Home My WebLink About2023-07-18 DRAFT DEM Rule Landfill Ban Recyclable WastesDRAFT 7/18/23 Georjean Adams DRAFT DEM Rule to Ban Designated Recyclable Wastes from County Landfills Article II of the COUNTY OF HAWAIʻI DEPARTMENT OF ENVIRONMENTAL MANAGEMENT RULES OF PRACTICE AND PROCEDURE Underlined is new text New Definitions Section 2-1-3 “Designated Recyclable Waste” (DRW) is waste that is prohibited from disposal in a County sanitary landfill because the director finds that a) collection locations and/or services are available to designated recyclable waste generators at a price that is less than the cost of solid waste disposal [how much less? current greenwaste only 25% tipping fee], b) the life cycle environmental costs are less than or the same as those of landfilling for the designated recyclable waste, and c) diversion from landfill for the designated recyclable waste would represent a reasonable [>5% or more?] reduction in landfill volume. The list of designated recyclable wastes is expected to change as criteria situations change over time. As of [date] the list of designated recyclable wastes are: 1. HI5 (as defined under the state of Hawai‘i Deposit Beverage Container Program) 2. Old Corrugated Cardboard (OCC) that is “clean” (not been contaminated with food or liquids; printing, labels and tape are acceptable) 3. NonHI5 Glass (as currently accepted at transfer stations = rinsed jars/bottles with necks) 4. Greenwaste (as described on hawaiizerowaste.org) 5. Scrap metal (as currently accepted at transfer stations) As of [date+1 year] the list of designated recyclable wastes are (amend with a repeat list above and delete if no longer meet the criteria, at least one a year): [See table at end as another way to present this] 1-5) list above 6. ?? Designated recyclable wastes listed above are exempt as not suitable for recycling if they are contaminated with food or hazardous materials, hard to clean, present hazardous physical handling characteristics. [Specify where it’s known there are problematic materials .] “Designated Recyclable Waste Generators” are persons or organizations as listed below as of the effective date indicated who discard designated recyclable wastes Large commercial businesses as of [effective [date] Large County government buildings as of [effective date] “Large Commercial Business” means a business with >x employees or >$y in sales “Large County Government Buildings” are those housing >x employees or generating > z tons of waste/year. DRAFT 7/18/23 Georjean Adams Rule 2-1-4 Annual Reporting by Listed Designated Recyclable Waste Generators Large Commercial Businesses and (whoever is responsible for operations of) Large County Government Buildings are required to submit an annual report to the department on their waste reduction and/or landfill diversion programs, including total volume waste and percent of each designated recyclable waste generated and methods they employed to achieve waste reduction and diversion from landfill. [come up with some kind of report form] Rule 2-3 Sanitary Landfill Operating Rules 2-3-1. All solid waste, except for prohibited materials and designated recyclable wastes brought by or on behalf of designated recyclable waste generators , shall be accepted at the sanitary landfill when properly deposited. Prohibited materials may be acce pted upon approval of the director. Designated recyclable wastes brought by or on behalf of designated recyclable waste generators may be accepted upon approval of the director. [haulers need some way to identify that the waste they are bringing is free of DRW from designated generators.] RULE 2-4 Reload Facility Operating Rules 2-4-1. All solid waste, except for prohibited materials and special handling materials and designated recyclable wastes brought by or on behalf of designated recyclable waste generators, shall be accepted at the reload facility when properly deposited. Prohibited materials and special handling materials may be accepted upon approval of the director. Designated recyclable wastes brought by or on behalf of designated recyclable waste generators may be accepted upon approval of the director.
