NO. 7H12 S.D. 1 A BILL FOR AN ACT RELATING TO THE UNIFORM AERONAUTICS ACT. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII: 1 SECTION 1. Section 263-10, Hawaii Revised Statutes, is 2 amended to read as follows: 3 "S263-10 Hunting from aircraft; penalty. (a) Any 4 aeronaut or passenger who, while in flight in, across, or above 5 the State, intentionally kills or attempts to kill any birds or 6 animals shall be guilty of a misdemeanor and punished by a fine 7 of not more than $1,000, or by imprisonment for not more than 8 one year, or both. 9 (b) Notwithstanding any other law to the contrary, state 10 employees and independent contractors retained by the State may, 11 while in flight in, across, or above the State, intentionally 12 kill or attempt to kill any wildlife in furtherance of official 13 state duties." 14 SECTION 2.
