HomeMy WebLinkAbout1000_01 Rules and Regulations SOP 202305171000.01 Rules and Regulations Standard Operating Procedure Implemented: May 2023 Revised: N/A Next Review: May 2026 This procedure is for internal use only and does not enlarge an employee’s civil liability in any way. The procedure should not be construed as creating a higher duty of care, in an evidentiary sense, with respect to third party civil claims against employees. A violation of this procedure, if proven, can only form the basis of a complaint by this department for non-judicial administrative action in accordance with the laws governing employee discipline. Related Policies: ADM 3.1 Code of Conduct Applicable HI Statutes: I. PURPOSE These rules and regulations cannot, nor are they expected to, provide a solution to every question or problem which may arise in an organization established to render emergency service. It is expected that they will be sufficiently comprehensive to cover, whether in a general or specific way, the obligations and duties of the members of the Hawai’i Fire Department. They are not designed nor intended to limit any member in the exercise of his judgement or initiative in taking the action a reasonable person would take in an extra-ordinary situations. Much, by necessity, must be left to the loyalty, integrity and discretion of members. II. APPLICABILITY Departmental Rules and Regulations are applicable to all members of the department, including Volunteers; and to all civilian employees of the department. All general and special orders, instructions (including those on departmental forms) and manuals shall have the same authority as Departmental Rules and Regulations. Departmental Rules and Regulations shall not be canceled, amended or issued without the specific approval of the Fire Chief. III. PROCEDURES Enforcement of these rules and regulations shall be done by the process as established by department policy and chain of command structure. The responsibility for such enforcement shall be as designated by the job descriptions, department policy, and/or as delegated by the chain of command.
