Yuen, Planning Director Norman Hayashi, Staff Planner Daryn Arai, Staff Planner Phyllis Fujimoto, Staff Planner Jeff Darrow, Staff Planner Kiran Emler representing Department of Public Works The Chair introduced the Commissioners and staff to members of t As there were no objections from anyone, the Commission amended its agenda by taking up Agenda Item No. 2 at this time as the Hearings Officer who was travelling from Oahu had not arrived as yet. REZ 03-013The Commission took this item up at 9:08 a.m. with HUALALAI approximately 35 people from the public in attendance. VISTAS, LLC KOHANAIKI, NORTH KONA APPLICANT: HUALALAI VISTAS, LLC (REZ 03-013) Change of Zone for 53+ acres of land from an Agricultural 3-acre Agricultural 1-acre (FA-1a) district. The property is located along the west (makai) side of State Highway 190 (Hawaii Belt Road), adjacent to and south of the Kona Hills Estates Subdivision, Kohanaiki, North Kona, Hawaii, TMK: 7-3-7:27 and 50. 1 (SEE EXHIBIT A) SPP 01-010The Commission took this item up at 11:47 a.m. with DOUTOR COFFEEapproximately 19 people from the public in attendance. (SPP 02-010) Continued hearing, including the Hearing Officer's Findings of Fact, Conclusions of Law, and Recommendation, and any exceptions and/or oral arguments of the parties, on the application for a Special Permit to allow public tour of the existing coffee farm, proposed retail sales of non- agricultural products, and related parking area on approximately 12 acres of a 28.47-acre parcel situated in the State Land Use Agricultural District. The property is located on the west (makai) side of Mamalahoa Highway, approximately 300 feet south of the Keopu Cemetery, Hienaloli nd 2, North Kona, Hawaii, TMK: 7-5-11: portion of 24. KAHULUI, NORTH KONA APPLICANT: ERIC SOTO (SMA 03-007) Special Management Area Use Permit to allow the construction of a three and one-half story, 45- foot high, 12-unit multiple residential development and related 15,203 square feet of land. The property is located on the west (makai) side of Alii Drive, adjacent to and north of the Sea Village Condominium complex, Kahului, North Kona, Hawaii, TMK: 7-5-19:30. (SEE EXHIBIT C) SMA 03-008The Commission took this item up at 5:46 p.m. with KONA, HIapproimately 7 people from the pubic in attendance. HOSPITALITY GROUP, LLC. KAILUA-KONA, NORTH KONA 2 APPLICANT: KONA, HI HOSPITALITY GROUP, LLC (SMA 03-008) Special Management Area Use Permit to allow the construction of a 3-story, 76-room hotel and related improvements. The property is located along the south side of Sarona Road and across st from Kuakini Tower, Honuaula 1, Kailua-Kona, North Kona, Hawaii, TMK: 7-5-7:9. (SEE EXHIBIT D) REZ 03-010/The Commission took this item up at 6:41 p.m. with SMA 03-005approximately 6 people from the public in attendance. CLIFTOÓS KONA COAST, LLC ND OOMA 2, NORTH KONA APPLICANT: CLIFTO'S KONA COAST, LLC (REZ 03-010/SMA 03-005) a)Change of Zone from General Industrial 3-acre (MG-3a) to Project District for 83 acres of land. b)Special Management Area Use Permit to allow the development of residential complex consisting of offices, retail uses, multi-family housing, facilities for transient accommodations, and related improvements. The property is located along the west (makai) side of Queen Kaahumanu Highway (State Highway 19), approximately 2,100 feet south of the Queen Kaahumanu Highway Î NELHA nd Access Road, Ooma 2, North Kona, Hawaii, TMK: 7-3-9:22. (SEE EXHIBIT E) MINUTESAt 7:15 p.m., the commission took up the following: July 3, 2003 Î The Commission deferred approval of the minutes t ADMINISTRATIVE At 7:16 p.m., the Commission took up the following MATTERunder Administrative Matters: Appeal of Anthony Ako AnjoÓs appeal on the Vipassana Meditation Center - Mr. Torigoe noted that the Intermediate Court of Appeals affirmed the Circuit CourtÓs denial of as Mr. Anjo did not follow the proper intervention procedures to participate in a contested case. Planning Commission Attorney - Mr. Torigoe said the Office of Corporation Counsel periodically rotates assignments and he regretably informs the Commission that after today he will no longer be servicing the Planning Commission. He thanked the Commission for their professionalism and the courtesy extended to him. His parting words to the Commission were to base their decisions on what is only on the record and not by a CommissionerÓs personal comments or inquiries; to adhere to the Sunshine Law, and to please extend to Ms. OÓToole the same courtesy and kindness that the Commission has shown him, noting Ms. OÓToole is very 3 experienced and will serve the Commission well. The Commission and Planning Commission staff expressed their personal regrets in having Mr. Torigoe being reassigned and said they will surely miss him, but thanked him for his sound advice all these years and wished him well. th Planning Commission Meetings - Mr. Hayashi noted the August 14 Hilo meeting has been th cancelled and the next meeting is scheduled for September 11 in Kona.
