PLANNING COMMISSION

MINUTES
MARCH 19, 2004
The Planning Commission met in regular session at 9:00 a.m. in the King Kamehameha's
Kona Beach Hotel, Kamakahonu Ballroom, 75-5660 Palani Road, Kail
with First Vice-Chairman Earl Fujikawa presiding.

APPLICANT: MITCHELL THOMPSON (REZ 770)
Request for a 3-year time extension to Condition C (time to secure final subdivision
approval) of Change of Zone Ordinance No. 94-99, which rezoned 7 acres of land from
an Agricultural 20-acre (A-20a) to an Agricultural 3-acre (A-3a) district. The property is
located along the west side of Hawi Road, approximately 1,700 feet north of the Hawi
Road Î Kohala Mountain Road (Highway 250) Î Kynnersley Road junc

Mr. Darrow oriented the Commission and public of the subject and surrounding
properties on the location map and site plan, summarized the request, and noted the
Planning DirectorÓs favorable recommendation.
The new owner of the property/applicant, Mitchell Thompson, and his representatives,
Sidney Fuke, were in attendance.

Mr. Fuke stated that the applicant has no objections to the staffÓs background report and
recommendation.
Commissioner Graham questioned if there was any way of knowing for sure if the
previous owner of the property (Wilfred Kita) was really at fault for the condition not
being complied with. Mr. Yuen said he did not think the sale of a property has anything
to do with not complying with the conditions, and the conditions and the expectations go
with the land; therefore, whether itÓs Mr. Kita or Mr. Thompson the standard for getting
the time extension would be the same. Mr. Yuen said his understanding of what
happened in this case is that water stopped being available for new subdivisions in North
Kohala, and he said that it is now up to Mr. Thompson to show that during this time
period there was a problem with fulfilling the conditions of final subdivision approval,
which the Planning Department feels he has so demonstrated.
Mr. Fuke added that the Planning DirectorÓs ability to granting or deny the time extension
has been exhausted, which is why they are coming in for a time extension that would not
necessarily be along the lines of the criteria that was established for the Planning
Director. He also added the applicant has already paid for his water commitment fee in
the amount of $1,050, so now it is a question of time when he would be able to
consummate the subdivision, noting he thought the applicant wanted to have the
subdivision sooner than later.
Commissioner Graham, resident of the nearby area, said he did not think the land use was
a real issue because it is along the Hawi Hill Road area where t
properties with similar size. He said the most consequential local issue would be access
onto Hawi Hill Road; however, given the plan of the additional lot taking access off the
Beers Road extension, it does not seem like there would be a saf
It was moved by Commissioner Graham and seconded by Commissioner Springer to send
a favorable recommendation to the County Council based on and incorporating the
Planning DirectorÓs recommendation. A roll call vote was taken and motion carried with
five ayes (Graham, Springer, McCall, Smith, and Fujkawa) and three absent and excused
(Galdones, Mina and Thibadeau).

10:02 a.m.
March 5, 2004 Î It was moved by Commissioner Springer and second
Commissioner McCall that the minutes be approved as circulated. Motion was
unanimously carried by a voice vote of all Commissioners in attendance.

Blasman Contested Case Hearing Î In response to Commissioner SpringerÓs inquiry,
Mr. Yuen explained that the applicant has agreed to suspend further hearings for the time
being.
Planning Commission Meeting Î In response to the ChairÓs inquiry, Mr. Hayashi noted
the next meeting is scheduled for April 2, 2004 in the County Councilroom in Hilo.
