SMITH (SLU O5-003/REZ A regularly advertised hearing on the application of 05-011) was called to order at 9:07 a.m. in the King Kamehameha's Kona Beach Hotel, Islander Room, 75-5660 Palani Road, Kailua-Kona, Hawaii with Chairman Fred Galdones presiding. PRESENT:Fred GaldonesABSENT & EXCUSED: Hannah Springer C. Kimo AlamedaAllen Salavea Jeffrey McCall Rodney H. Watanabe Rene€ Siracusa William R. APPLICANT: MARTIN E. SMITH (SLU O5-003/REZ 05-011) a.State Land Use boundary amendment for 5.304 acres from the Agricultural to the Rural district. b.ChangeofZonefor5.304acresfromanAgricultural5-acre(A-5a)districttoa Residential and Agricultural 2-acre (RA-2a) district. The property is located along the south side of Kanehoa Street, approximately 450 feet west of the Kanehoa Street-Anekona Street junction, Kanehoa Estates Subdivision, Ouli, South Kohala, Hawaii, TMK: 6-2-11:30. GALDONES:Agenda item number 1. Applicant is Martin E. Smith, SLU 05-003/REZ 05-011. This is State Land Use boundary amendment for 5.304 acres from the Agricultural to the Rural district. This also is a Change of Zone for 5.304 acres from an Agricultural 5-acre (A- 5a) district to a Residential and Agricultural 2-acre (RA-2a) district. Norman? HAYASHI:Thank you Mr. Chair. I€m not sure if you€re able to see the maps on the wall. Excuse me. First of all as far as the location of the subject property I€ll refer to the Planning Commission€s overall location map. And the subject property is within the Anekona Estates subdivision that is in this general configuration. Adjacent to that is the Kanehoa subdivision further mauka. This is the Waimea-Kawaihae Road. This would be in the Waimea direction and the Kawaihae direction would be this way to the west. The colors on the map indicate the various zoning districts. The green shaded areas, this light green shaded area are EXHIBIT A 1 lands that are designated agricultural 5-acres. We also have agricultural 3-acre zone lands indicated by the blue color. Excuse me, across the street which is Waimea landmark estates subdivision and we also have the areas that are indicated in orange which are within the State Land Use Rural district and also zoned Residential Agricultural 2-acre. And basically these are recent rezonings over the past 5 years. We also have the Ouli self-help housing project that is located here. These lots are basically 10,000-sq. ft. to 19,000-sq. ft. in size. The applicant intends to subdivide the property into 2 lots in this general configuration. This is Kanehoa Street and there is an easement, which is, referred to as easement 22 or Ahu Place and that goes through the property. This easement is part of the subject property. So basically the access for the rear lot would be from the easement 22 which also services approximately 8 other lots in this area. Access from this particular property could either be from the easement 22 or from Kanehoa Street. The adjacent property to the-, there€s a single family dwelling on this particular property which was also reclassified and rezoned to Residential Agriculture 2 acres. Other lands in the area are either vacant or used for pastoral purposes and there are other single-family dwellings alsowithinthe-,bothsubdivisionsAnekoaEstateSubdivisionandKanehoaSubdivision.Water is available to the subject property for the proposed development. We are recommending approval of both applications with proposed conditions. And basically these conditions are generally the same as those that were imposed for previous rezoning applications. Are there any questions? GALDONES:Commissioners are there any questions Norman? Commissioner Alameda? ALAMEDA:Norman just for my own information. So that€s pretty much the protocol then, before you can rezone a property such as this you gotta get one amendment for the boundary amendment? HAYASHI:That is correct. And since this property is less than 15 acres the County Council would be the one to approve the State Land Use Boundary Amendment. So in taking a vote for this particular application you would vote first on the State Land Use Boundary Amendment and then for the Change of Zone. ALAMEDA:Okay thank you. GALDONES:Seeing no further questions will the applicant or its representative please step forward. Good morning Mr. Mooers please raise your right hand. Do you swear or affirm to tell the truth on this matter now before the Hawaii County Planning Commission? MOOERS:I do. GALDONES:Could you please state your name and residence address? MOOERS:My name is Greg Mooers. My address is P.O. Box 1101 in Kamuela. GALDONES:Mr. Mooers have you received a copy of the Background Report and the Recommendations and do you have any comments to those documents? EXHIBIT A 2 MOOERS:Yes I have received it and it is pretty much identical to all of the other 30 that have been done in this neighborhood. We have no objections to any of the conditions as proposed. GALDONES:Commissioners are there any questions of Mr. Mooers? Commissioner Graham? GRAHAM:Greg, we have a long letter from the Department of Health in the Background about applications for NPDES. He has a permit already can you just in layman€s words explain to us what that involves-? MOOERS:Well, I think what the Department of Health has done is basically outline the requirements for NPDES permit. I don€t believe one will be required for this site because it doesnotdrainintonavigablewaters.Itdoesnot-,theywon€tbegradingthatmuchareasoI don€t think it applies here. So it€s one of those cases where I think the Department when they responded to the request just said okay. It€s like the fire department saying here our fire code requirements and so it does not apply to this property. GALDONES:Any further questions? Seeing none, Mr. Mooers do you have any closing statements? There being none. Norman, in the recommendation there is the recommendation for the State Land Use Boundary Amendment. There also, there€s the change of zone recommendation? HAYASHI:Yes that€s correct there are 2 recommendations. For the State Land Use Boundary amendment if you notice there are no conditions. What we do is impose those conditions at the zone change. GALDONES:Commissioners taking it one item at a time in reference to State Land Use Boundary Amendment it comes with a recommendation for approval and submitted-, a favorable recommendation be given and submitted to the County Council for approval. ALAMEDA:I€ll make a motion. GALDONES:Commissioner Alameda? ALAMEDA:I move that a favorable recommendation be forwarded to the County Council regarding application for the boundary amendment SLU 05-003 based on the Planning Director€s recommendation. SIRACUSA:Second. GALDONES:It has been moved by Commissioner Alameda and seconded by Commissioner Siracusa on Martin E. Smith application for State Land Use Boundary Amendment SLU 05-003 be given a favorable recommendation and be forwarded to the County Council. Discussion? Seeing none Norman? HAYASHI:That would go to the County Council. GALDONES:Okay. Commissioners the Director recommends a favorable recommendation also and be forwarded to the County Council. Motion is in order. WATANABE:I move that a favorable recommendation be forwarded to the County Council on application for a Change of Zone application REZ 05-011 based on the Planning Director€s recommendations.
