(SLU 05- A regularly advertised hearing on the application of 004/REZ 05-013) was called to order at 10:10 a.m. in the King Kamehameha's Kona Beach Hotel, Islander Room, 75-5660 Palani Road, Kailua-Kona, Hawaii with Chairman Fred Galdones presiding. PRESENT:Fred GaldonesABSENT & EXCUSED: Hannah Springer C. Kimo AlamedaAllen Salavea Jeffrey McCall Rodney H. Watanabe Rene€ Siracusa William R. Graham Chris Yuen, Deputy Planning Director Norman Hayashi, Planning Program Manager Phyllis Fujimoto, Staff Planner Jeff Darrow, Staff Planner Ivan Torigoe, Deputy Corporation Counsel And approximately 3 people from the public in attendance. APPLICANT: LAVA KUAKINI, INC. (SLU 05-004/REZ 05-013) a.State Land Use boundary amendment for 14 acres from the Agricultural to the UrbanDistrict. b.Change of Zone for 14 acres from an Agricultural 5-acre (A-5a) to a Multiple Family Residential  2,500 square foot (RM-2.5) district. The property is located along the northeast side of Kuakini Highway, adjacent to and south of the Kona Hillcrest Subdivision, Kahului 1, North Kona, Hawaii, TMK: 7-5-17:portions of 2 and 5. st GALDONES:Commissioners we are on agenda item number 4. Applicant is Lava Kuakini, Inc. SLU 05-004/REZ 05-013. This is a state land use boundary amendment for 14 acres from the Agriculture to the Urban district and also a change of zone for 14 acres from an Agriculture 5-acre (A-5a) to a multiple family residential 2,500 square foot (RM-2.5) district. Jeff? DARROW:Thank you Mr. Chairman. Good morning members of the Planning Commission. The Planning Department is requesting a continuance of this matter based on our letter dated October 6, 2005. Hopefully all the Commissioners got a copy of that this morning. We€re requesting additional information to be provided by the applicant before issuing a recommendation. Additionally I want to mention that Mr. Gimpel stopped by and submitted written testimony that will submitted on the record in the file. EXHIBIT D 1 GALDONES:Jeff was there any response to the letter and the action that you are proposing to the Commissioners for a continuance from the applicant? DARROW:I believe the Planning Director and the applicants are meeting in regards to these issues but as far as anything written we have not received anything written. GALDONES:Mr. Yuen is there anything derogatory that, or some concerns that we need to be aware of? YUEN:Well I know that they€re not objecting to the continuance. You know and it€s mostly access, road and access questions some drainage questions about the project. GALDONES:Okay. Commissioner Alameda? ALAMEDA:Thanks. Jeff will we get a copy of that Gimpel€s testimony later on? DARROW:Sure we can make that available to you. GALDONES:Jeff then it is my understanding that the applicant is not here today? DARROW:I did see Mr. Lim in the audience earlier I€m not sure where he€s at this time. GALDONES:Commissioners are there any questions of Jeff? Further discussion? Commissioner Siracusa? SIRACUSA:I would like to ask Mr. Torigoe if there€s anything that would preclude any legal reason that would preclude our granting the continuance at this point? TORIGOE:No I don€t think so. It seems as if the applicant is in agreement with this. Would that be accurate? SIRACUSA:Oh here comes Mr. Lim now. GALDONES:Mr. Lim we are on agenda item number 4, Lava Kuakini. Will the applicant or his representative please step forward? Mr. Lim will you please raise your right hand? Do you swear or affirm to tell the truth on this matter now before the Hawaii County Planning Commission? LIM:I do. GALDONES:Please state your name and residence address. LIM:Steven Lim, Carlsmith Ball, 121 Waianuenue Avenue. Thank you very much, sorry I was outside. EXHIBIT D 2 GALDONES:Mr. Lim what is before the Commissioners for consideration now is continuance and before we take any action on that we would like to give you the opportunity to comment on that. LIM:We agree with the continuance. We€d like to discuss further with the Planning Director the issues that he€s been raising on the application and we hope to resolve those and then come back to the Commission. GALDONES:Commissioners are there any questions of Mr. Lim. If not motion is in order to consider the continuance. Commissioner Alameda? ALAMEDA:With regard to application SLU 05-004/REZ 05-013 I make a motion that this particular application be continued at our next-, Phyllis correct me if I€m wrong Kona th meeting?November18? Is that correct? DARROW:Correct. SIRACUSA:Second. GALDONES:It has been moved by Commissioner Alameda and seconded by Commissioner Siracusa application by Lava Kuakini, Inc. SLU 05-004/REZ05-013 which is a State Land Use Boundary amendment and a change of zone be continued and be put on the th agenda at our next Kona meeting on November 18. Further discussion?
