NO. 7H12 <br />S.D. 1 <br />A BILL FOR AN ACT <br />RELATING TO THE UNIFORM AERONAUTICS ACT. <br />BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII: <br />1 SECTION 1. Section 263-10, Hawaii Revised Statutes, is <br />2 amended to read as follows: <br />3 "S263-10 Hunting from aircraft; penalty. (a) Any <br />4 aeronaut or passenger who, while in flight in, across, or above <br />5 the State, intentionally kills or attempts to kill any birds or <br />6 animals shall be guilty of a misdemeanor and punished by a fine <br />7 of not more than $1,000, or by imprisonment for not more than <br />8 one year, or both. <br />9 (b) Notwithstanding any other law to the contrary, state <br />10 employees and independent contractors retained by the State may, <br />11 while in flight in, across, or above the State, intentionally <br />12 kill or attempt to kill any wildlife in furtherance of official <br />13 state duties." <br />14 SECTION 2.
