Dear Chairman Lim:
Subject: Deferral of January 6, 2023 Hearing, Robert J. Silber
Special Permit Application No. PL-SPP-2o22-0000i6;
Request to rescind deferral and request to hold a new hearing
The above application was scheduled for the January 6th, 2023, hearing.
On January 4th, the applicant requested a deferral, which was approved.
Two reasons were submitted to justify the request for deferral:
1. "We need additional time to review and respond to the numerous items of public testimony
that have been submitted recently." [Pipan, email to Darrow, January 4th, 2023]
2. "We would like...additional time to work with neighbors of the subject property on concerns
that have recently been brought up about the proposed use." [Pipan, letter to Darrow, January
4th, 2023]
Regarding the first reason: the applicant has had ample additional time (four months) to review
and respond to testimony that was submitted for the January 6th hearing date.
Regarding the second reason: the applicant reached out to the core group of neighbors who
opposed his application in order to address their concerns; however, the ensuing discussion, dialogue
and attempted negotiation did not succeed in resolving the neighbors' major concerns [see Footnote
below].
Each of the eight core neighbors involved in dialogue with the applicant remains convinced that the
applicant's project is not and cannot be in the best interests of the neighborhood. Therefore we
remain opposed to the applicant's Special Permit, and request that a new hearing date
be set, preferably July 7th, 2023.
Footnote: History and summary of discussion, dialogue, and attempted negotiation:

• On February 27th six of the core group of opposing neighbors met with Mr. Silber and his
partner to seek answers to our main concerns.
• Between that time and the present, Mr. Silber responded in a letter addressing some of our
concerns, then Mr. Silber and his partner again responded in a letter, answering twelve specific
questions about Lolia operations and the Special Permit application.
The conclusion of each of the group's neighbors signed below is that the applicant's responses failed
to satisfy the substantive concerns of the neighbors, and that further attempts at finding common
ground are futile.
