HomeMy WebLinkAbout2003-10-03 Planning Commission Minutes PLANNING COMMISSION COUNTY OF HAWAIÒI MINUTES OCTOBER 3, 2003 The Planning Commission met in regular session at 9:00 a.m. in the Ohana Keauhou Beach Resort, Kahaluu Ballroom, 78-6740 Alii Drive, Keauhou, North Kona, Hawai`i, with Chairman Fred Galdones presiding. Yuen, Planning Director Norman Hayashi, Planning Program Manager Phyllis Fujimoto, Staff Planner Jeff Darrow, Staff Planner Kiran Emler representing Department of Public Works The Chair introduced the Commissioners and staff to members of t REZ ORD. 97-49The Commission took these items up at 9:02 a.m. with AND SMA NO. 412approximately 25 people from the public in attendance. THE BAY CLUB OWNERSHIP, INC. ANAEHOOMALU, SOUTH KOHALA APPLICANT: THE BAY CLUB OWNERSHIP, INC. (REZ ORD. 97 49/SMA USE PERMIT NO. 412) a.Request for time extension to condition B (time to secure Plan Approval) of Change of Zone Ordinance No. 97 49, which rezoned 9.643 acres fr (O) to the Resort-Hotel 2-acre (V-2a) district. b.Request for a time extension to condition 4 (time to secure Plan Approval) of Special Management Area Use Permit No. 412, which allowed the development of a recreational/restaurant/office complex, four single family dwellings, and other related improvements. 1 The property is located at the south end of Anaehoomalu Bay and abuts the South Kohala-North Kona District boundary, Anaehoomalu, South Kohala, Hawaii, TMK: 6-9-7:15. Mr. Darrow oriented the Commission and public of the subject and surrounding properties on the location map and site plan, summarized the requests, and noted the Planning Director recommended approval of the applications with conditions, as amended. In response to Commissioner KubotaÓs inquiry, Mr. Hayashi said the Planning Department has not made any recommendation to Mr. FukeÓs memoran September 23, 2003 in which he requests Condition N also be amen request came in after the publication of the hearing by the Commission. Mr. Yuen felt the Commission should not act on this request as it was not duly advertised. The applicantÓs representative, Brian Nishimura, stated the background report and recommendation are acceptable to the applicant and noted as they would not want to further delay the proceedings, they will accept the Planning DirectorÓs recommendation that the Commission not act on Mr. FukeÓs September 23, 2003 request to amend Condition N. There was no one from the public wishing to testify on this agen Regarding Condition B of Change of Zone Ordinance No. 97 49, it Commissioner Kubota and seconded by Commissioner Springer to send a favorable recommendation to the County Council based on and incorporating the Planning DirectorÓs recommendation. A roll call vote was taken and motion carried with seven ayes (Kubota, Springer, Graham, Mina, Smith, Thibadeau, and Galdones) and two absent and excused (Fujikawa and McCall). Regarding Condition 4 of SMA No. 412, it was moved Commissioner Kubota and seconded by Commissioner Springer to send a favorable recommendation to the County Council based on and incorporating the Planning DirectorÓs recommendations. A roll call vote was taken and motion carried with seven ayes (Kubota, Springer, Graham, Mina, Smith, Thibadeau, and Galdones) and two absent and excused (Fujikawa and McCall). SPECIAL PERMIT 1002The Commission took this item up at 9:19 a.m. with PARKER RANCH, INC.approximately 33 people from the public in attendance. WAIKOLOA, SOUTH KOHALA APPLICANT: PARKER RANCH, INC. (SPP NO. 1002) Request to amend Special Permit No. 1002, which initially allowed the establishment of an asphaltÎconcrete manufacturing facility on approximately 5.75 acres of land within the 2 State Land Use Agricultural District. The request is to increase the permit area to 14.75 acres and to also allow truck storage, parking, service, maintenance and fueling facilities, baseyards, car towing and storage facilities, and related uses. The area involved is located south of the existing West Hawaii Concrete facility and approximately 1,500 feet mauka of Hawaii Belt Road (State Highway 190), Waikoloa, South Kohala, Hawaii, TMK: 6-7-1: portions of 25 and 36. Mr. Darrow oriented the Commission and public of the subject and surrounding properties on the location map and site plan, summarized the request, and noted the Planning Director recommended approval of the application with conditions, as amended. The applicantÓs representatives, William Moore and Brandy Beaudet, were in attendance. Mr. Moore stated they did receive the Planning DepartmentÓs background report and recommendation and they have no objections to the proposed conditions on landscaping as it will address the concerns of visual impact of their facility and, also, screen the West Hawaii Concrete facility. In response to Commissioner KubotaÓs inquiry, Mr. Moore explained that traffic will be reduced as the truck operators already working in this general area would now able to obtain fuel and park in this area rather going to Waimea, Kawaihae or Kona. There was no one from the public wishing to testify on this agenda item. Mr. Yuen could not respond to Commissioner GrahamÓs inquiry on why the State Land Use Commission did not express their concerns, as it did with many other applications, of projects that appear to be parceled into 15 acres of less to avoid consideration by the Land Use Commission. It was moved by Commissioner Kubota and seconded by Commissioner Springer that the application be approved based on and incorporating the Planning DirectorÓs recommendation. A roll call vote was taken and motion carried with seven ayes (Kubota, Springer, Graham, Mina, Smith, Thibadeau, and Galdones) and two absent and excused (Fujikawa and McCall). SMA 03-011The Commission took this item up at 9:30 a.m. with KOA VENTURES, LLCapproximately 35 people from the public in attendance. PUAPUAA, NORTH KONA APPLICANT: KOA VENTURES, LLC (SMA 03-011) Special Management Area Use Permit to allow the construction of a 4-story, 32-unit condominium building and related improvements. The property is makai side of Alii Drive, between the Casa De Emdeko condominium Kona Isle condominium complex, Puapuaa, North Kona, Hawaii, TMK: 3 (SEE EXHIBIT A) RECESSEDThe Chair called a short recess at 10:42 a.m. RECONVENEDThe meeting reconvened at 10:52 a.m. SMA 03-012,The Commission took these items up at 10:52 a.m. with UP 03-002, ANDapproximately 35 people from the public in attendance. UP 03-003 RUTTER/ KW KOHANAIKI, LLC KOHANAIKI, NORTH KONA APPLICANT: RUTTER/KW KOHANAIKI, LLC (SMA 03-012/ UP 03-002/UP 03-003) a.Special Management Area Use Permit to allow the development of a homes/home sites project, an 18-hole golf course and golf clubhouse, public coastal park facilities, and related improvements. b.Use Permit to allow the development of an 18-hole golf course, golf clubhouse, and related improvements within the Resort-Hotel (V-1.25), Village Commercial (CV-10), Multiple Family Residential (RM-3), Single Family Residential (RS- 10), and Open (O) districts. c.Use Permit to allow the development of a major recreational faci an 18-hole golf course and related improvements) within the Limited Industrial (ML-10) district. The property is located between the Kaloko Honokohau National Park and the Ooma property, makai of the Queen Kaahumanu Highway (Highway 19), Koh Kona, Hawaii, TMK: 7-3-9:3 and 16. (SEE EXHIBIT B) MINUTESThe Commission took up the following minutes at this time, 3:18 p.m. September 11, 2003 Î It was moved by Commissioner Graham and sec Commissioner Kubota that the minutes be approved as circulated. Motion was unanimously carried by a voice vote of all Commissioners in attendance. September 22, 2003 Î The Commission deferred approval of the min meeting.
