THE APPLICANT IS REQUESTING :
■ A SPECIAL PERMIT TO LEGITIMIZE THE OPERATION OF AYOUTH GYMNASTIC AND
SPORTS FITNESS FACILITYAND RELATED IMPROVEMENTS ONA2.3-ACRE PORTION
OF A 23.8-ACRE PARCEL LOCATED IN THE STATE LAND USE AGRICULTURAL DISTRICT.
■ TO CONVERT THE EXISTING 12,600 SF WAREHOUSE BY OBTAINING ALL NECESSARY
PERMITS FOR THE PROPOSED USE.
■ TO CONSTRUCT 38 PARKING STALLS, INCLUDING 2 ADA STALLS.
■ TO PROVI DE ACCESS TO THE PERMIT AREA BY 12-15-FT WIDE, 1 ,000 -FT LONG
GRAVEL DRIVEWAY
■ TO OPERATE THE YOUTH GYMNASTICS FACILITY MONDAY - FRIDAY, 2:OOPM - 7:30PM,
AND SATURDAY, 8:OOAM TO 3:OOPM. THE SPORTS FACILITY WILL OPERATE MONDAY -
FRIDAY, 6:OOAM - 9:OOPM AND SATURDAY, 10:OOAM - 5:OOPM. SUMMER PROGRAMS
WILL OPERATE DURING SCHOOL SUMMER BREAKS (MAY - AUGUST) WITH
GYMNASTICS CLASSES HELD MONDAY/WEDNESDAY/FRIDAY, 7:30AM - 3:30PM, AND
TUESDAY/THURSDAY, 3:OOPM - 7:OOPM.
UPDATE FROM THE LAST LEEWARD PLANNING COMMISSION (LPC) HEARINGS ON THIS
APPLICATION:
■ SEPTEMBER 16, 2021 : THE LPC VOTED TO DEFER ITS DECISION ON THE MATTER UNTIL SUCH
TIME THAT THE APPLICANT HAS PROVIDED THE ENGINEERING SUPPORT REQUESTED BY THE
COMMISSION, I.E. REPORTS FROM A STRUCTURAL ENGINEER DETERMINING WHETHER THE
EXISTING BUILDING AND ACCESS DRIVEWAYARE SAFE FOR THE PROPOSED USE.
■ OCTOBER 28, 2021 : THE APPLICANT PROVIDED SUPPLEMENTAL INFORMATION TO ADDRESS
THE REQUEST OF THE LPC, RELATING TO ENGINEERING REVIEWS OF THE STRUCTURE AND
ACCESS FOR THE REQUESTED USE.
■ NOVEMBER 12, 2021 : THE DEPARTMENT OF PUBLIC WORKS PROVIDED COMMENTS
REGARDING THE 10/28/21 SUPPLEMENTAL INFORMATION, STATING THAT "THE
LETTER...REGARDING THE ACCESS ROAD DOES NOT APPEAR TO ADDRESS ALL SAFETY
CONCERNS" AND THAT THE BUILDING DIVISION "WOULD NOT BE ABLE TO APPROVE
OCCUPANCY UNLESS ALL THE REQUIRED PERMITTING, INSPECTIONS, AND AGENCY
APPROVALS WERE RECEIVED."
■ NOVEMBER 18, 2021 : THE LPC CHAIR ANNOUNCED AT THE HEARING THAT THE APPLICANT
HAD REQUESTED A POSTPONEMENT OF THE HEARING DATE. THE CHAIR INDICATED HE HAD
GRANTED THE REQUEST TO ALLOW THE APPLICANT MORE TIME TO ADDRESS CONCERNS
INCLUDING THOSE OF THE DEPARTMENT OF PUBLIC WORKS.

RECOMMENDATION :
APPROVAL WITH CONDITIONS
THE DEPUTY PLANNING DIRECTOR RECOMMENDS REVISING THE FOLLOWING
CONDITIONS, IN ORDER TO CLARIFY TIMING:
■ Condition No. 5:
[ . Prior
to [ ] applying for a building permit, the applicant shall secure Final Plan Approval for the proposed development
from the Planning Director in accordance with Section 25-2-70, Chapter 25 (Zoning Code), Hawaii County Code. Plans shall
identify all existing and proposed structures, fences, signage, water sources (potable and non-potable), wastewater systems,
fire protection measures, paved driveway access and paved parking stalls, outdoor lighting (if any, lighting must be shielded
with light directed downwards), landscaping and other improvements associated with the proposed development.
■ Condition No. 10:
[ ]Within five (5) years from the effective date of this permit, the applicant shall align the
access driveway within the 60-foot wide future Kakalina Road extension alignment. This alignment shall be noted on all future
plans submitted to the County and shall be kept clear of any permanent structures.
■ Condition No. 17:
With the exception of condition No. 10, [Alan initial extension of time for the performance of conditions within the permit may
be granted by the Planning Director upon the following circumstances:
A. The non-performance is the result of conditions that could not have been foreseen or are beyond the control of
the applicant, successors or assigns, and that are not the result of their fault or negligence.
B. Granting of the time extension would not be contrary to the General Plan or Zoning Code.
C. Granting of the time extension would not be contrary to the original reasons for the granting of the permit.
D. The time extension granted shall be for a period not to exceed the period originally granted for performance (i.e.,
a condition to be performed within one year may be extended for up to one additional year).
