SUBJECT: SPECIAL PERMIT APPLICATION (SPP 21-000227)
Applicant: Kona Aerial Gymnastic Team Inc.
Request: To Legitimize the Operation of a Youth Gymnastic and
Sports Fitness Facility
TMK: 7-5-017:044
We have reviewed the supplemental information for the Leeward Planning Commission
dated October 28, 2021 as it relates to the Engineering Division and provide the following
comments:
The map depicting a temporary alignment does not indicate the following:
location of the floodzone,
location of fencing (to verify that it does not impact the floodzone) as depicted in
site photos provided by Mr. Terin Gloor,
location of concrete barriers (to verify that it does not impact the floodzone) as
depicted in site photos also provided by Mr. Gloor, and
location of construction activities.
The letter provided by Mr. Gloor certifies that the access road Ðis adequate for its intended
purposeÑ and Ðtypical of driveways in Hawaii and is consistent with Hawaii County
standardsÑ which is in reference to its construction. There is no mention regarding the
safety of customers navigating the property during construction activities. No indication
of where construction vehicles may be crossing the access road, no reference to signage
(ie. hours of construction, location of where construction vehicles may be crossing, yield
ahead/proceed with caution, etc.), or the use of flaggers when crossing the access road.
We have provided comments to Mr. Gloor regarding the No Rise Certification for the
access road. A No Rise Certification is required when proposed work is being done in a
special hazard floodzone and the fill quantities shall be either equal to or less than the cut
quantities and have no impact and no increase to the flood heights.

Based on Engineering Division comments above, the map as well as the letter from
Mr. Gloor regarding the access road does not appear to address all safety concerns.
However, the Engineering Division does not have the authority to restrict access within
private property which would be the liability of the property owner.
The Building Division had the following comments:
BuildingÓs investigation team performed an inspection in response to a complaint on this
property. The structure was permitted as an Agricultural Warehouse (no electrical and
no plumbing) under permit BK2019-01023. There were no framing or final inspections
completed on the structure and their investigation found unpermitted electrical and
plumbing installed. No as-built applications have been applied for. Since these items are
still outstanding, the Building Division would not support approval for occupancy. The
division would not be able to approve occupancy unless all the required permitting,
inspections, and agency approvals were received.
