Subj: Silber request for mediation
Complainants in opposition to the application for a Special Permit for a retreat center on Lolia Place have received an
email from Robert Silber, applicant, suggesting a mediation process.
After discussion, the below signed complainants reject this request and reaffirm our request that the matter be
considered by the Windward Planning Commission—hopefully, as requested, at the commission's July meeting.
After discussions and emails with the applicant, we believe there are irreconcilable differences as well as "conditions on
the ground"that cannot be addressed
Moreover, having been involved in the complaint/application process for three and a half years we all share a lack of
trust both in applicant's willingness to abide by any conditions and in the county's inclination and capacity to monitor
and enforce compliance in any timely and effective way. For example, in the Planning Department's Notice of
Violation and Order, dated Dec 5, 2019, it clearly states:
"1. Immediately cease and desist the unpermitted commercial operations and overnight lodging
accommodations on the Property."
The applicant has never ceased operations; he currently has more than 10 separate listings on Airbnb; and the
Planning Department has failed to provide any enforcement of these violations for the past three and a half
years.
