Antu Harvey Subject: Testimony—Oppose Rule 9-11 (4) Amendment Aloha Chairs DeFranco and Lin and Members of the Leeward and Windward Planning Commissions, On behalf of the Board of Directors of Pulama is Kona Heritage Council, Pulama OPPOSES this amendment until these conditions can be met: 1. Written Description—The Planning Department must clearly document that this • is prepared under signature of the Planning Department (not just a pass through from the applicant) • AND that it reflects adequate diligence (complies with the requirements and rules as a CLG (Certified Local Government)) • AND that it includes the CRC's (Cultural Resource Commission) review, information and recommendation BEFORE it is submitted. 2. Archaelogical Inventory Report - must restore original item (A). Until the CRC can be adequately integrated as the primary authority role in this procedure, to "protect and preserve natural and manmade historic resources", this submission should at least include the inventory report by a licensed archaeologist,AND that is reviewed and commented on by the CRC BEFORE being sent to SHPD for review. Pulama's concerns: It is unclear the current workflow (process) by the Planning Department adequately complies with HRS Section 2015A-2, subsection (b) Objectives. (2) Historic resources; - (A) Protect, preserve, and, where desirable, restore those natural and manmade historic and prehistoric resources in the coastal zone management area that are significant in Hawaiian and American history and culture. 1. How is the Planning Department pulling together information to support drafting the submission? Does the Planning Department proactively: "...maintain a system for the survey, inventory and nomination of historic properties and archaeological sites within the county, as well as a system of site monitoring, that is compatible with that of the State Historic Preservation Office? [County Chapter 2 Section 229 -1a Powers and Duties of the Commission—(311" 2. How is the Planning Department ensuring: "The (CRC) Commission shall provide design review for projects affecting any building or structure, site or district eligible for listing on the National or Hawaii Register of Historic Places and shall request and consider the State Historic Preservation Officer' s review and comment on all county undertakings, including the granting of permits. In its review, the Commission shall consider the cultural significance of the site and its surroundings along with the United States Department of the Interior, Secretary of the Interior' s Standards for Rehabilitation, as amended. Planning Director's stated rationale for proposing this amendment: Reasons for the amendments:The State Historic Preservation Division(SHPD)requires that all document review related to the HRS,6E-42(Historic Preservation Review) review process be done by the Planning Department submitting applications and studies to SHPD through their HICRIS(Hawaii Cultural Resource Information System)permitting system,rather than an applicant or landowner submitting the information directly to SHPD.The Department has been implementing this change in practice for several years,but this section of Commission Rule 9 has not been amended to reflect SHPD's current review process. Furthermore,this amendment will still require Applicants to include any information on any known historic,archaeological, and cultural resources that may exist on the subject property with their application.
