GRAVETT (SPP 05- A regularly advertised hearing on the application of 016) was called to order at 1:30 p.m. in the Hapuna Beach Prince Hotel, Hau/Lehua Room, 62-100 Kaunaoa Drive, Kohala Coast, Hawaii, with Vice-Chairperson Hannah Springer presiding. APPLICANT: DARRELYN M. GRAVETT (SPP 05-016) Application for a Special Permit to allow a 2-unit bed and breakfast establishment on 1.291 acres of land situated within the State Land Use Agricultural District. The property is located between the Holualoa Art Gallery and the Kona Imin Center on the mauka (east) side of the Old Government Road, Holualoa, North Kona, Hawaii, TMK: 7-6-3:13. SPRINGER:I€d like to call this meeting of the Hawaii County Planning Commission back into order. We€re on agenda item number 6. The applicant is Darrelyn M. Gravett. It€s an application for a special permit SPP 05-016 to allow a 2-unit bed and breakfast establishment on 1.291 acres of land situated within the State Land Use Agricultural District. The property is located between the Holualoa Art Gallery and the Kona Imin Center on the mauka (east) side of the Old Government Road, Holualoa, Kona, Hawaii, TMK: 7-6- 3:13. Mr. Darrow? DARROW:Thank you Madam Chair. If I may direct your attention to the location map. The area of this application is within the North Kona district of Hawaii. More specifically it€s located within Holualoa. This white line travelling in a north-south direction is the Mamalahoa Highway coming through Holualoa and the area of the application is identified with a blue dot. Right here in this particular area is a small road that comes between the Mamalahoa Highway called an Old Government Road. And again this is EXHIBIT D 1 between the Holualoa Art Center and the Kona Imin Center. There€s an access easement to the property through parcel 17 from the Old Government Road. This is the property plot (inaudible). The easement would come from the Old Government Road, come to the boundary and then follow the area identified in brown. The residence is identified with pink and the applicant has also submitted a floor plan identifying the 2 bedrooms that will be used for the bed and breakfast. The applicant in this case Darrelyn M. Gravett is requesting a special permit for a 2-unit bed and breakfast on 1.291 acres of land. The Planning Department as of today has not received any letters or comments objections from the public. We do have an added comment based on a comment we received from the Department of Water Supply. It has been handed out to the Commissioners. It is going to be a new number 6. And basically it is taking into account the concerns of the Department of Water Supply. The Planning Director is recommending that this application be approved by the Planning Commission. Are there any questions? SPRINGER:CommissionerAlameda? ALAMEDA:Mr.DarrowIwasjustwonderingwhomaintainsthatOldGovernment Road? Is it the owner? DARROW:I don€t believe the owner maintains the Government Road. I believe the owner would maintain the access easement. As far as the Old Government Road basically it just says that it-, comments-, let me-, if you can give me one second here. Sometimes our comment letters from Department of Public Works will reflect who maintains the road. But in this particular case I don€t recall them specifying who maintains it. ALAMEDA:I guess it€s on the owner€s property when the road extends into-, it would be the owner? DARROW:Yeah, the Government Road does not extend into the-. Yes it€s a-. What happens here is you have the Government Road down here and then you have an easement that comes through another parcel. And I believe that is maintained by the owner. ALAMEDA:Okay thank you. DARROW:As far as the Old Government Road that€s probably maintained by the County. SPRINGER:Thank you. Other Commissioners? Commissioner Graham? GRAHAM:Jeff I just wanted to clarify one thing. I notice in the background report that the dwelling had a building permit in €78 and finalized in €80. But in the Department of Public Works letter we have the building division said that they opposed the approval because the building permit for the subject dwelling was never finaled. Do they mean a different one for this other one maybe? I believe that is from the ohana dwelling that was because according to our records the actual permit for the-. Now there was a question in talking to the applicant along with a building permit there€s also electrical and plumbing permits and I-, in EXHIBIT D 2 talking to the applicant it appears although the building permit was approved I think the electrical and plumbing permits were not finalized. And we can clarify that with her and I think she€s in the process of finalizing those permits. SPRINGER:Other Commissioners? MIKKELSON:Hi my name is Lori Mikkelson. I€ve been working with Darrelyn on her project. This is Darrelyn Gravett. SPRINGER:Okay, if I may swear you both in. MIKKELSON:My name is Lori Mikkelson. Post Office Box 291 Laupahoehoe, Hawaii. SPRINGER:Thank you and whomever is going to speak first may do so. Have you had an opportunity to review the Hawaii County Planning Department€s Background Report and Recommendations and do you have any comments on those? GRAVETT:Yes I have had a chance to review it and I have no comment at this time. Thank you. SPRINGER:Ma€am? MIKKELSON:There was a question about the permits and the existing ohana permit that was never completed. That was obtained by a previous owner and although it was granted to them there was never anything done with that. As far as the rest of it goes Darrelyn€s been working with her-, a contractor. She had, the original electrician had passed away so she had to get a different one but all that€s been resolved and now moving forward to get the electrician-? GRAVETT:Actually the original building was opened and inspected and finaled. It was an enclosure, an addition. The original building was built in 1978 as my records show and that€s my understanding. But in 1984 a permit was filed for, it was opened and never closed to enclose the downstairs into a rec. room with a bathroom and a bar sink. And in that EXHIBIT D 3 process of trying to tidy up these little pieces that I found when I bought the house last Fall, I find that the original electrical contractor has deceased. So theKona Building Division electricalinspector was going to close to permit for me and asked that a electrical contractor who was in there recently open a permit and sign off on it and call him in for inspection.
