ALL ISLANDS PLAZA (KSV 04-001) Sign Variance to allow deviations from the requirements of Chapter 3 (Advertising and signs), Article 2 (Kailua Village Signs), Division 1, Sections 3-73 (Number of signs) and 3-74 (Sign height), Hawaii County Code, as amended. Specific deviations would apply to the number of signs and sign height. The property is located on the southeast corner of Kuakini Highway and Hualalai Road and consists of the existing Village Professional st Plaza building, Hienaloli 1, Kailua-Kona, North Kona, Hawaii, TMK: 7-5-8:15. (SEE EXHIBIT C) RECESSEDThe Chair called a short recess at 10:05 a.m. RECONVENEDThe meeting reconvened at 10:17 a.m. SMA NO. 288The Commission took this item up at 10:17 a.m. with FLORA approximately 12 people from the public in attendance. BEAMER SOLOMON NIULII, NORTH KOHALA APPLICANT: FLORA BEAMER SOLOMON (SMA NO. 288) Request to amend Special Management Area Use Permit No. 288 by allowing the construction of 3 single family dwellings (two 2-bedroom dwellings and a 1-bedroom 2 dwelling) to be used for a bed and breakfast operation. The initial approval allowed the construction of a 3-unit apartment building. The property is located along the south side of Keokea Park Road, approximately 1,500 feet from the Keokea Park Road – Akoni Pule Highway intersection, Niulii, North Kohala, Hawaii, TMK: 5-2-12:14. (SEE EXHIBIT D) MINUTESThe Commission took up the following minutes at this time, 11:18 a.m. March 19, 2004 – It was moved by Commissioner Springer and seconded by Commissioner McCall that the minutes be approved as circulated with a correction on th Exhibit A, page 7, sixth paragraph, 8 line, changing “in-field” to “infill.” Motion was unanimously carried by a voice vote of all Commissioners in attendance. ADMINISTRATIVEThe Commission took up the following matters at this time, MATTERS10:21 a.m. Status of appeals filed on Planning Commission decisions – Corporation Counsel – Ms. O’Toole noted that the appellants for the Geiger appeal have filed their briefs in the Supreme Court and the Commission’s and the Director’s briefs are due shortly. Other Commission matters – Mr. Hayashi reported that the Planning Department has established new procedures in the selection of hearings officers because of procedural problems, noting the Deputy Planning Director who is the appointing authority designated by the Planning Director cannot be part of the selection committee. He said the Selection Committee will consist of the Board of Appeals Chair or designee, the Planning Commission Chair or designee, Alice Kawaha who is staff to the Board of Appeals, and Norman Hayashi who is staff to the Planning Commission. He said the selection committee will be establishing a list of hearings officers to be used on a rotational basis. The Chair stated for the record that if he cannot attend the Hearings Officers Selection Committee’s meeting, the first vice-chair of the Commission will be his designee, and if the first vice-chair is unable to attend then the second vice-chair. Upon Commissioner Springer’s inquiry, Mr. Hayashi said although the funds for the hiring of hearings officers are currently running low there are sufficient funds for the contested cases currently before the Commission, and he added that the Planning Department will be budgeting “x” amount of money for the next fiscal year hearings officers. ADJOURNMENTThere being no further business, at 11:22 a.m., it was moved by Commissioner Springer and seconded by 3 Commissioner Fujikawa that the meeting be adjourned.
