HOUSE CONCURRENT
RESOLUTION
URGING THE DEPARTMENT OF LAND AND NATURAL RESOURCES TO WORK WITH
LOCAL HUNTERS TO ACCOMMODATE TRADITIONAL AND CUSTOMARY
NATIVE HAWAIIAN HUNTING PRACTICES AND CHANGE ITS POLICIES
BASED ON THE CONCERNS OF LOCAL HUNTERS.
1 WHEREAS, the powers and duties of the Department of Land
2 and Natural Resources (DLNR) pursuant to Chapter 183D, Hawaii
3 Revised Statutes, include managing and administering the
4 wildlife resources and enforcing the wildlife hunting laws of
5 the State; and
6
7 WHEREAS, Article XII, section 7 of the Hawaii State
8 Constitution, acknowledges the State's obligation to protect all
9 rights, customarily and traditionally exercised for subsistence,
10 cultural, and religious purposes and possessed by ahupua'a
11 tenants who are descendants of native Hawaiians who inhabited
12 the Hawaiian islands prior to 1778, subject to the right of the
13 State to regulate such rights; and
14
15 WHEREAS, the Legislature passed Act 210, Session Laws of
16 Hawaii 2016, that established the Game Management Advisory
17 Commission (Advisory Commission) within DLNR, that recommends to
18 the Board of Land and Natural Resources (Board):
19
20 (1) Policies and criteria regarding the management,
21 protection, and promotion of public hunting in Hawaii;
22 and
23
24 (2) Amendments to existing DLNR policies and procedures
25 relating to hunting; and
26
27 WHEREAS, each member of the Advisory Commission, except the
28 Chairperson of the Board, is required to be a licensed hunter in
29 Hawaii and have leadership experience in working directly with

1 local hunter or shooting organizations and at least one member
2 must have knowledge, experience, and expertise in the area of
3 native Hawaiian cultural practices; and
4
5 WHEREAS, the Advisory Commission, among other things:
6
7 (1) Consults with and advises the Board on any matter
8 affecting hunting, including proposed rules and
9 regulations;
10
11 (2) Assists in establishing criteria to be used in
12 determining whether an area is suitable for hunting;
13 and
14
15 (3) Assists DLNR on policies, plans, and procedures
16 related to the control of game mammals, including
17 aerial shooting activities by DLNR and its
18 contractors; and
19
20 WHEREAS, DLNR is engaged in aerial shooting of goats; and
21
22 WHEREAS, DLNR restricts the areas in which hunters may
23 track wild ungulates; and
24
25 WHEREAS, DLNR restricts the bag limit on wild goats; now,
26 therefore,
27
28 BE IT RESOLVED by the House of Representatives of the
29 Twenty-ninth Legislature of the State of Hawaii, Regular Session
30 of 2018, the Senate concurring, that DLNR is urged to work with
31 local hunters to accommodate traditional and customary native
32 Hawaiian hunting practices; and
33
34 BE IT FURTHER RESOLVED that DLNR is:
35
36 (1) Requested to find alternative methods of eradicating
37 wild ungulates, other than aerial shooting;
38
39 (2) Urged to expand the areas where hunters may track and
40 access wild ungulates; and

1 (3) Urged to increase the bag limit of wild goats from two
2 to four goats per hunter; and
3
4 BE IT FURTHER RESOLVED that certified copies of this
5 Concurrent Resolution be transmitted to the Chairperson of the
6 Board of Land and Natural Resources, the Chairperson of the Game
7 Management Advisory Commission, and the President of the Hunting
8 Association of Waianae.
