COAST, LLC ND OOMA 2, NORTH KONA APPLICANT: CLIFTO'S KONA COAST, LLC (SMA 03-005) Request for reconsideration on the action taken on the application for a Special Management Area Use Permit to allow the development of a commercial Î resid offices, retail uses, multi-family housing, facilities for transient accommodations, and related improvements. The property is located along the west (makai) side of Queen Kaahumanu Highway (State Highway 19), approximately 2,100 feet south of the Queen Kaahumanu nd Highway Î NELHA Access Road, Ooma 2, North Kona, Hawaii, TMK: 7-3-9:22. (SEE EXHIBIT A) 1 RECESSEDThe Chair called a short recess at 10:55 a.m. RECONVENEDThe Chair reconvened the meeting at 11:05 a.m. SMA 03-014The Commission took this item up at 11:05 a.m. with PAUL BLECK, A.I.A.approximately 22 people from the public in attendance. WAIAHA, NORTH KONA APPLICANT: PAUL BLECK, A.I.A. (SMA 03-014) Special Management Area Use Permit to allow the development of a two-story office building and related improvements. The property is located between Walua Road and Kuakini Highway, approximately 350 feet northwest of the Walua Road Î Lunapule Road junction, Waiaha, North Kona, Hawaii, TMK: 7-5-18:7. Mr. Hayashi oriented the Commission and public of the subject and surrounding properties on the location map and site plan, summarized the request, and noted the Planning Director recommended approval of the application with conditions. For Mr. FujikawaÓs information, Mr. Fuke noted access to the property would be from Walua Road. In response to Commissioner SpringerÓs inquiry, Mr. Emler said he believed the issue of adequate sight distance was addressed in the subdivision review and grading processes, although the Department of Public Works did not actually survey the area. Commissioner Kubota said she would hope that the Department of Public Works would make sure adequate sight distance is complied with and not just leave it up to an applicant. The applicant, Paul Bleck, stated he did receive the Planning DepartmentÓs Background Report and Recommendation and had no objections to the proposed conditions of approval. In response to Commissioner FujikawaÓs inquiry, Mr. Bleck stated the building pad is in place and it was approved by the County. There was no one from the public wishing to testify on this agen It was moved by Commissioner Fujikawa and seconded by Commissioner Springer that the public hearing be closed. Motion was unanimously carried by a voice vote of all Commissioners in attendance. It was moved by Commissioner Fujikawa and seconded by Commissioner Smith that the application be approved based on and incorporating the Planning DirectorÓs recommendation. A roll call vote was taken and motion carried with eight ayes (Fujikawa, Smith, Springer, Thibadeau, Kubota, McCall, Mina and Galdones) and one absent and excused (Graham). 2 REZ 03-025/SMA 03-015The Commission took this item up at 11:16 a.m. with LEHUA LANI, LLCapproximately 22 people from the public in attend ND PUAPUAA 2, NORTH KONA APPLICANT: LEHUA LANI, LLC (REZ 03-025/SMA 03-015) a.Change of Zone for 10.1 acres from an Agricultural 5-acre (A-5a) to a Single Family Residential Î 7,500 square foot (RS-7.5) district. b.Special Management Area Use Permit to allow the development of a 58-unit single family residential house and lot subdivision and related improvements. The property is located along the east (mauka) side of Alii Drive, between the Alii Lani Condominium and the Alli Garden Marketplace and across from the nd Riviera Villas condominium complexes, Puapuaa 2, North Kona, Hawaii, TMK: 7-5-20:71 & 72. (SEE EXHIBIT B) RECESSEDThe Chair called a recess at 12:01 p.m. RECONVENEDThe Chair reconvened the meeting at 1:30 p.m. SPP NO. 626The Commission took this item up at 1:30 p.m. with PUU LANI RANCHapproximately 20 people from the public in attendance. CORPORATION PUUANAHULU HOMESTEADS, NORTH KONA APPLICANT: PUU LANI RANCH CORPORATION (SPP NO. 626) Request for a two-year time extension to Condition No. 4 (termination date of Special Permit), which allowed the establishment of a temporary on-site real estate sales office on approximately 0.25 acre situated within the State Land Use Agricultural District. The property is within the Puu Lani Ranch Subdivision located on the mauka side of Highway 190 and the Big Island Country Club Golf Course, Puuanahulu Homesteads, North Kona, Hawaii, TMK: 7-1-5: portion of 7. (SEE EXHIBIT C) As there were no objections by the applicants on the remaining items on the agenda, the Commission took up the following item out of order at the request of the applicant due to time constraints that Mr.Tsukazaki had to catch an off-island flight. SPP 1215The Commission took this item up at 2:00 p.m. with DOUTOR COFFEEapproximately 19 people from the public in attendan HAWAII CO., INC. ND HIENALOLI 2, NORTH KONA 3 APPLICANT: DOUTOR COFFEE HAWAII CO., INC. (SPP NO. 1215 Î formerly referred to as SPP 02-010) Doutor Coffee Hawaii Co., Inc.'s request to the Planning Commission to consider a Motion to Amend Something Previously Adopted in regard to Special Permit No. 1215, which allowed public tours of the existing coffee farm, proposed retail sales of non-agricultural products, and related parking area on approximately 12 acres of a 28.47-acre lot situated within the State Land Use Agricultural District. The property is located on the west (makai) side of Mamalahoa nd Highway, approximately 300 feet south of the Keopu Cemetery, Hienaloli 2, North Kona, Hawaii, TMK: 7-5-11:portion of 24. (SEE EXHIBIT D) SLU 03-010/REZ 03-024The Commission took this item up at 3:47 p.m. with VERIZON HAWAII, INC.approximately 19 people from the public in attendance. KEAHUOLU, NORTH KONA APPLICANT: VERIZON HAWAII, INC. (SLU 03-010/REZ 03-024) a.State Land Use boundary amendment for 2.821 acres from the Agricultural to the Urban District. b.Change of Zone for 2.821 acres from an Agricultural 1-acre (A-1a) to a Village Commercial Î 10,000 square foot (CV-10) district. The property is the site of Verizon Hawaii, Inc.'s existing telecommunications switching facility situated along the southeast side of Palani Road and immediately makai of the Kailua Fire Station, Kailua-Kona, Keahuolu, North Kona, Hawaii, TMK: 7-4-8:20. Mr. Hayashi oriented the Commission and public of the subject and surrounding properties on the location map and site plan, summarized the requests and noted the Planning Director recommended approval of the applications with conditions, with amendments to Conditions F and G as noted in the DirectorÓs memorandum to the Planning Commission. The applicantÓs representative, Sandy Padeken, proposed amendments to the various conditions of approval (SEE EXHIBIT E), highlighting the insertion of the words Ðat the time the subject property is developed,Ñ to Conditions, C, D, E, F, H. I, K, L as it was their intent to se property to a subsequent party who would be the developer and they wanted it clarified that when the subject property is developed is when all of the infrastructure improvements would take place. There was no one from the public wishing to testify on this agen Regarding the State Land Use Boundary Amendment, it was moved by and seconded by Commissioner Fujikawa to send a favorable recommendation to the Hawaii County Council based on and incorporating the Planning DirectorÓs recommendation. A roll call vote was taken and motion carried eight ayes (Kubota, Fujikawa, McCall, Mina, Smith, Springer, Thibadeau and Galdones) and one absent and excused (Graham). Regarding the Change of Zone Application, it was moved by Commissioner Kubota and seconded by Commissioner Fujikawa to send a favorable recommendation to the Hawaii County 4 Council based on and incorporating the Planning DirectorÓs recommendation, with amendments to Conditions F and G, as well as the amendments proposed by the McCall requested the DirectorÓs comments on the applicantÓs proposed amendments. Mr. Yuen said he would prefer to have more specific time frames as to when the improvements are required since there may be a questioned raised as to what does it mean Ðat the time the subject property is developed,Ñ noting one could say that the property is being developed as soon as they start to do any work. Commissioner Fujikawa agreed with Commissioner Kubota to withdraw the part of the motion of accepting the applicantÓs proposed amendments as they agreed with the Director. A roll call vote was taken and motion carried eight ayes (Kubota, Fujikawa, McCall, Mina, Smith, Springer, Thibadeau and Galdones) and one absent and excused (Graham). SLU 03-011/REZ 03-026The Commission took this item up at 4:05 p.m. with ULUWEHI PROPERTIESapproximately 17 people from the public in attendance. PUAPUAANUI, NORTH KONA APPLICANT: ULUWEHI PROPERTIES (SLU 03-011/REZ 03-026) a.State Land Use boundary amendment for 9.095 acres of land from the Agricultural to the Urban District. b.Change of Zone for 9.095 acres from an Agricultural 5-acre (A-5a Residential Î 15,000 square foot (RS-15) district. The property is located along the southwest (makai) side of Hualalai Road and also makai of the Kona Orchard Subdivision, approximately 700 feet south of the Hualalai Road and Kahului- Hienaloli Road junction, Puapuaanui, North Kona, Hawaii, TMK: 7-5-17:21. PUAPUAA, NORTH KONA APPLICANT: SCD KAHAKAI, LLC (SMA NO. 304) Request to amend Special Management Area Use Permit No. 304 by increasing the number of allowable residential lots from 98 to 101. The area involved includes the Kahakai Estates Subdivision situated along the southwest (makai) side of Kuakini Highway and north-northeast of Kahakai Elementary School, Puapuaa, North Kona, Hawaii, TMK: 7-5-20:78 (formerly portion of 7-5-20: portion of 1). (SEE EXHIBIT G) 5 REZ 02-016The Commission took this item up at 5:55 p.m. with TOM TUSOapproximately 6 people from the public in attendance. ND PUAA 2, NORTH KONA APPLICANT: TOM TUSO (REZ 02-016) Continued hearing on the application for a Change of Zone for 8.773 acres from an Agricultural 5-acre (A-5a) to a Family Agricultural 3-acre (FA-3a) district. The property is located approximately 720 feet west (makai) of Mamalahoa Highway in the vicinity of the former Ferrari nd, Kona Coffee Plantation Store, Puaa 2North Kona, Hawaii, TMK: 7-5-12:38. Mr. Darrow oriented the Commission and public of the subject and surrounding properties on the location map and site plan, summarized the request and noted the Planning Director recommended approval of the application with conditions. He pointed out that the hearings of December 2002 and February 2003 were continued to obtain informa applicant had a legal access over the existing the 25-foot wide easement. Mr. Fuke stated the staffÓs background report was reviewed with the applicant who concurs with the proposed conditions. He said because it could not be determined that the applicant has legal access over the existing 25-foot wide easement at the top of the highway, they came up with an alternative which was receptive to the Planning Director. He said with or without the other property ownersÓ participation, the applicant is prepared to proceed with the improvements, noting they are hopeful that the property owners makai of the su roadway will contribute their fair share of the improvements. Alan Harada, surrounding property owner, said he has no objections to the proposed rezoning upon reviewing the proposal. He explained that the roadway was their access to their coffee land and he just paved over a 10-foot road section because the idea was that it would only be used by his family and the Mori family. He said because other people ha will be looking into this matter further with his attorney. In response to Commissioner SpringerÓs inquiry, Mr. Darrow noted that ÐHonuauluÑ is the correct word in the background report and recommendation and that the words Ðrelated nd improvementsÑ in the recommendation on page 5, 2 paragraph, last line, should be deleted. th Mr. Darrow pointed out that Dolores WagnerÓs letter received November 28 requested that the matter be continued until the next Kona meeting. Commissioner Kubota said felt the Commission already has continued the hearing for a considerable amount of time and felt it had enough material to make a decision. It was moved by Commissioner Kubota and seconded by Commissioner Mina to send a favorable recommendation to the County Council as recommended by the Planning Director with editorial changes. A roll call vote was taken and motion carried with seven ayes (Kubota, Mina, Fujikawa, McCall, Springer, Thibadeau and Galdones) and two absent and excused (Graham, Smith). 6 RECESSEDThere being no further business, the Chair declared the meeting recessed at 6:10 p.m. on December 4, 2003. ELECTION OF The Commission took up the following under election 2004 OFFICERSof officers: It was moved by Commissioner Kubota and seconded by Commissioner Mina that the following individuals be nominated for the officers for 2004: Fred Galdones for Chairman; Earl Fujikawa for First Vice-Chairman, and Hannah Springer for Second Vice-Chairman. It was moved by Commissioner Smith and seconded by Commissioner McCall that the nominations be closed. Motion was unanimously carried by a voice vote of all Commissioners in attendance. MINUTESThe Commission took up the following minutes at this time. November 7, 2003 Î The Commission deferred approval of the minutes to a future meeting. ADMINISTRATIVEThe following were discussed under administrative matters: MATTERS Status of appeals filed on Planning Commission decisions Î Corporation Counsel Î Ms. OÓToole had no report to give on this matter. Other Commission matters Î Staff reviewed the 2004 meeting schedule with the Commission, who expressed their desire not to have Thursday meetings if at all possible. Report on Other Planning and Planning Related Projects Î Staff reviewed these projects with the Commission (SEE EXHIBIT H).
