A BILL FOR AN ACT
RELATING TO WATERSHED AREAS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
1 SECTION 1. Chapter 183, Hawaii Revised Statutes, is
2 amended by adding a new section to part III to be appropriately
3 designated and to read as follows:

"§183- Watershed project; watershed management plans;
5 game management advisory commission approval. Any new watershed
6 project or the amendment of any existing watershed management
7 plan by the department, on land that is currently a game
8 management area or public hunting area, shall require the
9 approval of the game management advisory commission established
10 pursuant to section
183D-4.5."
11 SECTION 2. Section 183-1, Hawaii Revised Statutes, is
12 amended by adding two new definitions to be appropriately
13 inserted and to read as follows:
14 ""Game management area" shall have the same meaning as in
15 section 183D-4.
16 "Public hunting area" shall have the same meaning as in
17 section 183D-4."

1 SECTION 3. Section 183-31, Hawaii Revised Statutes, is
2 amended to read as follows:
3 "§183-31 Watershed areas. The department of land and
4 natural resources shall determine, after public hearing held in
5 the same manner as provided in section 91-3, areas which are
6 watersheds[—]; provided that if a proposed watershed area will
7 be on land that is currently a game management area or public
8 hunting area, determination of an area to be a watershed shall
9 require the approval of the game management advisory commission
10 established pursuant to section 183D-4.5.
11 The term "watershed" as used in this part means (1) an area
12 from which the domestic water supply of any city, town or
13 community is or may be obtained, or (2) an area where water
14 infiltrates into artesian or other ground -water areas from which
15 the domestic water supply of any city, town or community is or
16 may be obtained."
17 SECTION 4. This Act does not affect rights and duties that
18 matured, penalties that were incurred, and proceedings that were
19 begun before its effective date.
20 SECTION 5. Statutory material to be repealed is bracketed
21 and stricken. New statutory material is underscored.

Requires the Department of Land and Natural Resources to obtain
the approval of the Game Management Advisory Council when
designating an area as a watershed, conducting a new watershed

hunting area.
