HomeMy WebLinkAbout2003-05-23 Planning Commission Minutes PLANNING COMMISSION COUNTY OF HAWAII MINUTES MAY 23, 2003 The Planning Commission met in regular session at 9:05 a.m. in the County Building, Councilroom - Room 201, 25 Aupuni Street, Hilo, Hawaii with Chai presiding. PRESENT:Fred GaldonesABSENT & EXCUSED: Earl Fujikawa William Graham Florence Kubota Hannah Springer Jeffrey McCall Aurelio Mina, Jr. Francis Smith Bill Thibadeau Ivan Torigoe, Deputy Corporation Counsel Christopher J. Yuen, Planning Director Norman Hayashi, Staff Planner Phyllis Fujimoto, Staff Planner Jeff Darrow, Staff Planner The Chair introduced the Commissioners and staff to members of t The Commission deferred approval of the minutes and administrative matters until the end of the agenda. SPECIAL PERMITThe Commission took this item up at 9:08 a.m. with VERNE A. WOOD &approximately 3 people from the public in attenda MELODY LYNN WOOD KEAAU, PUNA APPLICANTS: VERNE A. WOOD & MELODY LYNN WOOD (SPP NO. 870) Î Continued hearing on the request to amend Special Permit No. 870 to include the adjoining one- acre parcel of land, and to amend Condition No. 4 (complete construction) for the establishment of the Orchidland Trade Center in the State Land Use Agricultural District. The properties are th located in Orchidland Estates Subdivision at the northwest corner of Orchidland Drive and 34 Street, approximately 1,600 feet west (mauka) of its intersection with Keaau-Pahoa Road, in the vicinity of Wiki Wiki Mart, Keaau, Puna, Hawaii, TMK: 1-6-10:82 & 83. (SEE EXHIBIT A) USE PERMITThe Commission took this item up at 9:20 a.m. with SCOTT ANDREWS ANDone person from the public in attendance. CLAUDIA ROHR WAIAKEA, SOUTH HILO APPLICANT: SCOTT ANDREWS AND CLAUDIA ROHR (USE 03-001) - Application for a Use Permit to allow the establishment of a 3-bedroom bed and b existing single family dwelling within the County Single Family Residential (RS-15) zoned district. The property is located on the north side of Nene Street approximately 390 feet west of its intersection with Oeoe Street at Waiakea, South Hilo, Hawaii, TMK: 2-1-18: 5. Mr. Darrow oriented the Commission and public of the subject and surrounding properties on the location map and site plan, summarized the request, and noted the Planning Director recommended approval of the application with conditions, with an amendment to Condition No. 7. The applicants, Scott Andrews and Claudia Rohr, stated they did receive the background report and recommendation. Ms. Rohr stated she reviewed all the correspondences. She said that Aaron Ueno at the Health Department suggested she inform the Commission of her intent to provide continental breakfasts for their guests and that they understand the concerns of the Ar cleaning out the ponds and not filling them. She said that she will be posting at the establishment the tsunami and fire evacuation routes as approved by the Civil Defense and Fire Department. Mr. Andrews added Water Department has inspected and approved their backflow preventer and will be informing the Planning Department of this in writing. Ms. Rohr said they were prepared to meet all of the conditions within the next week. For Commissioner GrahamÓs information, Ms. Rohrs said that the guest house is not to be used for a rental but family members only, noting their intent to have her husbandÓs mother and spouse or her siblings reside in the guest house. There was no one from the public testifying on this application. It was moved by Commissioner Springer and seconded by Commissioner McCall that the application be approved based on and incorporating the Planning DirectorÓs recommendation, with Condition No. 7 amended to read, ÐThe applicant shall comply with the requirements of the Department of Water Supply relating to the provision of potable water. The applicant shall also install a backflow preventer (reduced pressure type) meeting with the requirements of the Department of Water Supply prior to the start of the operation of the bed and breakfast establishment.Ñ A roll call vote was taken and motion carried with seven ayes (Springer, 2 McCall, Graham, Mina, Smith, Thibadeau and Galdones) and two absent and excused (Fujikawa and Kubota). CookÎ Mr. Torigoe reported that the papers for dismissal of this appeal in the Court have been filed.
